Special Eligibility Criteria

   This item to be procured from RDSO approved/Developmental sources registered under RDSO item ID: 3100054 SUB ITEM ID- 3100054001as available on ireps vendor directory. The status of firm shall be reckoned as on date of tender opening and not thereafter, unless changed because of downgrading/removal/suspension/banning. BULK ORDER: - Railway reserves the right to order entire or bulk quantity on RDSO approved sources. In case there are not more than three Indian Suppliers categorized as Approved Vendor for a particular item, unconditional developmental vendors can be considered for placement of bulk order without any quantity restrictions as per Para 1.3.1 of Annexure-B of WCRs e TENDER DOCUMENT FOR SUPPLY CONTRACTS. DEVELOPMENTAL ORDER: -In case there are more than three Indian supplier as Approved Source (without any condition of prototype/field trial), the development orders may be placed on firms which are unconditionally approved by RDSO as developmental vendor as per Para 1.3.1 of Annexure-B of WCRs e TENDER DOCUMENT FOR SUPPLY CONTRACTS. CONDITION APPROVAL BY RDSO FOR FIELD TRIAL : - When a firm is approved by RDSO for developmental orders but with conditional approval subjected to field trials of the specific quantity as on the date of tender opening, firm should attach the details of orders received already. In case firm do not attach details, it will be presumed that firm has not received any order for the tendered item. Such firms shall be considered only up to 20% of net procurement quantity or the balance quantity Required for field trial whichever is minimum. However, if after opening of the tender, such firms receive any order, it will be responsibility of the firm to inform it to this office at the earliest. In case the firm get any order against this tender but RDSO do not entertain the order for carrying out trials/ inspection then the order will be cancelled as per relevant instructions mentioned in the tender conditions. CONDITION APPROVAL BY RDSO SUBJECT TO PROTOTYPE APPROVAL : - When a firm is approved by RDSO for developmental orderswith remarks that Supply (even for field trials, whichever applicable) shallcommence only after approval of the prototype by the RDSO. Offers of such firms will be summarily rejected. Note:- No back reference will bemade in this regard & communication received after opening of tender will also not be entertained.

   TENDER SPECIFIC AUTHORIZATION: - Authorized agents of OEM must submit Tender Specific Authorization of the OEM. No back reference will be made in this regard & communication received after opening of tender will also not be entertained. The material supplied by the traders will be inspected at the OEM premises by the inspecting agency before supply. Neither one agent can represent two OEMs nor can one OEM authorize two agents. Purchaser reserves the right to reject both bids in such cases. In a tender either the Agent on behalf of the OEM or OEM itself can bid but both cannot bid simultaneously for the same item in the same tender. In cases where both OEM and their agent participate in bidding for same item, any or both the bids shall be liable to be rejected.

   Price Variation Clause: The final price payable shall be subject to adjustment ,up or down, in accordance with the Price Variation Formula as below :- P = P0 + 0.157[Cu-Cu0] + 0.277[Cc-Cc0] + 0.289[Fe-Fe0]; Where, P = Basic Rate payable as adjusted in accordance with above formula (Rs/Km), P0 = Basic Rate as per PO (Rs/Km), Cu0 = IEEMA price of Copper wire rods (Rs/MT), Cc0 = IEEMA price of PVC compound (PVC) (Rs/MT) and Fe0 = IEEMA price of Steel for Armouring [Flat 4 mm x 0.8 mm dia] (Rs/MT). Note: Above prices are as published by IEEMA as per IEEMA Price Circular as applicable on the first working day of the Base Month June-2026. The prices (Cu), (Cc) & (Fe) shall be above prices (Rs/MT) as applicable on the first working day of the calendar Month one month prior to the date of call letter for offering material for inspection, duly acknowledged by the Inspection Agency. In case date of call letter for inspection duly acknowledged by Inspection Agency is not available, the reference date for the purpose of computation of PVC and the payable Basic Rate shall be taken as the first working day of the calendar Month one month prior to the date of actual inspection as mentioned on the Inspection Certificate issued by the Inspection Agency. Bidders must quote their offer according to above. Offers with deviation in the Price Variation Formula and/or BASE MONTH/DATE of price(s)/indices of input raw materials from the tender schedule (OR) offers quoted on FIRM price basis, will be summarily rejected .

   Local Content Certificate- a:Irrespective of the value of the tender case, the Class- I local supplier/Class-II local supplier at the time of tender, bidding or solicitation shall be required to indicate percentage of local content and provide self- certification that the item offered meets the local content requirement for Class-I local supplier/Class-II local supplier, as the case may be. They shall also give details of the location(s) at which the local value addition is made. b: The Class-I local supplier/Class-II local supplier shall be required to provide, at the time of execution of the contract, a certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing cost accountant or practicing chartered accountant (in respect of suppliers other than companies) giving the percentage of local content. The same shall also be provided by the contractor along with the bill submitted by the contractor for payment. For cases where it is not possible to provide the requisite certificate at the time of execution of the contract, the supplier is permitted to provide the requisite certificate for local content at the time of submission of bill. Submission of the requisite certificate by the contractor is mandatory for claiming any payment from the Railway. In case the contractor/supplier does not meet the stipulated local content requirement and the category of the supplier changes from Class-I to Class- II/Non-local or from Class-II to Non-local, a penalty of 10% of the value of the portion of contract for which the stipulated local content requirement is not met, will be imposed. However, contract once awarded shall not be terminated on this account. Note: The requisite certificate of local content must be signed with UDIN or relevant similar numbers for statutory auditor or cost accountant whichever is applicable, and should be verifiable online using such UDIN (or other relevant number as the case may be).

   PLASTIC WASTE MANAGEMENT RULE 2016 :- "It is certified that for execution of this contract, the plastic packaging material or commodities which are made out of Compostable Plastic or Biodegradable Plastic shall be purchased from firms having certification by CPCB for manufacture or sale of plastic packaging or commodities made from Compostable Plastic or Biodegradable Plastic as per rule 4 (4) of Plastic Waste Management rule 2016. It is also certified that we shall also not use any other category of plastic, such as Bio Compostable or Oxo-degradable or Oxo-bio-degradable or the like, which are not recognized under Plastic Waste Management Rule 2016 with all amendments." (Note: - May confirm as Yes , to certify all the above certification . )

   Jurisdiction of Court :- As per Para 2703 of IRS Condition of Contract the Courts of the place from where the acceptance of tender has been issued shall alone have jurisdiction to decide any dispute arising out of or in respect of the contract.

   Fall clause: The Fall Clause shall be applicable in accordance to para [c] of Railway Board's letter no. 2022/RS(G)/779/2 dated 14.02.2022. Details as per ANNEXURE- II.
