Eligibility Criteria

Tenders from Joint ventures are not acceptable.

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

Bidders shall ensure upload of relevant document certifying his/her status as Scheduled Caste/ Scheduled Tribe/other reserved category as prescribed in the tender document.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

Prices: Quoted price shall be inclusive of Packing & Forwarding, Provident Fund & Excluding GST. The statutory levies such as IT etc. will be recovered at prevailing applicable rates from the bills. Please furnish registration copies of IT PAN, GSTIN, and Independent PF code. Quoted basic rates shall be FIRM throughout the period of contract. Any subsequent variations in taxes and duties shall be to the account of KPCL. No extra charges will be paid on account of price variation of material and labour etc. No price variation will be allowed whether in cost/labour/materials or any other factors affecting process or services.

Taxes and Duties: Taxes such as GST prevailing as on the date of offer shall be quoted as in price schedule. Any variation whether upward or downward in taxes and duties shall be to the account of KPCL.

Transportation, accommodation and conveyance: Contractor has to arrange for To and Fro transportation and conveyance of his workmen. Accommodation for the engineer will be provided at KPCL guest house on chargeable basis subject to availability or otherwise firm shall make their own arrangement for their stay during work.

Transportation: Safe and Secure transportation of all materials & accessories and transit insurance from Contractor work shop to RTPS, Shaktinagar shall be arranged by Contractor. Necessary loading/ unloading of all materials & accessories at RTPS shall be in contractor scope. KPCL crane for loading/ unloading of materials at RTPS will be provided subject to its availability or otherwise contractor shall hire private crane for loading/ unloading.

Terms of Payment: 100 % Payment will be made in the form of NEFT/ RTGS after satisfactory completion of work and handing over of Site. Contractor shall furnish his bank account details along with Invoice.

Provident Fund: The Agency shall have their own independent P.F code and the contribution towards P.F to their Employees shall be made to their own independent code and proof of this shall be submitted along with the bills.

Work Completion period: Within Six months from the date of work order.(4 months for material Supply and 2 months for complete work execution) If there is any delay in handing over of site for erection, testing and commissioning from KPCL side, KPCL will extend the completion period

Guarantee period: The entire equipments (Both Supply & Erection) should be guaranteed for satisfactory operation at least for a period of 12 months from the date of commissioning. Any defect noticed during this period due to bad workmanship / materials defects shall be made well at free of cost by the supplier/Contractor.

Contract period: Contract period is work completion period plus guarantee period.

Quality: All the materials supplied shall be of highest quality and shall meet all the Indian Standard Specifications.

Validity: Validity of offer shall be 180 days.

EMD as indicated in the memorandum shall be paid online through KPP portal.a)The bidder may note the fact that their registration with any other authority does not entitle them for exemption from payment of EMD.b)If the bidder has not furnished the requisite EMD in the specified form as mentioned above, the said tender will be rejected.c)The Bidder or the tenderer is liable to be Blacklisted:1)If he withdraws his tender within the validity period as indicated in the memorandum or fails to execute the work after acceptance of the tender or fails to submit the Security Deposit.2)If he revises any of the terms quoted during the validity period.3)If, any of the document / information furnished by the bidder is found to be false after submission of the tender.4)The EMD validity period shall be 210 Days from the date of the Technical Bid open.

Agreement: The successful bidder shall attend the office of the Executive Engineer (CHP)E-1 RTPS within 20 days from the date of issue of LOI/work order along with security deposit for executing the agreement on stamp paper of appropriate value. Failure to do this will entail forfeiture of EMD. The cost of the stamp paper will be borne by the contractor. All the terms and conditions specified in the KPCL bid document shall be binding on the contractor and considered to be part of agreement.

