   1) Railway reserves the right to procure bulk or entire qty. of this item from RDSO approved vendors. (RDSO Item ID : 3100553). Approval status of the firm will be reckoned as on the date of tender opening and not thereafter. But in case of downgrading /removal/suspension/banning etc.,after opening of this tender, such changes shall be taken into account while considering the offers.

    Have you attached any performance statements with your offer? For proof of supply to other railways / production units copy of Purchase Order, Inspection certificate and receipt note / certificate must be uploaded. Non-submission of such vital documents may be taken as their not having any such past performance.

Commercial-Compliance

   Tenderers should quote for all consignees with delivery to respective consignees ( destinations). If the tenderer fails to quote even for any one consignee/ destination or quotes conditional offer of delivery of material of any consignee to other consignee/destination then their offer will be treated as deviation to tender conditions and offer shall not be considered for any consignee (i.e) it will be rejected summarily.

   EARNEST MONEY DEPOSIT (EMD) : EMD shall be deposited by all vendors for tenders with estimated value above Rs.25 Lakhs subject to the applicable exemptions. For the exemptions and other details please refer Para 2.0 Part A of Southern Railway Tender conditions. In case of submission of Earnest Money Deposit in the form of Bank Guarantee, please refer Annexure- 6 of Southern Railway Tender conditions for the Proforma for BG.

   SECURITY DEPOSIT (SD) shall be 5 % of total value of contract and shall be taken from all vendors for contract value above Rs. 25 Lakh subject to the applicable exemptions. For details please refer 10.0 Part A of Southern Railway Tender Conditions. In case of submission of security Deposit in the form of Bank Guarantee, please refer Annexure - 5 of Southern Railway Tender conditions for the Proforma for BG.

   1. For PUBLIC PROCUREMENT POLICY (Preference to Make in India ), please refer Para 16.0 Part B of Southern Railway Tender Conditions. 2. Procurement of the item is restricted to Class-I Local suppliers with minimum local content of 50% (Class-I Local supplier as defined in Railway Board letter no: No.2020/RS(G)/779/2/Pt.1 dated 25.09.2020) only and the vendors who do not qualify to be "Class-I Local suppliers" (i.e., "Non-Local suppliers" or "Class-II Local suppliers" with local content less than 50%) should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a "Class-I Local supplier" for the tendered item participates in the tender, it does so at it's own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor. 3.Please enter the percentage of the local content in the material being offered .Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India Policy as incorporated in the tender condition.

   Split clause : Pre-decided splitting condition is applicable in this tender. The Purchaser reserves the right to split/distribute the procurable quantity on more than one eligible tenderers within the zone of consideration in terms of the criteria outlined in para 5.2 of Southern Railway Tender Conditions Part (B) available under mentioned link.

   1] The tenderers shall submit a copy of certificate stating that all their statements/documents submitted along with bid are true and factual. Standard format of certificate to be submitted by the bidder is enclosed as Annexure-14. Non-submission of above certificate by the bidder shall result in summary rejection of his/their bid. It shall be mandatorily incumbent upon the tenderer to identify, state and submit the supporting documents duly self- attested/digitally signed by which they/he is qualifying the Qualifying Criteria mentioned in the Tender Document. 2] It will not be obligatory on the part of Tender Committee/Accepting Authority scrutinize beyond the submitted document of tenderer as far as his qualification for the tender is considered. 3] The bidder shall be mandated to submit Annexure-14. The tenderers shall refer Annexure -14 of SR Tender conditions.

   Tenderers shall confirm the following declaration failing which the offer will be ignored. " I have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India.I certify that this bidder is not from such a country or,if from such a country, has been registered with the Competent Authority.I hereby certify that this bidder fulfills all requirements in this regard and is eligible to be considered. Where applicable, evidence of valid registration by the Competent Authority shall be attached."

We understand that the offers of all such sister concerns including ours are liable to be rejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti competitive practices [Para 2502(c)] and obligation to proactive disclosures [Para 2503]. I/We understand that we are fully responsible for the above declaration and it shall not be the Railway's responsibility to verify the same. I/We are aware that we shall be liable for all consequences of violation of Code of Integrity, if detected, at any stage.
