Special Eligibility Criteria

   Regular and Bulk quantity ordering will be done on the bidder(s) who have supplied at least 20% of tender quantity of the tendered /Similar item(similar means VHF Set of different sape, size and specification ) in a single PO [Purchase order] to ECR or any other unit of Indian Railways in last 3 calendar years and current year till tender opening date. The onus of submission of credential i.e. R Note , Inspection certificates etc. lies with the firm.

   Only OEM or their tender specific authorized dealers are eligible to participate in this tender case. Dealers/Agent quoting on behalf of OEM must submit tender specific authorization from the OEM, mentioning OEM-s confirmation for fulfilling warranty obligation, along with their offer failing which their will be summarily rejected.

   The tenderer should have valid Dealer Possession License (DPL) from WPC to fulfill all the WPC regulations. Copy of the DPL shall be submitted along with the offer failing which the offer shall be summarily rejected.

   In compliance of railway Board letter no. 2022/RS(L)/709/1 (SER-VHF Set) (E3385444) dated 01.10.2025, RDSO letter no. RDSO-TELE0LKO( SPEC)/9/2019 dated 12.07.2024 & Rly. Board letter no. 2010/Tele/11(3)/1-part(1)(3467095) dt. 28.07.2024 (copy attached), offer will be considered only from Make & Model of VHS Sets which have passed the RDSO Type test & POC as on the date of opening of Tender.

   The tenderer/OEM should have valid mandatory, regulatory certification i.e. WPC certification applicable to 5 W VHF sets. Tenderers shall submit these certificates along with their offer, failing which offer shall be summarily rejected.

Commercial-Compliance

   Bidders are required to confirm the compliance along with bid for compliance of OM of MoE dated 23.07.2020 as per para 9.5.3 of IBD. If such certificate given by a bidder whose bid is accepted is found to be false, this would be a ground for immediate termination and further legal action in accordance with law. Non-confirmation of the same may lead to summarily rejection of offer.

   At the time of the Inspection and supply of the VHF Sets, the firm must submit the MTCTE Certificate and the same should also be endorsed in the inspection certificate too.

   Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

   In case of procurement for a value in excess of Rs. 10 crore, the local supplier shall be required to provide a certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing cost accountant or practicing chartered account (in respect of suppliers other than companies) giving the percentage of local content. (Refer 29.2 (b) of IBD (V- 3.0) of ECR for more details).

   Offers from allied /sister concern firms: In case of allied /sister concern firms, only one of the allied /sister concern firm is eligible to participate in the tender as per IRS conditions. If more than one allied /sister concern firms participate in the tender, offer of all the allied /sister concern firms will be ignored.

   Annexure-A to Railway Board letter no. 2004/RS (G)/779/11 Pt. Dated 23.12.2019 Bid securing declaration to be signed by bidders availing exemption from submission of EMD. I/we certify that my/our offer is eligible for exemption from submission of bid security/Earnest Money Deposit, in terms of the tender conditions. In case my/our claim to exemption from submission of bid security/Earnest Money Deposit is not found valid as per terms of the tender, I/we understand and accept that Railways has unquestionable right to summarily reject my bid and my offer shall not be considered for ordering. Further, I/we hereby understand and accept that if I/we withdraw or modify my/our bids during the period of validity, or if I/we are awarded the contract and on being called upon to submit the performance security/Security Deposit, fail to submit the performance security/Security Deposit before the deadline defined in the request for bid document/Notice Inviting Tender, I/we shall be debarred from exemption of submitting Bid Security/Earnest Money Deposit and performance security/Security Deposit for a period of 6(six) months, from the date I/we are declared disqualified from exemption from submission of EMD/ SD, for all tenders for procurement of goods issued by any unit of Indian Railways published during this period.

   I/We have carefully gone through the IRS conditions of contract (included and uploaded along with the bid document) particularly Para 2500 pertaining to "Code of Integrity, Misdemeanor and Penalties". I/We hereby certify that no other sister concerns or affiliates (such as having common partner/director/promoter/owner/holding company decision control etc.) have participated in this tender which can give rise to a conflict of interest or fall under anti-competitive practices. We understand that the offers of all such sister concerns including ours are liable to be rejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti competitive practices [Para 2502(c)] and obligation to proactive disclosures [Para 2503]. I/We understand that we are fully responsible for the above declaration and it shall not be the Railway's responsibility to verify the same. I/We are aware that we shall be liable for all consequences of violation of Code of Integrity, if detected, at any stage.