Security Deposit (SD)/ Contract Performance Guarantee: i)The successful bidder shall deposit security deposit within 20 days from the date of issue of LOI/work order in the form of e BG drawn in favor of Karnataka Power Corporation Limited,RTPS, Shaktinagar, on any Nationalized Bank, for an amount equivalent to 5 percent of the contract amount. (Plus 5 percent additional security for unbalanced tenders). Furnished eBG shall be as per KPCL approved format. This Deposit shall not carry any interest. The KPCL reserves the right to forfeit the SD in case of any breach of contract.If the contractor fails to start the work as stipulated, the EMD and the SD shall be forfeited.ii)Security deposit (SD) shall be refunded after completion of the contract period including guarantee period subject to clearance of all dues and to the satisfaction of the KPCL. If KPCL incur any loss or damage on account of non-fulfillment of obligations under this contract, then such losses / damages incurred by KPCL shall be deducted from the security deposit. The amount so deducted / adjusted shall not be refunded to the tenderer.iii)If the whole or a part of the EMD / security deposit is adjusted / attached by KPCL for any default of tenderer in the due fulfillment of the contract during the contract period, then the contractor shall immediately arrange to replenish the amount of security deposit so attached / adjusted for the continued operation of the contract, failing which the contract is liable for termination by KPCL, the responsibility for which shall wholly rest with the tenderer.iv)In the event of any upward revision in the value of the contract arising on account of increase in the schedule of works, the KPCL reserves the right to call for additional security deposit amount and agency shall, on receiving intimation from the KPCL, increase the security deposit suitably as may be directed by the KPCL within 30 days.v)All compensations or other sums of money payable by the Contractor/agency, under the terms of this contract may be deducted from his security deposit or from any sums that may be due, or may become due to the Contractor by the Corporation on any account whatsoever and in the event of security deposit being reduced by reason of any such deduction, the Contractor shall, within 10 days thereafter make good the shortfall in the security deposit referred to above.vi)Note: Only e-BG shall be submitted by Agency in KPP portal.

Testing and Inspection: Testing & inspection of materials shall be offered to KPCL after receiving the materials at RTPS site.

The bidder can inspect the site on any working day during office hours in RTPS with prior intimation to the Executive Engineer (CHP) E-1

Penalty Clause: The Chief Engineer (FM) RTPS may terminate the agreement at his option at any time in case of bad workmanship, use of defective/ inferior quality materials or the work not being completed as per schedule.i)Supply part: If the material supply is delayed beyond the material supply period(Four Months), then contractor is liable for penalty of half (1/2) percent of the supply contract price of the delayed portion per week, subject to Maximum penalty of 5 % of the total material/Supply value.ii)Work Execution part: If the Installation, Commissioning and Testing is delayed beyond the work Execution period(Two Months) from the date of site handed Over, then contractor is liable for penalty of half (1/2) percent of the total work execution value per week of delay, subject to a Maximum penalty of 5% of the total Installation, Commissioning and Testing value.Chief Engineer (FM) RTPS is the final authority and having absolute discretionary powers to waive off or modify the penalty imposed.

The submission of tender by Contractor implies that he has read the contract schedules, conditions of contract, site conditions and has understood the scope and specifications of the work to be done and availability of the quantities of the materials and laborers required.

The Contractor shall pay statutory taxes levied by the State Government and City/ Municipal Corporations/ Local Bodies, etc.and also, royalty if any due to the Government of Karnataka at the prevailing rates during the contract period.

Income tax at prevailing rates and any other statutory recoveries shall be recovered from the bills.

The contractor shall be governed by the factory act, minimum wages act, EPF act, workmen compensation act, contract labour act and other relevant acts and rules as applicable to the labourers employed by him.

No part of the contract shall be sublet without written permission of the Chief Engineer (Fuel Management) RTPS, Raichur Thermal Power station, nor any transfer be made by Power of Attorney

The Contractor shall be responsible for any accidents to the workmen employed by him

Any loss or damage to Corporations property, due to negligence of the workmen employed by him, shall be made good as assessed by the Executive Engineer.

The tenderer should obey all the security rules of the KPCL/ RTPS/ CISF and labour rules in vogue

Safety equipment: Required safety equipments such as safety shoes, helmets, safety belts, hand gloves, facemask, goggles etc. must be provided to the workmen by the successful tenderer before commencement of work.

The Contractor shall pay compensation to his workmen in case of accidents, as per the Workmen Compensation Act. To facilitate prompt payment, the Contractor shall obtain an insurance policy to cover all workmen and submit to the Executive Engineer concerned before start up the work at site.

2Any accident shall be brought to the notice of the Superintending Engineer (CHP)E / Executive Engineer (CHP)E-1 and the Contractor shall comply with instructions issued in this regard by the Corporation. The Contractor shall comply with the provisions of relevant acts and rules as applicable.

The Contractor shall remit PF (employees and employers contributions) in respect of his workmen to the PF Authorities and submit the proof of payment to the Executive Engineer along with the Bill. Otherwise, Bills will not be accepted

Any or all disputes shall be settled by the Chief Engineer (Fuel Management) RTPS, Shaktinagar-584 170 & his decision shall be final and binding on all the concerned

The contract is liable for termination within three daysnotice if the work carried out by the Contractor is not satisfactory. Security Deposit shall be forfeited in such cases.

