Make/Brand name of the product offered by the bidder is to be clearly mentioned. Offer without Make/Brand name or vague terms like 'AS PER TENDER' or '0' will be summarily rejected.

BID SECURING DECLARATION : I/we hereby understand and accept that if I/we withdraw or modify my/our bids during the period of validity, or if I/we are awarded the contract and on being called upon to submit the performance security/security deposit, fail to submit the performance security/security deposit before the deadline defined in the request for bid document/notice inviting tender, I/we shall be debarred from exemption of submitting bid security/ Ernest money deposit and performance security/security deposit for a period of 6(SIX) months , from the date I/we are declared disqualified from exemption of EMD/SD for all tenders for procurement of goods issue by any unit of Indian railways published during this period.

Bd's L/No.2020/RS(G)/779/Pt.I (E 332267), dated. 20/08/2024 on Public Procurement (Preference to Make in India), Order 2017 - Revision, only CLASS-I LOCAL SUPPLIER as defined in this order shall be eligible to quote. The vendors who do not qualify to be CLASS I LOCAL SUPPLIERS should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a Class I local supplier for the tendered item participates in the tender it does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor. The Class-I local supplier must indicate percentage of local content and provide self-certification.

Eligibilty main : i) Tenderer with satisfactory past performance for the tendered item (with same/equivalent drawing/specification) within last 3 years for minimum 20 percent of the tendered quantity against a single order to any Zonal Railway or Railway PUs shall only be eligible for full/bulk order. Other sources may be considered for developmental order, provided the firm submits documentary proof in support of their credentials/satisfactory performance. ii) All other offers can be considered only for developmental order up to 20 percent of the net procurable quantity provided tenderer is a manufacture or registered with any of the Zonal Railways/PU/CORE or MSE firm for the tendered item [Or for the item having same description, but of different sizes/ratings/capacities] subject to their rate being lower than the rate of the lowest bidder eligible for bulk order. iii) The onus of submission of requisite documents (such as copies of receipt & acceptance for Non- Stock items, capacity & capability credential, M&P required for manufacturing tendered item, T&P, Technical manpower, in house testing facilities, MSE credentials, financial credential PAN no etc.) along with their e-offer regarding 'Bulk order' or 'Developmental order' lies with the tenderer. In case the tenderersdo not submit the requisite documents as detailed above along with their e-offer, the tender will be decided based on their past performance records as availablewith NFR/CON [if any]. iv) In case tenderer participate as an authorized agent, then the performance as required above shall be that of the Principal, authorizing the agent. lt may so happen that the agent has credentials of past supply for a different Principal but this will not be considered as performance for placing bulk order in case of change of Principal. i) Tenderers must submit performance documents such as copies of recent Purchase Orders for the tendered item received from any Zonal Railways /PUs with Receipt notes. Please note that non submission of such documents shall be taken as they are not having any such past performance and their offers shall be considered further as per extant rules. ii) The tenderer with past performance of satisfactory execution of contracts as mentioned above for supply of the same items for a quantity of 20 percent or more of tendered quantity against a single contract during last three years prior and to excluding, tender opening date may be considered [as responsive to N.F Rlys (Con) requirements] for placement of regular order. iii) If such past performance level is lower, then the offer may be considered [as responsive to N.F Rlys (Con) requirements] for placement of development order not exceeding 20 percent of the net procurable quantity. For consideration of such development orders, the tenderers who have no past performance as above, must along with their quotation submit the MSE for the same item

Delivery point:- Material to be delivered SSE/P.WAY/CON/APDJ under DYCE/CON/APDJ/N.F. Railway. If any of the Firm's are quoting deviation in delivery location, such offer will be summarily rejected.

Validity of offer shall be 60 days from the date of tender opening

Warranty /Guarantee as per IRS condition of contract.
