Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

Bidders shall ensure upload of relevant document certifying his/her status as Scheduled Caste/ Scheduled Tribe/other reserved category as prescribed in the tender document.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of KP Procurement Portal on or before the last date and time of bid submission.

The bidder is required to ensure browser compatibility of the computer well in advance to the last date and time for receipt of tenders. The departments shall not be responsible for non-accessibility of KP-Procurement portal due to internet connectivity issues and technical glitches at bidders end.

Bidder shall pay Contract Management Module processing fees of 0.025% of the contact value (Min Rs.500/- & Max Rs.7500/-) soon after contract has been issued to bidder.

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka.

As per Karnataka State Government order No.LD/300/LET/2006 Bangalore Dated 01.01.2007 and Government Letter No.PW/134/BMS/2007 Dated 27-07-2007, a sum amounting to 1% of the bill amount will be deducted towards Construction Labour Welfare fund.

The Item Rate quoted shall include the Royalty Charges on construction materials and other taxes as per prevailing Government Orders.

Conditional tenders will not be accepted.

The Tenderer shall obtain the required work done certificates from the Competent Authority not below the rank of Executive Engineer or equivalent.

Financial Year will be reckoned as the period between first day of April and Thirty first day of March of succeeding year (both days inclusive).

The Tenderer shall scan Original Ownership Documents/ Lease/ Hire commitment Agreement for the Machineries and attach the scanned file to the Bid. The Original Documents shall be produced at the time of opening of technical Bids for physical verification.

The Employer reserves the right to reject any or all Tenders without assigning any reason or what so ever.

The tenderer shall maintain the Road/Building/Bridge during the defect liability period.

The Department is not responsible for any delay in accessing kp-procurement portal.

Financial turnover of previous years shall be given a weightage of 10% per year to bring them to the price level of the 2025-26. And Value at 2025-26 price level, of existing commitments and on-going works to be executed during the next 12 months (Financial commitment of previous years shall be given a weightage of 10% per year to bring them to the price level of the 2025-26) in the Technical Qualification Criteria mentioned in the next section.

Tenderer shall note that the Tenders of those found Eligible as mentioned in Clause 3 - Qualification of the Tenderer in Section 2: Instructions to Tenderers (ITT), will only be considered for evaluation.

The star rates in respect of specified materials (Cement, Steel and Bitumen) shall be payable as per GO No: FD/3/PCL/2008 Bangalore Dated 21.11.2008.

The tenderer shall furnish required information in all formats. Scan and upload all Formats/Original documents required for this bid to the kp-procurement portal. The Original Formats/Documents shall be produced at the time of opening of Technical Bid for physical verification.

The proposed methodology and program of construction, backed with equipment planning and deployment, duly supported with broad calculations and quality control procedures proposed to be adopted, justifying their capability of execution and completion of the work as per technical specifications within the stipulated period of completion.

The time stipulated for completion of work is 11 (Eleven) calendar months including rainy season.

The Agency shall comply with ISO 14001 (Environmental Management System) requirement during execution of work.

The tenderer shall submit an affidavit stating that he has not involved in litigation with Government, also he shall state that, amount of existing / on going works and amount of works awarded to him and yet to be commenced.

Contractor should follow strictly the prevailing rules of labour act and applicable any other law as concerned to work.

All safety precautions, warning signs, night illumination, reflectors, deployment of security guards has to be ensured so that no untoward incident happens on account of negligence or any project activity till completion. Contractor should indemnify the client to that extent.

The Defects Liability Period is 12 (Twelve) Months after successful completion of the Project

Contractor should establish a fully functional laboratory at site at their own cost and risk in order to carry out all the required tests for the materials and work being used in the project for satisfactory completion.

The Bidder shall ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of KP-Procurement portalon or before the last date of bid submission.

It is mandatory to use Manufactured Sand as per Government Circular No.PWD/72/BMS/2013 dated 31-07-2013. Also it is mandatory that the bidders should upload the required documents which demonstrate that, the bidder owns sand manufacturing unit or an agreement with the manufactured sand suppliers. The manufactured sand that should be got tested to confirm IS 383-2007 before use. Further, the contractor shall have his own Artificial sand manufacturing plant Unit.

As per Government Circular No.PWD/15/ITC/20082009 dated 2-12-2010, the tenderer can submit requisite EMD in two parts. i.e., for works costing from Rs.50.00 lakhs to 1.00 Crore, minimum of Rs.50,000/- through e-payment and rest of the amount either in the form of Bank Guarantee or FDR drawn in favour of the Executive Engineer, Public Works Department Division, Ballari issued by any Nationalised or Scheduled Bank. For works costing Rs.1.00 crore and above, minimum of Rs.1,00,000/- through e-payment and rest of the amount either in the form of Bank Guarantee or FDR drawn in favour of the Executive Engineer, Public Works Department Division, Ballari issued by any Nationalised or Scheduled Bank. If the tenderer intends to submit the requisite EMD in two parts, then the validity of EMD submitted in the form of Bank Guarantee or FDR shall remain valid for a period of 135 days from the last day of bid submission. If not such tenders will not be considered for evaluation. The tenderer shall submit the original instrument of EMD remitted in second part.

The Successful Tenderer has to execute the work as per approved designs and drawings provided by the Department.

Contractor should adhere to HSE policy applicable for similar projects. Contractor to that extent should submit HSE document defining all the procedure including the policies before execution of the project.

The tenderer shall note that, the increase in GST shall not be paid in the extended period of contract for which the contractor alone is responsible for delay as determined by the authority while granting the extension of time.