The Contractor shall not be entitled to any loss or damage in case the contract is to be suspended for some time due to any equipment break-down or shut down of the Unit/s for one or the other reason and for which he is not entitled for any compensation.

The Contractor shall keep the area of work neat and tidy. The contractor or his authorized representative shall be available for supervision of the work. The supervisor shall co-ordinate with concerned KPCL site engineers while executing the work

In the event of death or insolvency or insanity or imprisonment of the Contractor, the Corporation can terminate the contract by a Notice in writing pasted at the place of work. The corporation is not liable for the payment of compensation wages to the workmen employed by the contractor. Also, his legal heir, if an eligible registered contractor and willing, can execute and complete the work at the accepted rates irrespective of the cost of the work

All the released and excess items shall be returned/shipped to the KPCL stores/division store/designated location by the contractor

No overtime claims will be entertained by the Corporation.

Tools: The contractor should be self-equipped with sufficient number of tools and machines to execute the work.

Force Majeure: At any time during the continuance of this contract, if the performance in whole or in part of any obligation under this contract shall be prevented or delayed by reasons of any war, hostility, acts of public enemy, acts of civil commotion, strikes, lockouts, sabotage fires, floods explosions, epidemics, quarantine restrictions or other acts of God (hereinafter referred to as eventualities) then, provided notices of the happening of any such eventuality is given by the agency to the Corporation within 15 days from the date of occurrence thereof, neither party shall, by reasons of such eventuality, be entitled to terminate this contract, nor shall have any claim for damages against the other in respect of such non-performance or delay in performance/ deliveries under this contract work shall be resumed as soon as practicable after such eventuality has come to an end or ceased to exist, provided that if the performance in whole or part by the agency or any obligation under this contract is prevented or delayed by reasons of any eventuality for a period exceeding 60 days, both parties to the contract may at their option terminate this contract by a notice in writing.

If any additional information, not covered in this specification, if required, the contractor shall contact the Executive Engineer (CHP)E-1 / Superintending Engineer (CHP)E, RTPS, but it must be clearly understood that the tenderer is deemed to have accepted all the terms and conditions of the specification.

The contractor / Authorized representative should be available at site during execution of work.

If the rates quoted by the agency are abnormal, such offer is likely to be rejected as per the discretion of accepting authority.

Jurisdiction: Law courts of Raichur only.

Arbitration: Any dispute or difference or claim arising out of or in connection with or relating to present contract or the breach, termination or invalidity thereof shall be referred and settled under the arbitration center Karnataka (domestic and international) Rule 2012 by one or more arbitrations appointed in accordance with its rules

Technical Criteria

General

Minimum financial turnover (civil engineering construction works) not less than two times the annual payments from this contract (Rs. xxxxx Lakhs)

Satisfactoriy completed (atleast 90%) as prime contractor at-least one such similar work of value not less than Rs. xxxxxxx (80% of estimated cost of tender)

Executed in any one year the following minimum quantities of work (Cement Concrete - xxxx cum, Earthwork - xxxx cum, etc) (80% of peak rate of construction)

Tenderer or his identified Sub Contractor should possess valid Electrical License for executing building electrificatio works and should have executed similar electrical works totallng Rs. xxxxxx (not less than 50% of electrical works) n any one year

Tenderer or his identified Sub Contractor should possess valid license for executing water supply / sanitary engineering works and should have executed similar works totallng Rs. xxxxxx (not less than 50% of electrical works) n any one year

Owning the following key and critical equipment for this work (xxxx, xxxx, xxxx)

Liquid assets and /or availability of credit facilities of no less than Rs. xxxxxx Lakhs (estimated cash flow for 3 months of peak construction period)

Total value of civl engineering works executed and payments received in the last five years (year-wise)

List of existing commitments and ongoing works

List of works for which tenders already submitted

Banker Details for reference

Construction equipment owned by the tenderer and equipment proposed to be deployed on this contract, if awarded

The intending bidder should have satisfactorily as a prime contractor, at least one similar work such as supply and Commissioning of LT Breakers of value not less than Rs 49.09 Lakhs in the last five years (2021-22, 2022-23, 2023-24, 2024-25 and 2025-26) in any power stations/Process Industries. As a proof of this, the bidder should upload a work order and corresponding work done certificate issued by the competent authority. (Work done of Previous years shall be given weight of 10% per year to bring them to the present price level of the financial year).
