Railway reserve the right to order entire or bulk quantity from OEM or their authorized dealers ( of MAKE BRANDS- PARKER/FESTO/SMC/NORGREN/JANATICS, as per s.No.-5 of Table-1 of MMDTS 19027 Rev.3 in Page no.6 of 13 date.22.12.2022.or similar) as per Clause No. 16.5 of General Tender Condition of Eastern Railway. Bidder must upload tender specific authorization from OEM, if quoting in behalf of OEM. . In a tender, either the agent %u201Con tender specific authorization%u201D, on behalf of the Principal/OEM or Principal/OEM itself can bid but both cannot bid simultaneously for the same item/product in the same tender. In such case, both the offers shall be considered ineligible and will be summarily rejected. If an agent submits bid on behalf of the Principal/OEM, the same agent shall not submit a bid on behalf of another Principal/OEM in the same tender for the same item/product. In such case, both the offers shall be considered ineligible and will be summarily rejected.

In terms of DPIIT/Ministry of Commerce and Industries order no. P- 45021/2/2017 PP (BE II) dated 16.09.2020 which is circulated vide Rly Board letter no 2020/RS(G)/779/2/Pt. 1 dated 25.09.2020 and Keeping in view with the public procurement (Preference to Make in India) order 2017 as amended time to time, only class 1 and class 2 local suppliers are eligible to participate in this tender. The bidder agrees to supply the tendered stores at the rates quoted by him in accordance with the IRS Conditions of Contract and (or) special Conditions and (or) other Conditions specified/attached with the tender.

The bidder should go through the Tender Documents consisting of Instructions to Tenders, General Tender Conditions and Special Conditions of Tender, and agree and confirm to abide by the Instructions to Tenders, General Tender Conditions, IRS Conditions of Contract and Special Conditions of Tender.

Guarantee/Warranty as per specification and In case specification does not contain guarantee/warranty clause then the same should be offered as per IRS Conditions of Contract.
