APPENDIX- 3A

PROFORMA FOR STATEMENT OF MINOR DEVIATIONS

(Refer Clause C 2.2(d) and C 15.1 of ITT)

1. The following are the particulars of minor deviations from the requirements of the Tender Document:

1. The Tenderer shall indicate price reduction against each deviation in Appendix-3A of BOQ. This price is the price which the tenderer shall reduce from this tender price if deviation(s) is/are accepted by the Employer.

2. Where there is no deviation, the statement should be returned duly signed with an endorsement indicating ‘No Deviations’. In case, Performa of deviations is not submitted or submitted as blank, it will be construed that the tenderer has not proposed any deviations from tender documents.

3. It shall be noted that in case Nil/Zero/NA Price quoted by Tenderer in Appendix-3A then it shall mean that contractor has quoted same price for deviation and undeviation bid.

4. If the tenderer proposes deviations in tender documents, and/or any other terms and conditions of the tender, other than in this Appendix, it will have no effect.

Preamble

The Bill of Quantities shall be read in conjunction with Notice Inviting Tenders, Instructions to Tenderers, General and Special Conditions of Contract, Employer's Requirement and other relevant documents.

BoQ1 consists of two schedules i.e. Schedule ‘A’ for DSR-2023 items and Schedule 'B' for Horticulture DSR-2025 Items.

Tenderers shall quote their offer in Indian Rupees (₹) only. Tenderers are required to quote percentage (%) Excess/Less for Schedule-A & Schedule-B in figures in the appropriate highlighted cells in the BoQ1 sheet.

The rates and prices to be tendered in the unit Priced Bill of Quantities are for completed and finished items of works and complete in all respect. It will be deemed to include Duties, Taxes, Octroi, Royalty etc., cost of all plants, labour, supervision, materials, transport, all temporary works, erection, maintenance, utility identification, contractor’s profit and establishment/overheads, together with preparation of design and drawings, all general risks, insurance liabilities, compliance of labour laws and obligations set out or implied in the contracts. For taxes and duties refer clause C2.4 & C2.5 of ITT & clause 17 of SCC.

The price offer in the BOQ shall be given without considering any deviation mentioned in Appendix-3 of FOT i.e. price in the box shall be quoted as per tender conditions without any deviation.

If the tenderer fails to quote rates against any item, the tender may be treated as incomplete and non-responsive and shall be rejected.

Errors will be corrected by the employer for any arithmetical errors in computation or summation as per contract conditions.

The Financial Proposal (as per BOQ) shall be uploaded online on the website http://etenders.gov.in/eprocure/app. The rates shall be quoted in the excel file provided in the bid documents. The tenderer shall download the excel file and quote the rates in BoQ1. After quoting their rates the excel file shall be uploaded accordingly. The rates shall not be offered/quoted elsewhere in the technical submission/ tender submission.

In case of any discrepancy in DSR items covered under Schedule 'A' the relevant item as mentioned in DSR published by CPWD shall prevail.

The contractor may raise their “On Account” payments on monthly basis as per the status of work on the last day of the respective month.

Renovating lawns including weeding, cheeling the grass, forking the ground, top dressing with sludge or manure, mixing the same with forked soil, watering and maintaining the lawn for 30 days or more till the grass forms a thick lawn free from weeds and fit for mowing and disposal of rubbish as directed, including supplying of good earth if needed. (The cost of sludge, manure and good earth shall be paid for separately).

Providing Circular Cement Concrete pots of specified size, cast with cement concrete of nominal mix 1:2:4 (1 cement: 2 coarse sand: 4 graded stone aggregate 6 mm nominal size), reinforced with 7 Nos (3 nos horizontal & 4 nos vertical “ U “ shape) M.S. wires of 3.5 mm dia as per design, including required form work, finishing with cement punning on exposed surface, curing for specified period and stacking in required rows & height, all complete as per direction of Officer-in-charge.

Maintenance of cement potted plants at ground floor in flats and ground floor bungalows, office complex including application of good earth, manure, insecticide, pesticide and fertilizer, removing of dry parts by pruning, cleaning dry leaves and displaying in appropriate place and replacement of broken pots coloring of pots and change of location of pots and replacing with fresh plants as and when required (Materials provided by the department) as per direction of officer in charge (1 mali for 300 Nos. Cement Pots).

Pruning, trimming, shaping of trees /shrubs (ht 15 feet and above) i/c removal of cut materials upto 50 mt. lead and as per direction of officer in charge (necessary T&P shall be arranged by the contractor).
