Dear Ladies and/or Gentlemen,
In support of the additional information required as per ITB clause 9.3(q) of the Bidding Documents, we furnish herewith our details/documents etc., alongwith other information, as follows:
We are furnishing the following details / document in support of qualifying requirement for the subject package(s).
Part- A - Technical Experience:
QUALIFICATION OF THE BIDDER:
Qualification of bidder will be based on meeting the minimum pass/fail criteria specified below regarding the Bidder’s technical Experience, Manufacturing Facilities and Financial Position as demonstrated by the Bidder’s responses in the corresponding Bid Schedules. Subcontractors’ technical experience and financial resources shall not be taken into account in determining the Bidder’s compliance with the qualifying criteria. The bid can be submitted by an individual firm or a Joint Venture of two or more firms. (Specific requirements for Joint Ventures are given under Para 1.3 below).
The Employer may assess the capacity and capability of the bidder, to ascertain that the bidder can successfully execute the scope of work covered under the package within stipulated completion period. This assessment shall inter-alia include (i) document verification; (ii) bidders work / manufacturing facilities visit ; (iii) manufacturing capacity, details of works executed, works in hand, anticipated in future & the balance capacity available for the present scope of work; (iv) details of plant and machinery, manufacturing and testing facilities, manpower and financial resources; (v) details of quality systems in place; (vi) past experience and performance; (vii) customer feedback; (viii) banker’s feedback etc.
POWERGRID reserves the right to waive minor deviations if they do not materially affect the capability of the Bidder to perform the contract
1.1 Technical Experience:
i) The bidder1 shall have successfully completed2 physical construction of transmission line project(s) involving tower foundation, erection and stringing of not less than 1 km of 400 kV or higher voltage class transmission line as a contractor or as a partner in a joint venture1 within the last seven (07) years as on the originally scheduled date of bid opening, i.e., 17/04/2023.
(1) Note: In case of works executed under a contract that had been awarded on a Joint Venture, the experience of individual Joint Venture partner shall be considered limited to the scope of that partner under the said contract.
(2) Successfully completed means issue of provisional or final taking over certificate (TOC) by the Employer to the contractor for the referred contract.
In case bidder is a holding company, the technical experience referred to in clause 1.1 above shall be of that holding company only (i.e. excluding its subsidiary/group companies). In case bidder is a subsidiary of a holding company, the technical experience referred to in clause 1.1 above shall be of that subsidiary company only (i.e. excluding its holding companies).
2.1 The bidder shall furnish following documents/ details with its bid:
a) The bidder shall submit documents in support of meeting the technical experience mentioned at para 1.1 above in the form of LOA/ Work order & completion certificate/ payment certificate or any other document evidencing the same.
b) The bidder shall submit audited / certified copies of Balance Sheet and Profit and Loss account in support of meeting the financial position as mentioned at para 1.2.

Part- B - Financial position Performance Report from Client
1.3 Financial Position Acceptance of Final Bill by Client
i. Minimum Average Annual Turnover *(MAAT) for best three years i.e. 36 months out of last five financial years of the bidder should be Rs. 1.13 Crores.
(b) Minimum Average Annual Turnover *(MAAT) for best three financial years i.e. 36 months out of last five financial years of the bidder should be Rs 9.95 Crore.
c) Bidder shall have liquid assets (L.A)or/ and evidence of access to or availability of credit facilities of not less than Rs.1.66 Crore.
*Note: - Annual Gross Revenue from operations/ Gross operating income as incorporated in the profit & loss account excluding Other Income.
In case bidder is a holding company, the financial position criteria referred to in clause 1.3 above shall be of that holding company only (i.e. excluding its subsidiary/ group companies). In case bidder is a subsidiary of a holding company, the financial position criteria referred to in clause 1.3 above shall be of that subsidiary company only (i.e. excluding its holding company).
NOTE : RELAXATION FOR MSEs/ STARTUPs
MSEs^/ START-UPs^^ shall also be considered qualified if they meet 80% (Eighty percent) of the requirements specified at para 1.3 above ^MSEs as defined in bidding documents. ^^START-Ups as defined by DIPP, applicable as on the originally scheduled date of bid opening.
1.4 Joint Venture Bids
a) In case a bid is submitted by a Joint Venture(JV) of two firms or more firms as partners, joint venture must comply with the following minimum criteria:
(i) All the partners of the JV shall meet individually the Financial Position criteria given at 1.3(a) above
(ii) The lead partner of Joint Venture shall meet not less than 50% of the Technical Experience criteria given at Para 1.1 above and not less than 40% of the Financial Position criteria given at Para 1.3 (b) & (c) above.
