The tenderer must have minimum average annual contractual turnoverof V/N or 'V' whichever is less, where V= Advertised value of the tenderin crores of Rupees N= Number of years prescribed for completion ofwork for which bids have been invited. The average annual contractualturnover shall be calculated as an average of "total contractualpayments" in the previous three financial years, as per the auditedbalance sheet. However, incase balance sheet of the previous year is yetto be prepared/ audited, the audited balance sheet of the fourth previousyear shall be considered for calculating average annual contractualturnover. The tenderers shall submit requisite information as perAnnexure-VIB, along with copies of Audited Balance Sheets duly certifiedby the Chartered Accountant/Certificate from Chartered Accountant dulysupported by Audited Balance Sheet. Non submission Of the documents by the bidder shall result in summarily rejection of his/their bid.
Tenderer should have valid HT (33KV) electrical contractor's license issued by state/central govt. Supporting documents self-attested should be submitted along with tender papers. The tenderer has to upload the HT supervisory license if the contractor license is not reflecting as HT. If tenderer do not upload valid HT (33KV) electrical contractors license, the same offer of tenderer will be summarily rejected.
WORK EXPERINCE:-The tenderer must have successfully completed orsubstantially completed any one of the following categories ofwork(s)during last 07(seven) years, ending last day of month previous tothe one in which tender is invited: (i)Three similar works each costing notless than the amount equal to 30% of advertised value of the tender, or(ii)Two similar works each costing not less than the amount equal to40%of advertised. value of the tender, or (iii)One similar work costing notless than the amount equal to 60% of advertised value of the tender.Note: Substantially Completed Work means an ongoing work in whichpayment equal to or more than 90% of the present contractvalue(excluding the payment made for adjustment of Pricevariation(PVC), if any) has been made to the contractor in that on goingcontract and no proceedings of termination of contract on Contractor'sdefault has been initiated. The credential certificate of SubstantiallyCompleted Work should have been issued not prior to 60days of date ofinvitation of present tender. Note: Work experiencecertificate fromprivate individual shall not be considered. However,in addition to workexperience certificates issued by any Govt.Organisation, work experiencecertificate issued by Public listed companyhaving average annualturnover of Rs 500 crore and above in last 3financial years excluding thecurrent financial year, listed on NationalStock Exchange or Bombay StockExchange, incorporated/registered atleast 5years prior to the date ofclosing of tender, shall also beconsidered provided the work experiencecertificate has been issued by aperson authorized by the Public listedcompany to issue such certificates.Incase tenderer submits workexperience certificate issued by publiclisted company, the tenderer shallalso submit along with workexperience certificate, the relevant copy ofwork order, bill of quantities, bill wise details of payment received dulycertified by Chartered Accountant, DS certificates for all paymentsreceived and copy of final/last bill paid by company in support of abovework experience certificate. Non submission Of the documents by thebidder shall result in summarily rejection of his/their bid.

(i)The tenderer shall clearly specify whether the tender issubmitted on his own(Proprietary Firm) or on behalf of aPartnership Firm / Company / Joint Venture(JV) / RegisteredSociety / Registered Trust / Hindu Undivided Family (HUF)/Limited Liability Partnership (LLP) etc. The tenderer(s) shallenclose theattested copies of the constitution of their concern,and copy of PAN Card alongwith their tender. TenderDocuments in such cases are to be signed by suchpersons asmay be legally competent to sign them on behalf of thefirm,company, association, trust or society, as the case may be. (ii)The Otherdocuments to be submitted in support of the above asper Clause No. 14 (ii) ofGCC- 2022. (iii) If it is NOT mentioned inthe submitted tender that tender isbeing submitted on behalf ofa Sole Proprietorship firm / Partnership firm / JointVenture /Registered Company etc., then the tender shall be treated ashavingbeen submitted by the individual who has signed thetender. (iv) After openingof the tender, any documentpertaining to the constitution of SoleProprietorship Firm /Partnership Firm / Registered Company/ Registered Trust/Registered Society / HUF/LLP etc. shall be neither asked norconsidered, ifsubmitted. Further, no suo-moto cognizance of anydocument available inpublic domain (i.e., on internet etc.) or inRailway's record/office files etc. willbe taken for consideration ofthe tender, if no such mention is available intender offersubmitted. (v) A tender from JV shall be considered onlywherepermissible as per the tender conditions. (vi) The Railway willnot bebound by any change of power of attorney or in thecomposition of the firmmade subsequent to the submission oftender. Railway may, however,recognize such power ofattorney and changes after obtaining proper legaladvice, thecost of which will be chargeable to the Contractor.
