Special Eligibility Criteria

   Supply to be made as per the Tender description, Annexure-1 and enclosed Drawing attached in tender documents.

   The tenderer must have supplied the same items to Southern Railways or any zonal railways and documentary evidence must be furnished along with their offer evidencing the execution of such purchase orders. The tenderer with past performance of satisfactory execution of contracts as mentioned above for supply of the same items for a quantity of 20% or more of tendered quantity against a single contract during last 3 years prior to, and excluding tender opening date (supported by CRNs, CRACs, R/NOTEs etc.) to be considered as responsive to Southern Railways requirements for placement of bulk and regular order. Here Same Item refer to Successful supply to any of the 14 Inspection gauges mentioned in tender description above.

   Railway reserves the right to place entire quantity order on either ORIGINAL EQUIPMENT MANUFACTURE or an AUTHORIZED DEALER nominated by the OEM. If authorized agent of OEM participates in the tender, valid tender specific authorization Certificate from OEM/principal with required undertaking that the vendor takes full responsibility for the quality of the material including warranty obligation shall be furnished along with the offer.

   (1) EMD shall be 2% of the estimated tender value and shall be taken from all bidders for contract value above Rs. 25 Lakh subject to the applicable exemptions. For details please refer 2.0 Part A of Southern Railway Tender Conditions available under the mentioned link in the tender. (2) Authorized dealers are advised to remit the EMD amount for consideration of the offer.

   (1) SECURITY DEPOSIT (SD) shall be 5 % of total value of contract and shall be taken from all vendors for contract value above Rs. 25 Lakh subject to the applicable exemptions. For details please refer 10.0 Part A of Southern Railway Tender Conditions available under the mentioned link in the tender. (2) In case of submission of Security Deposit in the form of Bank Guarantee,please refer Annexure-5 (page 54-56) of Southern Railway Tender Conditions available under the mentioned link, for the PROFORMA. (3) As per para 0501 of IRS conditions of contract- Security Deposit should remain valid for a minimum period of 60 days beyond the date of completion of all the contractual obligations of the supplier, including warranty obligations . i.e 3 years from the date of acceptance of the stores

   MAKE IN INDIA POLICY: Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as defined in Railway Board letter uploaded on IREPS website.

   Tenderers should mention the HSN CODE of the item and Rate of GST applicable. Firm's GST NO. and Firm's Banker details viz., Name & Address of the Bank Account No.., IFSC Code. and MICR No. in their E- Bid. Purchaser shall have the right to levy general damages on the supplier for failing to comply with the contractual conditions, not by way of penalty, an amount equal to 5% of the value of cancelled quantity.

   Railway is not bound to accept/Cancel the lowest or any tender or assign any reason for doing so and Railway reserves the right to accept/Cancel any tender in respect of the Whole or any portion of the items specified in the Schedule annexed (a or Tender Schedule) and the contractor shall be required to supply the same at the rate quoted.

   Land Border Condition : country which shares a land border with India. I certify that this bidder is not from such a country or , if from such a country, has been registered with the Competent Authority. I hereby certify that this bidder, fulfills all requirements in this regard, and is eligible to be considered. (Where applicable, evidence of valid registration by the Competent Authority shall be attached.)' along with bid for compliance of Office Memorandum of Department of Expenditure, Ministry of Finance dated 23.07.2020. If such certificate given by a bidder whose bid is accepted is found to be false, this would be a ground for immediate termination and further legal action in accordance with law.    "I/We have carefully gone through the IRS conditions of contract (included and uploaded along with the bid document) particularly Para 2500 pertaining to "Code of Integrity, Misdemeanor and Penalties". I/We hereby certify that no other concerns or affiliates (such as having common partner director/ promoter/owner/holding company decision control etc.) have participated in this tender which can give rise to a conflict of interest or fall under anti-competitive practices. We understand that the offers of all such sister concerns including ours are liable to be rejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti competitive practices [Para 2502(c)] and obligation to proactive disclosures [Para 2503]. I/We understand that we are fully responsible for the above declaration and it shall not be the Railway's responsibility to verify the same. I/We are aware that we shall be liable for all consequences of violation of Code of Integrity, if detected, at any stage".

   "In the event of rejection of pre-inspected materials at the consignee's end, a penalty of 5% of the value of the rejected goods shall be levied on the supplier for each such instance of rejection. This penalty shall be in addition to any other penalties and punitive actions available under all the terms and conditions of the contracts".