(iii) Each of the other partner(s) shall meet individually not less than 25% of the Technical Experience criteria given at Para 1.1 above or not less than 50 % of Manufacturing Facilities criteria given in para 1.2 above and not less than 25 % of the Financial Position criteria given at Para 1.3 (b) & (c) above.
b) In case the JV intend to participate in the package proposing supply of tower parts from a manufacturer(s) then the manufacturer(s) shall meet the Manufacturing Facilities criteria given at para 1.2 above.
c) The joint venture must collectively meet the criteria given at para 1.1, 1.2 and 1.3 above for which purpose the relevant figure of Technical Experience, Manufacturing Facilities and Financial Position (Para 1.3 (b) & (c)) for each of the partners of the JV shall be added together.
1.5 The Bidder shall furnish following documents with the bid :
1.5.1 Copy of valid electrical license issued from state or central government authority for working in charged electrical installations in support of compliance of 1.1(ii) above.
1.5.2 A copy of award letter and completion certificate or payment certificate or any other evidence in support of compliance of 1.1(i) above.
1.5.3 Copy of certified Balance Sheet and Profit and Loss account from practicing charted accountant in support of 1.3 (b) above.
1.5.4 In addition the bidder shall submit a copy of partnership deed / proprietorship affidavit/Article and Memorandum of Association etc. as the case may be depending upon the constitution of their firm.
1.5.5 In the event the bidder is not able to furnish the information of its own (i.e., separate), being a subsidiary company and its accounts are being consolidated with its group/ holding/ parent company, the bidder should submit the audited balance sheets, income statements, other information pertaining to it only (not of its group/ holding/ parent company) duly certified by any one of the authority {(i) Statutory Auditor of the bidder or (ii) Company Secretary of the bidder certifying that such information / documents are based on the audited accounts as the case may be}.
1.5.6 Similarly, if the bidder happens to be group/ holding/ parent company, the bidder should submit the above documents/ information of its own (i.e., exclusive of its subsidiaries) duly certified by any one of the authority {(i) Statutory Auditor of the bidder or (ii) Company Secretary of the bidder certifying that such information / documents are based on the audited accounts as the case may be}.
1.5.7 The documentary evidences mentioned above shall be submitted to the satisfaction of the owner.
1.5.8 Notwithstanding anything stated above, the owner reserves the right to assess the Bidder’s capability to perform the work should the circumstances warrant such assessment in the overall interest of the owner.

3.0 We are aware that, in line with Clause No. 27.1 (ITB), our Second Envelope (Price Part) is liable to be rejected in case the same contains any deviation/omission from the contractual and commercial conditions and technical Specifications other than those identified in this First Envelope.
4.0 We confirm that except as otherwise specifically provided our Bid Prices in Second Envelope include all taxes, duties, levies and charges as may be assessed on us, our Sub-Contractor/Sub-Vendor or their employees by all municipal, state or national government authorities in connection with the Facilities, in and outside of India.
4.1 100% of applicable Taxes and Duties i.e. GST, which are payable by the Employer under the Contract, shall be reimbursed by the Employer on production of satisfactory documentary evidence by the Contractor in accordance with the provisions of the Bidding Documents.
4.3 We also understand that, in case of award on us, you shall reimburse to us octroi/entry tax as applicable for destination site/state on all items of supply including bought-out finished items, which shall be dispatched directly from the sub-vendor’s works to the Employer’s site (sale-in-transit). Further, Service Tax, if applicable, for the services to be rendered by us, the same is included in our bid price in Second Envelope.
4.2 We confirm that we have also registered/we shall also get registered in the GST Network with a GSTIN, in all the states where the project is located and the states from which we shall make our supply of goods.
4.5 We confirm that no Sales Tax/VAT in any form shall be payable by you for the bought out items which shall be despatched directly by us under the First Contract (as referred in para 5.1 below) to the project site. However, you will issue requisite Sales Tax declaration/Vatable forms in respect of such bought out items, on production of documentary evidence of registration with the concerned Sales Tax Authorities.
5.0 Construction of the Contract
5.1 We declare that we have studied Clause GCC 2.1 relating to mode of contracting for Domestic Bidders and we are making this proposal with a stipulation that you shall award us two separate Contracts viz ‘First Contract’ for ex-works supply of all equipment and materials including mandatory spares and ‘Second Contract’ for providing all the services i.e. inland transportation for delivery at site, In-transit insurance, unloading, storage, handling at site, installation, testing and commissioning including Trial operation in respect of all the equipment supplied under the ‘First Contract’ and other services specified in the Contract Documents.
We declare that the award of two contracts, will not, in any way, dilute our responsibility for successful operation of plant/equipment and fulfillment of all obligations as per Bidding Documents and that both the Contracts will have a cross-fall breach clause i.e. a breach in one Contract will automatically be classified as a breach of the other contract which will confer on you the right to terminate the other contract at our risk and cost.
