A] This is a PAC item. Bulk purchase [minimum 80 percent of net procurement quantity] will be made only from PAC firm M/s Faiveley Transport Rail Technologies India (P) Ltd., Hosur and/or their authorised dealers. In deserving cases, the offers from unapproved/unregistered/untried firms meeting the requisite credentials/capabilities/capacity may be considered for developmental orders limited to the extent of 20% of Net Procurement Quantity. The new firm must upload all the documents in support of their credentials failing which their offer will be rejected without any back reference. B] Preferably manufacturers should participate. Participating traders/agents must provide authorization letter issued by the OEM. Authorization letter should be tender specific. Bidders must submit authorization letter along with their offer failing which the offer is liable to be ignored.

Earnest Money Deposit (EMD) shall be as per Clause 23.0 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated Latest). EMD is compulsory and offers without EMD, except those exempted, will be summarily rejected. Vendors (other t h a n those appearing o n Vendor Panels of Approving Agencies) seeking exemption from EMD, shall have to attach scanned copy of requisite document along with offer in support of their claim for exemption, failing which their offer will n o t b e considered eligible for exemption from EMD.
Authorized agent quoting on behalf of a manufacturer shall not be exempted from remitting EMD, owing to any of the above exemptions as stipulated at Para 23.1 (a) to (i) of Clause 23.0 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated Latest).
MSEs who are interested in availing themselves the benefits/preferential treatment, will upload with their offer, the proof of their being registered only under Udyam Registration as MSE unit.
In case of an upward change in terms of investment in plant and machinery or equipment or turnover or both, and consequent re-classification, an enterprise shall continue to avail of all nontax benefits of the category (micro or small or medium) it was in before the re-classification, for a period of three years from the date of such upward change.
Bidders must agree to furnish SECURITY DEPOSIT as applicable as per Clause 24.0 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated Latest). The SD amount shall be @ 5 % as mentioned i n Clause 24.3 o f Section I I of CENTRAL RAILWAY BID DOCUMENT (Updated Latest). Bidders (except approved vendors for tendered item / items) claiming exemption from paying SD must upload requisite document towards such claim, alongwith t h e offer. Offers from firms denying to pay Security Deposit will be summarily rejected.
Goods & Services Tax (GST): As per Clause 9.0 a n d all sub-clauses of CENTRAL RAILWAY BID DOCUMENT (Updated Latest). All tenderers to q u o t e c o r r e c t HSN code and corresponding GST rate for the item/items quoted. Misclassification in HSN code, if quoted by any bidder, shall be dealt as per Clause 9.0(iv) of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated Latest).
The tenderers in their bids shall indicate the details of their Jurisdictional Assessing Officers (Designation, address & email id). In case of a contract award, a copy of the LOA/Purchase Order shallbe immediately forwarded by Purchaser to the Jurisdictional Assessing Officer mentioned in the Tenderers bid
In case the successful tenderer is not liable to be registered under CGST/IGST/ UTGST/SGST Act, the Railway shall deduct the applicable GST from his/their bills under Reverse Charge Mechanism [RCM] and deposit the same to the concerned tax authority.
Bidders shall also give Declaration as below:- I/We agree to pass on such additional input tax credit as may become available in future under GST scheme, in respect of a l l t h e inputs used in t h e manufacturing and/or supply of final goods/services on the date of supply by way of reduction in price and advise the purchaser accordingly.
The Bidder agrees to supply the tendered stores at the rates quoted by him in accordance with the Standard Governing Conditions of this tender.
The bidder confirms that Rates and other financial terms quoted in relevant columns of financial bid will only be ruling terms for acceptance, and such terms quoted anywhere else should be ignored. [Denial of this condition is not recommended].
In cases of procurement for a value in excess of Rs. 10 crores, firms claiming to be a Class-I Local Supplier/Class-Il Local Supplier on the basis of self- certification of Local Content; shall be required to provide a certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing cost accountant or practicing chartered accountant (in respect of suppliers other than companies) giving the percentage of local content, in the product offered. In terms of Clause 5.5 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated Latest), failing which their offer will not be considered as an offer from a Class I Local Supplier/Class II Local Supplier and will b e dealt with accordingly. If not uploaded with bid, such certificate should be submitted at the earliest.
All bidders shall confirm declaration as b e l o w i n terms of Clause 5 . 1 5 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated Latest) in compliance of restrictions under Rule 144(xi) of GFR- 2017:- a) I have read the clause regarding restrictions on procurement from a bidder of country which shares a land border with India. B) I certify that this bidder is not from such a country or, if from such a country, has-been registered with the competent authority. C) I hereby certify that this bidder fulfils all requirements i n t h i s r e g a r d a n d is e l i g i b l e t o b e considered. (Where applicable, evidence of valid registration by the competent authority is attached). If the bidder fails to give such declaration, as above, then it will b e presumed that t h e contents of above declaration have been read and unconditionally agreed and accepted by the tenderer. If any tenderer is not agreeable to this declaration they have to categorically mention about the disagreement in Techno- Commercial Deviation.
Vendors claiming to avail benefits and preferential treatment extended to Micro and Small Enterprises [MSEs] must necessarily upload relevant documents with their offer in terms of Clause 4.0 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated Latest).
The benefits of MSME Policy in respect of a particular item shall be given only to those MSEs which are registered for that item /group under Udyam Registration such that 2/4/5-digit NIC code/Description covers the broad description of the tendered item or the manufacturing process of the tendered item broadly.
Vendors which are Large Scale Industry or consortia of MSEs formed by NSIC, must upload w i t h offers, quantum of sub contracts given to Micro and Small Enterprises (in percent of order value) for goods to be supplied against this tender.
Criteria for classification of enterprises based on investment and turnover vide Gazette Notification dated 26.06.2020, a s amended time t o time, issued by Ministry of Micro, Small and Medium Enterprises is applicable in the tender. In case, conditions contained in the above notification contradict with any of the tender conditions, conditions contained in the above notification, as amended, shall prevail in terms of Clause 4.4 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated Latest).
Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.