Should a tenderer or Contractor being an individual,havemember(s) of his family or in the case of partnershipfirm/company / joint venture (JV) / registered society /registeredtrust etc. one or more of hispartner(s)/shareholder(s) ormember(s) of the family ofpartner(s)/shareholder(s) havingshare of more than 1%in thetendering entity employed ingazetted capacity in theEngineering or any other departmentof the railway, then thetenderer at the time of submission oftender, will inform theauthority inviting tenders the details ofsuch persons. a)i)Should a tenderer i) be a retired Engineer of thegazetted rank or any other gazetted officer working beforehis retirement, whether in the executive or administrativecapacity or whether holding a pensionable post or not, inthe Engineering or any other department of any of therailways owned and administered by the President of India forthe time being, OR ii) being partnership firm / joint venture (JV)/Registered society / registered trust etc have as one ofits partners/members a retired Engineer of the gazetted rankor any other gazetted officer working before his retirement,OR iii) being an incorporated company have any suchretired Engineer of the gazetted rank or any other gazettedofficer working before his retirement as one of its directorsAND incase where such Engineer or officer had not retiredfrom government service at least 1 year prior to the dateof submission of the tender THEN the tenderer will givefull information as to the date of retirement of such Engineeror gazetted officer from the said service and as towhether permission for taking such contract, or if theContractor be a partnership firm or an incorporated company,to become a partner or director as the case may be, has beenobtained by the tenderer or the Engineer or officer, as the casemay be from the President of India or any officer, dulyauthorized by him in this behalf, shall be clearly stated inwriting at the time of submitting the tender. The bidder shall submit copy of PAN card(s) & GST Registration certificate.
The tenderer whether sole proprietor / a company or apartnership firm /registered society / registered trust / HUF / LLPetc. if they want to act throughagent or individual partner(s),should submit along with the tender, a copy ofpower of attorneyduly stamped and authenticated by a Notary Public orbyMagistrate in favour of the specific person whether he/they bepartner(s) ofthe firm or any other person, specificallyauthorizing him/them to sign thetender, submit the tender andfurther to deal with the Tender/ Contract up tothe stage ofsigning the agreement except in case where such specificperson isauthorized for above purposes through a provisionmade in the partnershipdeed / Memorandum of Understanding /Article of Association /Board resolution,failing which tender shallbe summarily rejected. A separate power of attorneydulystamped and authenticated by a Notary Public or by Magistratein favour ofthe specific person whether he/they be partner(s) ofthe firm or any otherperson, shall be submitted after award ofwork, specifically authorizinghim/them to deal with all othercontractual activities subsequent to signing ofagreement, ifrequired. Note: A Power of Attorney executed andissuedoverseas, the document will also have to be legalized by theIndianEmbassy and notarized in the jurisdiction where thePower of Attorney is beingissued. However, the Power ofAttorney provided by Bidders from countries thathave signedthe Hague Legislation Convention 1961 are not required tobelegalized by the Indian Embassy if it carries a conformingAppostillecertificate. The tenderer should have to submit Powerof Attorney along with hisoffer stated above.
The tenderer shall produce a statement along with the bid as follows: "No retired Engineer (retired within one year prior to the date of submission of tender) or retired gazetted officer(retired within one year prior to the date of submission of tender) of Railways is associated with the tenderer ". E-Tender forms are not transferable and the same is to be submitted with digital signature by the Tenderer already registered with the site.
The submitted e-tender forms will be considered as digitally signed by the tenderer as a confirmation from the tenderer that the tenderer has read, agreed and accepted all the conditions and laid down documents as well as Schedule of Tender, General and Special Conditions.
NIT PERIOD IS SPLITTED AS UNDER-

Offer Submission Period - 15 (Fifteen) days prior to opening of tender during which TENDERERS CAN SUBMIT THEIR OFFER
The tender offer complete in all respect and with all documents is to be submitted online by e-tendering process through the website www.ireps.gov.in before the closing time/date of this tender as mentioned in the NIT (Notice Inviting Tender). Tenderer can revise the bids any number of times till the closing time/date of the tender. No manual offers shall be accepted.
The administration will not own any responsibility, if website is not opened for downloading/uploading the tender documents due to any technical snag.
