Terms & Conditions, Scope of Work and Pre-Qualification Criteria of Vendor

For Indian Suppliers: i) Imported Items: a) OEM COC should contain details of Date of Manufacturing, Shelf Life and Storage Conditions and should be issued by QC Rep of the OEM. b) Supplier COC to be provided linking to the OEM COC and the supplier should submit the Certificate of Authorised Distributor of OEM.

Delivery Term / INCO-TERMS: F.O.R Engine Division, HAL, Bengaluru

Payment Terms: 100% payment through RTGS / ECS / NEFT will be made within 30 days from the date of receipt, completion of installation & commissioning (if applicable) and acceptance of the items at HAL.

Warranty: Supplier shall provide warranty as per the requirement provided against the Technical Specification against each line item. The warranty period shall commence from the date of acceptance of the items at HAL. In the absence of Warranty Term in Technical Specification, then, the warranty period shall be agreed as per Annexure-A, warranty condition.

Liquidated Damages: Time is the essence of the contract. In case of delay in the supply from the mutually agreed schedule, HAL shall be entitled at their option to recover from the Supplier / Contractor as agreed liquidated damages, and not by way of penalty, a sum of 0.5% of the invoice value (excl. of GST) of the delayed supplies for each week of delay or part thereof, subject to a maximum of 10% of invoice value (excl. of GST).

Validity of the Quote: Minimum 180 Days from Tender Due Date

The Bidder shall SUBMIT the following documents:

Products of Chinese Origin are not acceptable. Bidder to confirm that their offer does not include any items of Chinese origin.

Repeat Order: Repeat Order (single order or multiple orders) may be placed up to 100% of the value of the original order only after completion of the original order and within 12 months from the contractual date of completion of the original order . The prices, terms and conditions of the repeat order shall be the same as that of the original order

Option Clause:HAL reserves the right to order additional quantities up to 100% of the ordered quantity as per the price, terms & conditions of the resultant contract during the currency of the contract. It is entirely at the discretion of HAL to exercise this option. The additional quantities may be ordered in staggered manner in different years of supply at the discretion of HAL at any time during the currency/period of Contract.

Future Pricing Clause (As per Indigenization policy, the quoted price should be firm and fixed for next 05 years. Confirmation required)

Escalation of price (after 5 years if any)

IPR TRANSFER ( In Development orders , Intellectual Proprietary Rights will rest with HAL. Your Confirmation on IPR transfer to HAL is required)

Compliance of Make in India is as per Purchase Preference Policy (Preference to Make in India) Order 2017 (PPP-MII Order,2017) issued by Department of Promotion of Industry and Internal Trade (DPIIT) as revised from time to time. and MSME provision as per general terms and conditions

NOTE: SAMPLE OF ITEM TO BE SUPPLIED WITHIN 180 DAYS FROM THE DATE OF PLACEMENT OF ORDER

HAL Tender Terms and Conditions at Annexure-A will govern any resultant order arising out of the enquiry and bidder’s quotation will be subject to the said conditions. (In case of non agreement to any of the terms, then the same must be brought out in the Deviation Statement at Appendix-1 with proper justification. HAL reserves the right to accept or reject the deviations / justifications and accordingly to take a decision to qualify the bidder in the bid evaluation)