The tenderer shall note that, the GST at 18% shall be paid to the tendered amount separately.

The tenderers shall note that as per the Govrnment Order No.FD/850/EXP-12/15 dated 29-12-2015 and GO No.FD/130/EXP-12/15 dated 8-9-2015, the exemption from payment of EMD for Micro and small enterprises registered with NSIC under single point vendor registration scheme is applicable only for supply of goods but not for works.

If undue delay caused by the contractor, the progressive damages caused to road will be assessed and make good at the cost and risk of the contractor. In addition, suitable action will be initiated against the contractor for the damages occurred during the undue delay period in accordance with the Karnataka Highway Act, 1964.

The tenderers shall note that, as per The Karnataka Minor Mineral Concession Rules-1964, it is mandatory to submit the Mineral dispatch Permits (MDPs) issued by a competent authority, along with the bills. If not, penalty will be levied as per the prevailing clauses.

It is mandatory for the contractor to upload the work done certificate issued by an officer not below the rank of Executive Engineer duly indicating the work indent numbers for works costing more than Rs.5.00 lakhs

The tenderer shall upload Physical and financial implementation calendar format before last date of tender receipt in the kpp portal.

The Tenderer or his identified sub-contractor should possess required valid electrical license for executing electrification works

Successful tender should have to obtain all mandatory clearances from Fire Services, Electrical Inspectorate, GESCOM Power Supply, Water supply, UGD from local bodies etc., before commencement of the work

To qualify for award of this contract, each tenderer should furnish qualification information as per clause-3 and section- 3 of Standard Tender Document attached to this tender and all the Formats prescribed in the bid documents shall be filled by the tenderer in full and complete manner. Otherwise the tender will be rejected.

All scanned documents uploaded Should be in original and legible.

The intending contractors are requested to note that they should abide by the detailed instructions and conditions contained in the Standard Tender documents of K.P.W.D. and further orders thereon. The employer reserves the rights to Reject or accept any or all the tenders without assigning any reasons.

Within 20 days of receipt of the Letter of Acceptance, the successful Tenderer shall deliver to the Employer a Security deposit for an amount equivalent to 5% of the Contract price plus additional security for unbalanced tenders ( Difference between amount put to tender and quoted amount).

The tender of any tenderer who does not accept the conditions contained in the tender document is liable to be rejected. Conditional tenders will not be accepted.

The cost of tender form shall not be refundable. The tenderer shall bear all costs associated with the preparation and submission of his tender, and the employer will in no case be responsible and liable for those costs. No interest will be paid by the Government on the Earnest money deposit.

The rates quoted shall be through rates for finished items of work inclusive of all lead and lifts, loading and unloading charges, all incidental charges and all Royalty etc., complete payable to the Government or Local bodies in the Region.

The rates quoted shall be inclusive of providing barricading fittings of danger lights, Jungle clearance near work spot / watchman etc., complete and maintained till completion of work and removing on completion as directed by the Engineer-in-charge of work. Rates quoted should includes clearance of site prior to commencement of work and its closure in all respects and holds good for all works under all conditions of site, moisture and weather.

A Cess of 1% of the total approved amount of contract will be deducted from the work bill towards the Building and other construction workers welfare in accordance with the Govt. Order No. LD 300 LET 2006 Bangalore dated 18-1-2007. Royalty on construction materials and other taxes will be deducted as per prevailing Government orders. Contractor should follow strictly the prevailing rules of labour act.

All the materials required for the work shall be procured by the tenderer themselves and should got tested by the quality control authority before use on the work at their own cost. All quantity and gradation of metal collected for the works should be got approved by the competent authority before use.

Contractor should execute the project with least impact to the environment. The Contractor should maintain the work during defective liability period as per contract conditions.

Omission and Typographical errors which is in the opinion of the Executive Engineer, will not be a ground for claims of extra payment. If any of the dates mentioned happens to be a general holiday, the next working day will holds good.

Further particulars, if any, required by the Contractor can be had from the office of the Executive Engineer, Public Works Department, Division, Chitradurga during office hours on all working days.

The tenderer should have registration under section 7 of Building and other construction works act 1966. (As per G.O. No. LD 95 LET 2013, Bangalore dated 01-4-2013.

The tenderer should be a registered KPWD/CPWD Class-I Contractor

Tenderer should produce certificate of work insurance policies before executing the work.

Tenderer Should submit work program before executing the work

GST shall be paid to the tendered amount separately as per Government order no FD 20 CSL 2022, Bangalore Dated: 15.07.2022 and also as per circular issued by the government vide letter No. FD 447 Expenditure-12/2022, Bangalore Dated: 30.07.2022

Payment based on the grant released from KKRDB

All the milestones should be achieved as per the approved DPR (Annexure attached)

The proposed road project approved under KKRDB i.e. protective/restoration type project. Therefore, Contractor not eligible for any additional financial claims due to delay in handing over of site/any other reason. Contractor only eligible for extension of contract period in the above case under this contract.

The contractor should employ competent liaison persons to expedite the land clearance process through competent authorities (State/central) with the help of employer under this contract.

To qualify for award of this contract, each Tenderer in his name should have in the last five years i.e., 2020-21 2021-22, 2022-23, 2023-24 and 2024-25 - satisfactorily completed as prime contractor, at least one similar work such as -IMPROVEMENTS OF ASPHALT ROAD WORKS of value not less than Rs.334.50 Lakhs.
