1.Eligibility / Qualification criteria to be Satisfied: Credentials & Qualifying Criteria: Technical and financial eligibility of the Individual / Proprietor firm / partnership firm / company / JV Firm shall be adjudged based on satisfactory fulfillment of the following criteria: Credentials: 1.The tenderer should be well established, experienced, reputed with a credibility to carry the work, in the govt., semi govt., state govt., PSU etc. Certificate to this effect, may be enclosed. 2.Documents testifying Tenderer's previous experience and financial status should be produced along with the tender or when desired by the competent authority. Tenderer(s) who has / have not carried out any work so far on this Railway and who is/are not borne on the approved list of contractors of Northern Railway should submit along with his/ their tender credentials to establish:- a.His capacity to carry out the work(s) satisfactorily. b.His financial status supported by Bank reference and other documents. c.Certificates duly attested and testimonials regarding contracting experience for the type of job for which the tender is invited with the list of works carried out in the past. The tenderer shall upload signed scanned copies of mandatory credentials such as experience, turn over Certificates and any other documents as applicable.

SECTION 5.4: POWER OF ATTORNEY FORMAT FOR AUTHORISED SIGNATORY TENDER FORM -3 (To be executed on non-judicial stamp paper of the appropriate value in accordance with Stamp Duty Act. The stamp paper should be in the name of the Firm / Company who is issuing the Power of Attorney in favour of Authorized Signatory).

CONDITIONS FOR PARTICIPATION OF PROPRIETARY FIRM / PARTNERSHIP FIRM /PRIVATE LIMITED COMPANY / LIMITED COMPANY/ JV FIRMS:

[i] In case the tenderer is an individual / proprietary concern, the experience and turnover shall be in the name and style of the Individual / Proprietary concern only. Note: The partner of a Partnership Firm cannot claim the credentials of Partnership firm to the extent of his share either during the subsistence of the Partnership firm or after its dissolution. [ii] In case the tenderer is a Partnership Firm, the experience and turnover shall be in the name and style of the firm only. [iii] If the Tenderer is a Partnership Firm, all the partners shall be jointly and severally liable for successful completion of the work and no request for change in the constitution of the Firm shall be entertained. [iv] During the currency of the contract, no partner of the firm shall be permitted to withdraw from the Partnership business and in such an event it shall be treated as breach of trust and abandonment of contract work.

[A] In case of Partnership Firm, the following documents shall be enclosed: [i]Notary certified copy of the Partnership deed. [Note: Partnership deed duly attested by a Gazetted Officer, certified true copy by authorised notary public is also acceptable. However railway reserves the right to call for the production of original partnership deed for verification, if necessary.] [ii] Power of Attorney [duly registered as per prevailing law] in favour of one of the partners of the Partnership Firm [if such power is already not assigned in partnership deed] to sign the tender/agreement on behalf of the Partnership Firm and create liability against the firm. [B] In case Private Limited /Limited Company, the following documents shall be enclosed: [i] Notary certified copy of Resolution of the Directors of the Company permitting the company to participate in the tender, authorizing MD or one of the Directors or Managers of the Company to sign the tender/agreement, such other documents required to be signed on behalf of the company and enter into liability against the company and/or do any other act on behalf of the company. [ii] Copy of Memorandum and Articles of Association of the Company. [iii] Power of Attorney [duly registered as per prevailing law] authorizing the person to do/act mentioned in the para [i] above, [if such authority is not already delegated in the resolution of directors].

It is responsibility of the tenderer that they ensure to see any corrigendum of the tenderer to check the corrigendum on the IREPS website from time to time.

If the Bid of a Tenderer is seriously unbalanced in relation to the Engineer s estimate of the cost of work to be performed under the contract, the Railways may require the tenderer to produce detailed price analysis for any or all items of the Tender Schedule, to demonstrate the internal consistency of those prices with the construction methods and schedule proposed.

The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the Railway, make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification, by the Railway shall not relieve the bidder of its obligations or liabilities hereunder nor will it affect any rights of the Railway thereunder.

The tenderers shall submit a copy of certificate stating that all their statements/documents submitted alongwith bid are true and factual. Standard format of certificate to be submitted by the bidder is enclosed as Annexure-V. Non submission of above certificate by the bidder shall result in summarily rejection of his/their bid. It shall be mandatorily incumbent upon the tenderer to identify, state and submit the supporting documents duly self attested by which they/he is qualifying the Qualifying Criteria mentioned in the Tender Document.

After opening of the tender, any document pertaining to the constitution of Sole Proprietorship Firm / Partnership Firm / Registered Company/ Registered Trust / Registered Society / HUF etc. shall be neither asked nor considered, if submitted. Further, no suo moto cognizance of any document available in public domain (i.e., on internet etc.) or in Railway's record/office files etc. will be taken for consideration of the tender, if no such mention is available in tender offer submitted.

Any bidder from a country which shares land border with India will be eligible to bid in this tender only if the bidder is registered with the competent authority.
