Eligibility Criteria

Regarding GST: Note: a.The amount put to tender is exclusive of G.S.T b.G.S.T shall be paid to the tendered amount separately as per prevailing Government order c.The increase in GST shall not be paid in the exteneded period of contractor for which the contractor alone is responsible for delay as determined by the authority while granting the extension of time.

General Conditions :1)The tenderer should submit the following documents along with the tender

A copy of the Registered Class-IV & above

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

Each tenderer in his name should have in the last five years period, achieved in at least Two financial year an average annual financial turn over of not less than the cost of work (i.e: 10.00 lakhs) i.e., from 2021-22 to 2025-26, should be uploaded. Duly giving 10% escalation every year. All document/certificates issued by a Charted Accountant should have a UDIN (Unique Document Identification Number) generated through the ICAI (The Institude of chartered Accountants of India) Portal. Certificate without UDIN the documents uploaded will be considered and treated as invalid document

Tender Capacity:Tenderers who meet the above specified minimum qualifying criteria, will only be qualified, if their available tender capacity is more than the total tender value.The available tender capacity will be calculated as under: Assessed available tender capacity -(AXNX2.5-B) Where,A-Maximum value of civil engineering works executed in anyone year during the last five years i.e 2021-22,2022- 23,2023-24 ,2024-25 & 2025-26 (updated to 2026-27 price level) taking into account the completed as well as works in progress.N-Number of years prescribed for completion of the works for which tenders are invited. B-Value at 2026-27price level,of existing commitments and on-going works to be completed during the period of completion of the works for which Tenders are invited Note: The statements showing the value of existing commitments and on-going works as well as the stipulated period of completion remaining for each of the works listed should be countersigned by the Employer in charge,not below the rank of an Executive Engineer or equivalent.

Within 20 days of receipt of the letter of acceptance ,the successful Tenderer shall deliver to the Employer a Security deposit in any of the forms given below for an amount equivalent to 5% of the Contract price Plus full difference amount for below quoted tenders as additional security (for unbalanced tenders) in accordance.with clause 25.5 of ITT & Clause 44 of the condition of contract for all works.

The necessary certificates / documents in support of eligibility criteria fulfilled as stipulated shall be scanned and attached to e-tender document. The Original certificates/documents shall be produced on or before stipulated date and time for verification. Scanned signature of the bidder/authorized representative of the bidder shall be attached while uploading bid document.

If any of the dates mentioned above happen to be a general holiday, the next working day holds good

The contractor should take still photos / videos of the work before commencement of works, during execution and after completion compulsorily. These photos/ videos should be made available to the implementing officer, for immediate reference during review of works to enclose it with completion certificate

The bidder at the time of execution of the agreement should give a detailed execution plan and fortnightly program to complete the work in full manner in without fail. The program can be modified with mutual consent

The work will be constantly monitored by the Executive Engineer and if there is any slippage in achieving the program/ milestones month wise, a penalty / liquidated damages as indicated in the agreement / tender document would be levied. However, these liquidated damages will be refunded if the contractor makes good the shortfall in the subsequent months or completes the whole work before the stipulated date of completion

Conditional tenders are liable to be rejected. The officer competent to accept the tender shall have the right to reject any or all the tenders without assigning any reason whatsoever

Corrigendum will be published in web site for all modifications/corrections if any

The intending bidders should note that, if any of lands either in part/parts or whole required for the work is not acquired by the Nigam, it shall be the responsibility of the bidder to take possession of such land and start the work by the consent of the land owners before commencement of work at no extra cost to the Nigam and no claim whatsoever relating to non availability of land would be entertained.

The contractor should mention their recent correct postal address and e-mail address in the declaration form

Incomplete tender documents will be rejected

All materials like steel, cement & pipes etc., required for the above work should be procured by the contractor only at his own cost. And these materials will have to be got tested by the competent authority before put to use

The application made by the firm/company, shall be signed by a person holding the power of attorney, in which case a copy of power of attorney shall be submitted

Maintenance period or the defect liability period for this work is 12 months from the date of completion of work

As per GO FD 5 EXP -12 / 2023 dated 15.05.2023 the contractor shall be abide to provide e Bank Guarantee towards Security Deposits

Debarment of tenderers: The procurement entity may debar tenderer for a period not exceeding 3 years from participation in its tenders following such procedures as may be prescribed on the ground that tenderer is engaged in corrupt or fraudulent practices in competing or executing the contract including misleading the procuring entity or any stage of procurement activity with a fraudulent intention. ( KTPP Act 26A)

They should abide by the directions of Government towards recovery of 1% (or as modified by the Government from time to time) Cess from the contractors bill under the provisions of building and other constructions worker welfare cess Act 1996

The payment of bills of this work will be made as and when the letter of credit is received under the same head of account from KNNL/Government of Karnataka

The contractors should adhere to the accepted action plan submitted by him under any circumstances without linking to the pending bill payment of the work

Typo-graphical errors if any will not be the ground for any claims by the Contractor

Tendering by the joint venture will not be allowed

The contractor should furnish the name of the individual /firm with address and Telephone numbers with place of registration, year of incorporation etc

The tender processing charges paid by the bidders are not refundable even if the tenders are cancelled

Royalty on construction materials and other taxes will be deducted as per prevailing Government orders.

The tenderer has to make his own arrangement for procurement of all materials required for the work. There is no departmental supply of materials. Contractor should procure only ISI mark materials and submit necessary quality control certificates from the authorized quality control authority, before execution

Sub leasing of work in any form is prohibited

No quarries are approved by KNNL for materials. The quarries considered are for the estimate purpose only. The intending bidders shall visit the site, identify the quarries, ascertain availability for the quantity and quality of the materials required for the work and shall quote his rates accordingly. No extra claim whatsoever will be entertained in this regard

The rates includes all leads and lifts and work shall be carried out as per the instruction of Engineer-in-charge .All specifications are as per relevant IS codes in vogue and Indian Road Congress. The rates for the specification in the Schedule B includes all lead and lifts irrespective of the distance and height, no extra claim will be entertained for additional lead and lifts

The validity period of EMD shall be for a minimum period of 225 days from the date of opening of the tenders

The EMD of the unsuccessful bidder will be refunded only after the acceptance of the tender by the competent authority as per tender clause

The tender inviting authority has got right either accepting tender or rejecting the tender without assigning any reasons

In case of death of contractor after executing the agreement commencement of the work , his legal heir if any eligible registered contractor and willing can execute and complete the work at the accepted tender rates irrespective of the cost of the work

EMD amount and Amount put to tender will be as mentioned in the e-portal of respective work

Royalty will be deducted as per Prevailing government circular No.G.Bho.E/D.C.B/2024-25 Dt:24-01-2025

The contractor shall produce the mineral dispatch receipt (MDR) from department of Mines & Geology for Exemption