False/incomplete statement: Any statement / declaration made by the tenderer while uploading tender or submitted later as specifically required in the tender, if proved wrong or false or incomplete or such as to withhold any information relevant to the award of the tender, at any stage of the tender or in the event of his tender having been accepted, at any stage the contract, shall render his/their tender(s)/contract(s) liable to be cancelled/rescinded, in addition to the following:
If such statement is found at the tender stage, his total Earnest Money / Bid Security shall be forfeited.
In case such a statement is found at the contract stage, the 4.2.2 conditions/rights available to the Railways under Clause 62 of the G.C.C. shall be applicable.
In addition to above, action of banning of business may also be taken against such tenderers including prosecution under law.
If the tenderer(s) deliberately gives / give wrong information in his/their tender or creates/create circumstances for the acceptance of his/their tender, the Railway reserves the right to reject such tender at any stage.
The Railway may, of its own or in response to any clarification requested/suggested by any person including that from the tenderer, may modify this tender document at its sole discretion at least 15 days before the due date of closing of the tender as corrigendum.
Corrigendum as required may be issued atleast 15 days prior to the closing of the tender. These corrigenda of this tender, if any, as issued time to time will be available on website at least 15 days in advance of closing of tender. The tenderers are requested to check the website before submitting their offer whether any such corrigendum to the tender has been issued or not and revise the offer if required accordingly. Failure on the part of tenderer on this aspect will be solely tenderers responsibility.
This document is the Standard Tender Document which consists of the Instruction to the Tenderers, NIT (Notice Inviting Tender), Indian railway standard General Conditions of contract, Additional Special conditions of the tender, Tender schedules, Specifications of the works & various Annexure etc. All the above mentioned documents taken together if not scored off, shall constitute the complete tender document hereafter referred to as Tender Document & have to be read together & acted upon accordingly. No part of the tender document can be relied upon or acted upon in isolation.
In case of any problem with the portal is faced while filling the e- tender, Tenderers are advised to contact with the Helpdesk of IREPS portal who will render all help and assistance related with the website and portal except that related with the details of the tender. Railway will not take any responsibility for non- participation in the e-tender online for the reasons related to the website and portal or server etc beyond the control of railways.
Railway and the IREPS website will not take the responsibility for any online payment made by the tenderer and debited from his/their account towards the tender cost or Earnest Money due to wrong or mis manipulation or any reasons related with the IT or found unsuitable for the tender etc. In this regard Railway and IREPS website will not entertain any claim or refund the paid amount.
Opening of Tender
Opening of e-tender online:- The e-tenders will be opened online using the IREPS portal. No representative is required to be present for opening of tender and taking notes of rates quoted and ranking as the complete details of rates etc. of all the bidders shall be available to the bidders in the website after the opening of the tender.
In case the date of closing mentioned in the Notice Inviting Tender is declared a holiday /bandh/strike etc. on any account, the date of closing tender online will not be changed as the application in the website of IREPS does not permit submission of any offer after closing date and time of the tender. However, opening of tenders online will be on any convenient day after the closing date/time of tenders
The railway and the website will have no responsibility for incorrect evaluation of cost and thereby incorrect cost of work and ranking of tenders. If the schedule is not filled in correctly and unambiguously for each item. No claim or clarification of a tender regarding applicability, inclusion or exclusion of any element of tax or duty or any other change in the offer subsequently (after opening of the tender) will be entertained, for this the tenders are advised to read the instructions, General Conditions, Special Conditions and other instructions carefully before submission of tender.
The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the Railway, make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification, by the railway shall not relieve the bidder of its obligations or liabilities hereunder nor will it affect any rights of the railway there under.
In case of any wrong information submitted by tenderer, the contract shall be terminated Earnest Money Deposit (EMD), Performance Guarantee (PG) and Security Deposit (SD) of contract forfeited and agency barred for doing business on entire Indian Railway for 02 years.
No post tender correspondence shall be entertained after closing of tender even suo- moto post tender letters of the tenderers shall be treated as null/void.
For all tenders having advertised cost of Rs.10 lakh or above,the contractorshall have to submit the option to take paymentfrom Railways through a letterof credit (LC) arrangement. Thetenderer shall affirm having read over andagreed to the termsand conditions of the LC option. The option of takingpaymentthrough LC arrangement, once exercised by tenderer at thetime of bidding, shall be final and no change shall be permitted,thereafter, during execution of contract. (The tenderer have tosubmit the option to take payment from Railway through aLetter of Credit arrangement).
TRD related work in connection with the work of "Protection to side slopes in cuttings by wirerope netting, esaening of slope, retaining wall etc to protect deep cuttings on vunerable locations under the jurisdiction of ADEN/RAIR of Sambalpur Division".
