Special Eligibility Criteria

1. 1

   Only Manufacturer or their authorized dealers for tendered item are eligible and firm shall submit supporting documents for the same. Firm shall submit valid explosive license of DA Gas along with their offer. Authorized dealers are required to submit valid tender specific authorization certificate from manufacturer along with offer. Failing to comply the above conditions, the offer will be summarily rejected without any back reference.

   Bulk procurement will be made from those firms who have successfully supplied minimum 20 percent of the tendered quantity of the tendered item to Eastern Railway or in any other Railways during last 3 years as calculated from date of tender opening, against Purchase orders (including option quantity and Modification Advice, if any) of any zonal railways/PUs issued against one tender. Other capable firms not having sufficient supply performance for bulk order may be considered for developmental order up to 20 percent of the net procurable quantity after examining their credentials subject to their rates being lower than those applicable for regular and bulk order in terms of Para No. 16.4 of E. Rly GTC. Tenderer must upload documentary evidence in support of their completed supply performance during last 3 years as calculated from date of tender opening in the form of copies of PO, Receipt Notes etc. of Railways along with offer as credential in terms of Para No. 16.4 of E. Rly GTC. However, Railway reserves the right to refer to firm's performance in Eastern Railway as available with Railway. Railway reserves the right to split quantity more than one firm under bulk and developmental categories both for multi source ordering i.e Pre decided split ordering as per clause No. 18.0 of General terms and conditions will be applicable for this tender.

   The bidder should go through the Tender Documents consisting of Instructions to Tenders, General Tender Conditions and Special Conditions of Tender, and agree and confirm to abide by the Instructions to Tenders, General Tender Conditions, IRS Conditions of Contract and Special Conditions of Tender.

   The bidder agrees to supply the tendered stores at the rates quoted by him in accordance with the IRS Conditions of Contract and [or] special Conditions and [or] other Conditions specified/attached with the tender.

Commercial-Compliance

   Since the estimated value of tender exceeds Rs. 10 crore, the Class-I local supplier/ Class-II local supplier shall be required to provide a certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing cost accountant or practicing chartered account (in respect of suppliers other than companies) giving the percentage of local content.The bidder shall give self-certification for local content in the quoted item (goods/works/services) at the time of tendering. However at the time of execution of the project, for all contracts above INR 10 Crore, the contractor/ supplier shall be required to give local content certification duly certified by cost/ chartered accountant in practice. For cases where it is not possible to provide certification by cost/ chartered accountant at the time of execution of project, the supplier shall be permitted to provide the certificate for Local Content from Cost/Chartered Accountant after completion of the contract, within time limit acceptable to the procuring entity.(Clause 28 under section-2 of ER GTC regarding Public Procurement Policy for Preference to Make in India may be referred).

   Firm will have to submit quotation with a validity for a minimum period of 90 [Ninety] days otherwise their offer will be summarily rejected.

2. 2

   Earnest Money Deposit (EMD): EMD will be applicable as per clause no. 8.0 (SECTION-1) of Instructions to Tenderers for e-Tender and General Tender Condition (GTC) of Eastern Railway available in the IREPS. Vendors who are not exempted from paying the EMD must submit the EMD along with their BID as per the tender document failing which their offer will be summarily rejected without any back reference.
