10.2. Financial Eligibility Criteria: Thetenderer must have minimum averageannual contractual turnover of V/N or 'V'whichever is less; where V= Advertisedvalue of the tender in crores of Rupees.N= Number of years prescribed forcompletion of work for which bids havebeen invited. The average annualcontractual turnover shall be calculatedas an average of "total contractualpayments" in the previous three financialyears, as per the audited balance sheet.However, in case balance sheet of theprevious year is yet to be prepared/audited, the audited balance sheet of thefourth previous year shall be consideredfor calculating average annual contractualturnover. Eligiblity criteria: -10.1 (a) The tenderermust have successfully completed orsubstantially completed any one of thefollowing categories of work(s) duringlast 07 (seven) years, ending last day ofmonth previous to the one in whichtender is invited: (i) Three similar workseach costing not less than the amountequal to 30% of advertised value of thetender, or (ii) Two similar works eachcosting not less than the amount equalto 40% of advertised value of thetender, or (iii) One similar work costingnot less than the amount equal to 60%of advertised value of the tender. (b) (i)In case of tenders for composite works(e.g. works involving more than onedistinct component, such as CivilEngineering works, S&T works,Electrical works, OHE works etc. and inthe case of major bridges - substructure, superstructure etc.),tenderer must have successfullycompleted or substantially completedany one of the following categories ofwork(s) during last 07 (seven) years,ending last day of month previous tothe one in which tender is invited:(i)Three similar works each costing notless than the amount equal to 30% ofadvertised value of each component oftender, or (ii)Two similar works eachcosting not less than the amount equalto 40% of advertised value of eachcomponent of tender, or (iii)One similarwork each costing not less than theamount equal to 60% of advertisedvalue of each component shall also beconsidered for fulfillment of technicaleligibility criteria for differentcomponents. (b) (2) In such cases,what constitutes a component in acomposite work shall be clearly pre-defined with estimated tender cost of it,as part of the tender documents withoutany ambiguity. (b) (3) To evaluate thetechnical eligibility of tenderer, onlycomponents of work as stipulated intender documents for evaluation oftechnical eligibility, shall be considered.The scope of work covered in otherremaining components shall be eitherexecuted by tenderer himself if he haswork experience as mentioned in clause7 of the Standard General Conditions ofContract or through subcontractorfulfilling the requirements as per clause7 of the Standard General Conditions ofContract or jointly i.e., partly himselfand remaining through subcontractor,with prior approval of Chief Engineer inwriting. However, if required in tenderdocuments by way of SpecialConditions, a formal agreement dulynotarised, legally enforceable in thecourt of law, shall be executed by themain contractor with the subcontractor for the component(s) of work proposedto be executed by the subcontractor(s),and shall be submitted along with theoffer for considering subletting of thatscope of work towards fulfilment oftechnical eligibility. Such subcontractormust fulfill technical eligibility criteria asfollows: The subcontractor shall havesuccessfully completed at least onework similar to work proposed forsubcontract, costing not less than 35%value of work to be subletted, in last 5years, ending last day of monthprevious to the one in which tender isinvited through a works contract. Note: for subletting of work costing upto Rs 50 lakh, no previous workexperience of subcontractor shall beasked for by the Railway. In case afteraward of contract or during execution ofwork it becomes necessary forcontractor to change subcontractor, thesame shall be done withsubcontractor(s) fulfilling therequirements as per clause 7 of theStandard General Conditions ofContract, with prior approval of ChiefEngineer in writing. Note:- SubstantiallyCompleted Work :- SubstantiallyCompleted Work means an ongoingwork in which payment equal to or morethan 90% of the present contract value(excluding the payment made foradjustment of Price variation (PVC), ifany) has been made to the contractor inthat ongoing contract and noproceedings of termination of contracton Contractor's default has beeninitiated. The credential certificate inthis regard should have been issued notprior to 60 days of date of invitation ofpresent tender. Note for item 10.1:Work experience certificate from privateindividual shall not be considered.However, in addition to work experiencecertificates issued by any Govt.Organisation, work experiencecertificate issued by Public listedcompany having average annualturnover of Rs 500 crore and above inlast 3 financial years excluding thecurrent financial year, listed on NationalStock Exchange or Bombay StockExchange, incorporated/registered atleast 5 years prior to the date of closingof tender, shall also be consideredprovided the work experience certificatehas been issued by a person authorizedby the Public listed company to issuesuch certificates. In case tenderersubmits work experience certificateissued by public listed company, thetenderer shall also submit along withwork experience certificate, the relevantcopy of work order, bill of quantities, billwise details of payment received dulycertified by Chartered Accountant, TDScertificates for all payments receivedand copy of final/last bill paid bycompany in support of above workexperience certificate.

