Statement of past supplies along with, (i) purchaser's name and (ii) address, (iii) email address and (iv) phone/fax number of purchaser, (v) purchase order (PO) or supply order number and (vi) PO date (vii) along with the copies of purchase order (PO), (viii) quantity supplied (with proof of supply), (ix) date of supply and (x) their commissioning date shall be submitted with the offer.

   Non-compliance of following shall lead to summary rejection of the offer and no correspondence in this regard will be entertained. A) There shall not be any deviation from the Major parameters mentioned in clauses. B) AERB type approval from competent authority for the offered machine/model should be attached with the bid documents while submitting the tender. C) The productivity requirement, as specified in above clauses of the bid documents shall be clearly furnished.

   EARNEST MONEY DEPOSIT : 1) Tenderers are required to deposit Earnest Money equivalent to the amount mentioned in the tender document. Tenderers not submitting Earnest Money should clearly indicate in their offer the reasons for the same, and failure to do so will be taken as unwillingness on their part to deposit the Earnest Money and such offers without requisite Earnest Money will be summarily rejected. Tenderer not falling in the exempted categories as mentioned in the subsequent para shall submit the Earnest Money only through Payment Gateway Facility on the IREPS Portal. Earnest Money shall be accepted only via the online system as available on IREPS portal. No other mode of the submission of Earnest Money is acceptable except in case of Global Tenders. 2) There shall be no exemption from submission of Earnest Money for any tender or by any tenderer except following: (a) Limited Tender Cases (including Single Tender and Global Limited Tender) of value limit up to Rs. 25 (Twenty-five) Lakh. (b) Micro & Small Enterprises (MSEs) registered with agencies mentioned at Para 2.4.1 (i) of Instruction to Tenderer attached with the Tender. (c) Other Railways and Government Departments. (d) Indian Ordinance Factories. (e) PSUs owned by the Ministry of Railways and PSUs for the group of items that are manufactured by them. (f) Vendors registered with Northeast Frontier Railways for the trade group of the item tendered. (g) Vendors appearing on the approved vendor list of RDSO/PUs/CORE, subject to approval status being valid on the date of tender closing. (h) Vendors registered with Railway Board/Northeast Frontier Railways for supply of medicine, medical equipments and consumables shall be exempted from submission of EMD for these items. (i) In tender issued against PAC, OEM in whose favor PAC has been issued shall be exempted from submitting EMD. KVIC shall be exempted from EMD for items supplied by them. 3) If authorized agent participates on behalf of OEM, such authorized agent can not claim EMD exemption based on its own or its OEMs MSE certificate. 4) Offers of tenderers, who do not submit Earnest Money, and are also not exempted from submission of Earnest Money shall be summarily rejected. 5) The Purchaser reserves the right to forfeit the Earnest Money Deposit if the tenderer withdraws or revises his offer within the validity period. The Purchaser also reserves the right to forfeit the Earnest Money deposit, if the Bidder fails to deposit Security Money in terms of Clause-12 of the Instructions to Tenderers.

All the bidders /tenderers should ensure that they are GST compliant and their quoted tax structure rates are as per GST Law. In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, the Railway shall deduct the applicable GST from his/her/their bills under Reverse Charge Mechanism (RCM) and deposit the same to the concerned tax authority.

   Annexure-I (Attached with the Tender Schedule): : The tenderers shall submit a copy of certificate stating that all their statements/documents submitted along with bid are true and factual. Standard format of certificate to be submitted by the bidder is enclosed as Annexure-I. Non submission of above certificate by the bidder shall result in summary rejection of his/ their bid. It shall be mandatorily incumbent upon the tenderer to identify state and submit the supporting documents duly self-attested/ digitally signed by which they/ he is qualifying the Qualifying Criteria mentioned in the Tender Document. It will not be obligatory on the part of Tender Committee/ Accepting Authority to scrutinize beyond the submitted document of tenderer as far as his qualification for the tender is concerned.    Complaint / Failure: : The contractor shall attend and rectify any complaint/failure within 48 hours from the time of intimation by the Railway/authorized representative. In case the complaint/failure is not rectified within the stipulated 48 hours, penalty shall be imposed on per scanner machine basis as under: Delay period after expiry of initial 48 hours ? Penalty: First 6 hours or part thereof Rs. 2,000/-; Next 6 hours or part thereof Rs. 5,000/-; Next 12 hours or part thereof Rs. 10,000/-; Every subsequent 24 hrs or part thereof Rs. 15,000/-. Note: The penalties are cumulative. Part thereof means that even a fraction of an hour within a bracket will trigger the full penalty for that specific block. In case of unforeseen circumstances beyond the control of the contractor/licensee, waiver of penalty may be considered by the Sr. DCM of the concerned Division, subject to extant rules and contractual provisions.
