Supply of 110 V, 200Ah LOW MAINTENANCE LEAD ACID BATTERY

Bidder to provide Specific OEM /OEM authorization certificate/Dealership certificate along with offer. Failing which offer may not be considered.

Bidders to provide proof of successful supply of atleast 1 set of 110V low maintenance lead acid battery of 200AH capacity or more to any of indian railway units in a single PO in last 3 financial years reckoned from the tender closing date. Documentary evidence like crn, R Note, Performance certificate to be attached with bid. Failing which offer won't be considered. Note: Merely attaching Purchase Orders will not be accepted as valid proof of past performance.

Ambiguous offers like (1) Unbranded items (2) make/brand as NA as per similar, (3) Not adhering to tender specification (4) Unclear makes, brands etc. will be summarily rejected without any correspondence.

[a] Please indicate whether you are registered with any of the following Micro & Small Enterprises (MSE) agencies : District industries Centre[s,KVIC, KVIB, Coir Board, NSIC, Directorate of Handicraft & Handloom or any other body specified by Ministry of MSME.[Name the agency clearly]. If yes, then for availing benefits under MSME Act, should upload valid documents maintained under MSME Act such as NSIC Certificate etc duly marking the tendered item in the certificate. Otherwise, claim for benefits under MSME Act may not be entertained and also indicate whether the Enterprise is owned by SC/ST/Woman. Please upload support of this. [b] If you are not a MSE or a consortia of MSEs formed by NSIC, please indicate percentage of sub contracts in execution of this tender that will be from Micro and Small Enterprises. [in percent of order value] with further breakup of MSE owned by SC/ST[Information will be provided in percentage terms with 6 fields; Micro owned by SC, ST, Others and Small Industries owned by SC, ST and Others]. PVC will be based on M/s HZLs price of lead [exclusive of all statutory duties and taxes and also considering all discounts offered in HZL price circular]. Price of lead prevailing on 1st day of the month of tender opening should be considered for quoted price and the price of lead prevailing one month(i.e., 30 days) prior to date of offering the material for inspection will be considered for computing PVC. The basic price will subject to variation for every increase or decrease of Rs.100/- (exclusive of all statutory duties taxes) on the above M/s. HZLs price or part there of the price of the battery quoted will be subject to an increase or decrease of Rs. 52.25 per battery set (exclusive of statutory duties taxes). In the event of variation in M/s HZL Lead price as declared by HZL (Ex- Chanderiya Smelter) in its price circular (exclusive of all statutory levies, duties, taxes and discounts if any) adjustments in contract price upward/ downward will be regulated with reference to the date of inspection call letter. The basic price of M/s HZL Lead (Ex Chanderiya Smelter) in its price circular (exclusive of all statutory levies, duties, taxes and discounts if any) prevalent one month (i.e., 30 days) prior to the date of inspection call for offering the batteries for inspection will be considered for computing the PVC. Further, for the purpose of aforesaid PVC, the basic price of Lead Ex. Chanderiya Smelter shall be taken into account without referring to any discount mentioned in the HZL circular. NOTE 1: The date of dispatch will be treated as the date of inspection call offer for the purpose of price variation in case of inspection waiver. NOTE 2: For the purpose of computing aforesaid PVC, the basic price of Lead purity 99.99% (ex Chanderiya smelter) shall be taken into account without referring to any discounts mentioned in the HZL price circular. In case of extension of delivery date with LD and DC, two calculations will be done to calculate PVC price. 1) Taking contractual Delivery Date and 2) As per actual Delivery Date. The lowest price among the two will be considered as the price of battery. NOTE 3: No change in PVC will be permitted. Any offer differ from PVC in this tender will not considered

HSN CODE [a] All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per the GST Law. Firms must indicate its GST registration number along with their offer. [b] In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, The Railway shall deduct the applicable GST from his/their bills under Reverse Charge Mechanism (RCM) anddeposit the same to the concerned tax authority. [c] The firm should indicate the tariff code (HSN Code) for claiming GST for the tendered item. [d] The offer shall be evaluated based on the GST rate as quoted by each bidder and same will be used for determining the inter-se ranking. While submitting offer, it shall be the responsibility of the bidder to ensure that they quote correct GST rate and HSN number. [e] It shall be the responsibility of the bidders to quote correct HSN number and corresponding GST rate. The Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate, if quoted by the bidder. [f] Wherever, the successful bidder invoices the goods at GST rate or HSN number which is different from that incorporated in the Purchase order, payment shall be made as per GST rate which is lower of the GST rate incorporated in the Purchase order or billed. [g] Vendor is informed that she/he would be required to adjust her/his basic price to the extent required by higher tax bill as per invoice to match the All inclusive Price as mentioned in the Purchase order. [h] Any amendment to GST rate or HSN number in the contract shall be as per the contractual conditions and statutory amendments in the quoted GST rate and HSN number, under SVC.

Railway is not bound to accept/Cancel the lowest or any tender or assign any reason for doing so and Railway reserves the right to accept/Cancel any tender in respect of the Whole or any portion of the items specified in the Schedule annexed (a or Tender Schedule) and the contractor shall be required to supply the same at the rate quoted

Purchaser shall have the right to levy general damages on the supplier for failing to comply with the contractual conditions, not by way of penalty, an amount equal to 5% of the value of cancelled quantity.

I certify that this bidder is not from such a country or , if from such a country, has been registered with the Competent Authority. If such certificate given by a bidder whose bid is accepted is found to be false, this would be a ground for immediate termination and further legal action in accordance with law. In case of non- submission of the above said certificate by a bidder, such bidder's bid is liable to be ignored."