The Railway may, of its own or in response to any clarification requested/ suggested by any person including that from the tenderer, may modify this tender document at its sole discretion at least 15 days before the due date of closing of the tender as corrigendum.
Corrigendum as required may be issued at least 15 days prior to the closing of the tender. The corrigenda of this tender, if any, as issued time to time will be available on website at least 15 days in advance of closing of tender. The tenderers are requested to check the website before submitting their offer whether any such corrigendum to the tender has been issued or not and revise the offer if required accordingly. Failure on the part of tenderer on this aspect will be solely tenderers responsibility.

The Railway and the website will have no responsibility for incorrect evaluation of cost and thereby incorrect cost of work and ranking of tenderers, if the schedule is not filled correctly and unambiguously for each item. Railway and the IREPS website will not take the responsibility for any online payment made by the tenderer and debited from his/their account towards the Earnest Money due to wrong or mismanipulation or any reasons related with the IT or found unsuitable for the tender etc. In this regard Railway and IREPS website will not entertain any claim or refund the paid amount. E- Tender Forms shall be issued free of cost to all tenderers.

INCONSISTENCY BETWEEN THE DOCUMENTS
The Indian Railways Standard General Conditions of Contract- April- 2022 (GCC-April-2022) with all correction slips up-to-date, Standard Schedule of Rate SSOR), CPWD Specifications 2019 Vol I & II and the USSOR [Unified Standard Schedule of Rates (Labour & Materials) & Indian Railway Unified Standard Specification shall be read with all correction slips issued thereto from time to time and shall form integral part of this tender document. In case of any difference, contradiction, discrepancy, with regard to Conditions o f tender/contract, Specifications, Drawings, Bill of quantities etc., forming part of the tender/ contract, the following shall b e the order of precedence: (i) Letter of Award/Acceptance (LOA) (ii) Bill(s) of Quantities (iii) Special Conditions of Contract (iv) Technical Specifications as given in tender documents (v) Drawings (vi) Indian Railways Standard General Conditions of Contract updated with correction slips issued up to date of inviting tender or as otherwise specified in the tender documents. (vii) Indian Railways Unified Standard Specification (IRUSS) updated with correction slips issued up to date of inviting tender or as otherwise specified in the tender documents, if applicable in thecontract. TENDERER S POSTAL ADDRESS
Address of tenderer: The address, email Id and Mobile phone, other phone nos. and other details given in the portal while registering will be considered as official address a n d all correspondences to the tenderer will be made in these registered modes. All communication sent in time to the tenderer by post at the said address shall be deemed to have reached the tenderer duly and in time. Important documents shall be sent by Registered Post. However, an undertaking has to be given in the enclosed annexure by uploading a scanned copy of duly filled in form in the portal.
THE SCHEDULE OF WORKS
The Schedules of Works is also available separately in the website online and Rates are to be quoted online and submitted online duly signed digitally.
INSPECTION OF DATA
Drawings for the work can b e seen in The office inviting this tender on any working day during working hours. The drawings are only for the guidance of tenderers. Detailed working drawings, if required based on the drawings mentioned above, will be given by the Engineer or his representative from time to time.
OPENING OF TENDER
Opening of e-tender online:- The e-tenders will be opened online using the IREPS portal. No representative is required to be present for opening of tender and taking notes of rates quoted and ranking as the complete details of rates etc. of all the bidders shall be available to the bidders in the website after the opening of the tender. In case of two packet system, technical bids will be opened first and financial bid will be opened in a subsequent date and time to be notified/intimated to those bidder whose technical bids are found acceptable. The tenderer must submit the documents in support of technical bids against eligibility criteria as mentioned in special technical criteria at para 4 and filled the financial bid on schedule.
In case the date of closing mentioned in the Notice Inviting Tender is declared a holiday/bandh/strike etc. on any account, the date of closing tender online will not be changed as the application in the website of IREPS does not permit submission of any offer after closing date and time of the tender. However, opening of tenders online will be on any convenient day after the closing date/time of tenders.
SUBMISSION OF DOCUMENTS IN SUPPORT OF ELIGILIITY CRITERIA, IF APPLICABLE:-
All documents in support of fulfillment of the eligibility criteria with respect to completion of similar nature of work for Technical Eligibility Criteria and minimum average annual contractual turnover for Financial Eligibility Criteria must be uploaded over the website www.ireps.gov.in with scanned copy in .Pdf format at the time of tender bidding with details in specified format (Annexure W & VIB).
The tenderer shall submit along with the tender document, documents in support of his / their claim to fulfill the eligibility criteria as mentioned in the tender document. Each page of the copy of documents/certificates in support of credentials, submitted by the tenderer, shall be self- attested / digitally signed by the tenderer or authorized representative of the tendering firm. Self - attestation shall include signature, stamp and date (on each page).
The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the Railway, make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification, by the railway shall not relieve the bidder of its obligations or liabilities here under nor will it affect any rights of the railway there under.
