Similar nature of work: Construction of Bridges such as Rail Bridges or road Bridges or Rail cum Road Bridges or Road Over Bridges (ROB) or Road Under Bridges (RUB) or Limited Height Subways (LHS))

I/we the tenderer (s) am/are signing this document after carefully reading the contents.

I/We the tenderer(s) also accept all the conditions of the tender and have signed all the pages in confirmation thereof.

I/we hereby declare that I/we have downloaded the tender documents from Indian Railway website www.ireps.gov.in . I/we have verified the content of the document from the website and there is no addition, no deletion or no alteration to the content of the tender document. In case of any discrepancy noticed at any stage i.e. evaluation of tenders, execution of work or final payment of the contract, the master copy available with the railway Administration shall be final and binding upon me/us.

I/we declare and certify that I/we have not made any misleading or false representation in the forms, statements and attachments in proof of the qualification requirements.

I/We also understand that my/our offer will be evaluated based on the documents/credentials submitted along with the offer and same shall be binding upon me/us.

I/We declare that the information and documents submitted along with the tender by me/us are correct and I/we are fully responsible for the correctness of the information and documents, submitted by us.

I/we certify that I/we the tenderer(s) is/are not blacklisted or debarred by Railways or any other Ministry / Department of Govt. of India from participation in tender on the date of submission of bids, either in individual capacity or as a HUF/ member of the partnership firm/LLP/JV/Society/Trust.

I/we understand that if the contents of the certificate submitted by us are found to be forged/false at any time during process for evaluation of tenders, it shall lead to forfeiture of the Bid Security and may also lead to any other action provided in the contract including banning of business for a period of upto two year. Further, I/we and all my/our constituents understand that my/our offer shall be summarily rejected.

I/we also understand that if the contents of the certificate submitted by us are found to be false/forged at any time after the award of the contract, it will lead to termination of the contract, along with forfeiture of Bid Security/Security Deposit and Performance guarantee and may also lead to any other action provided in the contract including banning of business for a period of upto two year.

I/We have read the clause regarding restriction on procurement from a bidder of a country which shares a land border with India and certify that I am/We are not from such a country or, if from such a country, have been registered with the competent Authority. I/We hereby certify that I/we fulfil all the requirements in this regard and am/are eligible to be considered (evidence of valid registration by the competent authority is enclosed)

The tenderer shall visit the site of work and acquaint himself/themselves with the conditions of work viz. approach roads and accessibility, nature of soil/rock, availability of materials, electric power, water for work and drinking purposes, site for labour camps, stores, godowns, extent of lead/lift in work, availability of skilled and unskilled labour etc. that may be encountered in the course of execution of work. In short, he/they should familiarize himself/themselves fully with the conditions obtaining at site and FURNISH A CERTIFICATE TO THIS EFFECT, in the Proforma appended as Annexure-C of Tender Document.

The original Bank Guarantee for Bid Security should be delivered in person to the Deputy Chief Engineer/ Construction-I/ Chandigarh office Near Railway Colony (Panchkula Side), Chandigarh before closing date for submission of bids (i.e. excluding the last date of submission of bids)

Tenderers are compulsorily required to upload Certificate as per Annexure M and Annexure M (A), as the case may be, as stipulated in Clause 2.2.6 of General tender conditions and instruction to tenderer(s) without which the offer will be considered incomplete and will be rejected summarily.

The tenderers must necessarily upload/submit the legal documents, pertaining to the constitution of their Concern as applicable, along with the tender, as enumerate in clause 2.4 of General tender conditions and instruction to tenderer(s) of tender document.

Tenderer shall certify that they are not black listed or debarred by Railways or any other Ministry/ Department/PSU (Public Sector undertaking) of the Govt. of India/State Govt. from participation in tenders/contract on the date of opening of bids either in their individual capacity or as a member of the JV frm in which they were/are members.

Tender must compulsorily upload ANNEXURE-Q regarding Employment/Partnership etc. of Retired Railway Employees without which tender will be summarily rejected.

Submit your bank details i.e. Name of the Bank along with Bank Branch Code, Account Number, IFSC Code as per Annexure-J (Real Time Gross Saving (RTGS)/National Electronic Fund Transfer (NEFT) (Model Mandate Form)) of tender document

The tenders confirms the option of taking payment through LC arrangement. The tenderer affirms having read over and agreed to the terms and conditions of the LC option.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

Tenderer may please note that offers received without requisite/mandatory documents as mentioned above, will be considered as invalid tender and for which contractor shall have no claim on Railway.

Tenderers are compulsorily required to fill up/submit requisite details in prescribed Performa of Annexure C to G,I,J and Annexure-L as per tender document without which the offer may be considered as incomplete and be liable to be rejected.

The tenderer's may note that the Railway reserves its right to either accept or reject any Bid/s without assigning any reasons whatsoever and tenderer s shall have no claim s on this account.

TAXES

The contractor shall be governed by the Taxes applicable at the place of actual execution of work as per clause 23.0 of General tender conditions and instruction to tenderers

If on verification of credentials, at the evaluation stage, it is found that the tenderer has submitted forged/fake documents in support of his offer, his Bid Security shall be forfeited besides banning of business for a period of upto two year.

Care for submission of offer

Before submitting a tender, the tenderer will be deemed to have satisfied himself by actual inspection of the site and locality of the works, that all conditions liable to be encountered during the execution of the works are taken into account and that the rates he enters in the tender forms are adequate and all inclusive to accord with the provisions in Clause-37 of the Standard General Conditions of Contract for the completion of works to the entire satisfaction of the Engineer.

Tenderers will examine the various provisions of The Central Goods and Services Tax Act, 2017(CGST)/Integrated Goods and Services Tax Act, 2017(IGST)/Union Territory Goods and Services Tax Act, 2017(UTGST)/ respective state's State Goods and Services Tax Act (SGST) also, as notified by Central/State Govt & as amended from time to time and applicable taxes before bidding. Tenderer's will ensure that full benefit of Input Tax Credit (ITC) likely to be availed by them is duly considered while quoting rates.

The successful tenderer who is liable to be registered under CGST/IGST/UTGST/SGST Act shall submit GSTIN along with other details required under CGST/IGST/UTGST/SGST Act to railway immediately after the award of contract, without which no payment shall be released to the contractor. The contractor shall be responsible for deposition of applicable GST to the concerned authority.

In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, the railway shall deduct the applicable GST from his/their bills under reverse charge mechanism (RCM) and deposit the same to the concerned authority.

The bidders who desires to participate against e-tenders, are advised to electronically register themselves on website www.ireps.gov.in for which they would require to obtain Class III digital certificate (if already not obtained) issued by CCA under IT Act-2000.

Bid Security shall be submitted by JV or authorized person of JV either as : (i) Cash through e-payment gateway or as mentioned in tender document, or (ii) Bank Guarantee bond either in the name of JV, or in the name of all members of JV as per MOU irrespective of their share in the JV if the JV has not been constituted legally till the date of submission of tender.

GUIDELINES FOR PARTICIPATION OF JOINT VENTURE (JV) FIRMS: Kindly refer Annexure-K of tender document

Tenderers are required to upload all relevant legal documents- such as the MOA, AOA, Certificate of Incorporation, Partnership Deed, Power of Attorney, Board Resolution, or LLP Agreement etc., as applicable - in accordance with Clause 2.4 (Constitution of the Tenderer) of the tender document.