In case of any wrong information submitted by tenderer, the contract shall be terminated. Bid Security, Performance Guarantee (PG) and Security Deposit ( SD) of contract shall be forfeited and agency shall be debarred for doing business on entire Indian Railways for 2 (Two) years.
Tenderer are advised to take utmost care while scanning/uploading the documents related to their eligibility. Railway administration will not be responsible for improperly scanned/uploaded document, corrupt file, illegible documents etc.
The tenderer should ensure that the information/documents, being submitted in support of claim of qualifying the laid down eligibility criteria, are prepared in prescribed formats duly signed by an official authorized to do so. Documents issuing authority must furnish all relevant information in the prescribed format itself. Complete details of issuing authority should also be indicated in the document. Furnishing incomplete, illegible, vague information may lead to rejection of offer.
SUBMISSION OF COST OF TENDER FORM:
E-Tender Forms shall be issued free of cost to all tenderers.
SUBMISSION OF Bid Security: The Bid Security shall be deposited either in cash through e-payment gateway or submitted as Bank Guarantee bond from a scheduled commercial bank of India. The Bank Guarantee bond shall be as per Annexure-VIA and shall be valid for a period of 90 days beyond the bid validity period.
Tender must be accompanied with Bid Security of requisite amount as mentioned in NIT in A/c of P.F.A., S.E.C.Railway, Bilaspur deposited through Internet Banking or payment gateway only. i Any firm recognized by Department of Industrial Policy and Promotion (DIPP) as 'Startups' shall be exempted from payment of Bid Security deposit detailed above. ii Labour Cooperative Societies shall deposit only 50% of above Bid Security deposit detailed above.
In case, submission of Bid Security in the form of BankGuarantee, following shall be ensured:- i. A scanned copy of theBank Guarantee shall be uploaded on e-Procurement Portal(IREPS) while applying to the tender. ii. The original BankGuarantee should be delivered in person to the officialnominated as indicated in the tender document (i.e. OfficialAddress mean: Divisional Engineer/II/Raipur, Office of the Sr.Divisional Engineer/Co-ord/Raipur, DRM office Complex, NearWaltair Gate, P.O- WRS Colony, Raipur, Chhattisgarh- 492008)before closing date for submission of bids (i.e. excluding the lastdate of submission of bids). iii. Non submission of scanned copyof Bank Guarantee with the bid on e-tendering portal (IREPS)and/or non submission of original Bank Guarantee within thespecified period shall lead to summary rejection of bid. iv. TheTender Security shall remain valid for a period of 90 daysbeyond the validity period for the Tender. v. The details of theBG, physically submitted should match with the details availablein the scanned copy and the data entered during bid submissiontime, failing which the bid will be rejected vi. The BankGuarantee shall be placed in an envelope, which shall besealed. The envelope shall clearly bear the identification "Bid forthe ***** Project" and shall clearly indicate the name andaddress of the Bidder. In addition, the Bid Due Date should beindicated on the right hand top corner of the envelope. vii. Theenvelope shall be addressed to the officer and address asmentioned in the tender document. viii. If the envelope is notsealed and marked as instructed above, the Railway assumesno responsibility for the misplacement or premature opening ofthe contents of the Bid submitted and consequent losses, if any,suffered by the Bidder.
SOUTH EAST CENTRAL RAILWAY TENDER FORMS (FIRST SHEET) ANNEXURE-I
I/We have read the various conditions to tender attached hereto and agree to abide by the said conditions. I/We also agree to keep this offer open for acceptance for a period of 60 (Sixty days) days from the date fixed for closing of the tender and in default thereof, I/we will be liable for forfeiture of my/our "Bid Security". I/We offer to do the work for South East Central Railway, at the rates quoted in the attached bill(s) of quantities and hereby bind myself/ourselves to complete the work in all respects within as mentioned in NIT of this instant tender (months) from the date of issue of letter of acceptance of the tender.
I/We also hereby agree to abide by the Indian Railways Indian Railways Standard General Conditions of Contract- April- 2022 (GCC-April-2022) with all correction slips up-to-date and to carry out the work according to the Special Conditions of Contract and Specifications of materials and works as laid down by Railway in the annexed Special Conditions/Specifications, Schedule of Rates with all correction slips up-to-date for the present contract.
A Bid Security of Rs. (as mentioned in NIT of this instant tender) has already been deposited online/ submitted as Bank Guarantee bond. Full value of the Bid Security shall stand forfeited without prejudice to any other right or remedies in case my/our tender is accepted and if: -
I/We do not submit the Performance Guarantee within the time specified in the Tender document;
I/We do not execute the contract documents within seven days 10.3.2 after receipt of notice issued by the Railway that such documents are ready, and
I/We do not commence the work within fifteen days after receipt of orders to that effect.
