Augmentation and improvement/Upgradation of Telecom infrastructure by Supply, Installation, Testing, Commissioning of IP based Intercom Exchanges & Telecom Equipments along with LAN cabling including associated works related to Fire Alarm System, Lightening Arrestor, Power Supply and Replacement of old analog PCSTE Conference system with Digital Audio Conference System in Head Quarter Gorakhpur, N.E. Railway.

Financial Eligibility Criteria as per Clause 10.2 of Part-I of IRSGCC-2022: The tenderer must have minimum average annual contractual turnover of 'V/N' or 'V' whichever is less; where V= Advertised value of the tender in crores of Rupees. N= Number of years prescribed for completion of work for which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information as per Annexure-VIB of GCC 2022 (Annexure-VIB of Tender Document & separately enclosed with tender), along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet, and as per tender document.

Attested Certificates(s) issued by Executive or Nominated Authority of the government Departments or Semi-Government/Public Sector Undertakings for the value of the work done for them during the qualifying period including current financial year certifying the bill amounts paid Agreement-wise and Date-wise or attested photo copy of such certificate. Such certificates will be accepted only from Govt. / Govt. bodies / PSUs authorities. Certificates issued by Private Bodies will not be considered.

Audited Balance Sheets clearly indicating contractual receipts from the works done for Govt./ Govt. bodies / PSUs/Pvt. Organization in the P&L Account of the balance sheet duly certified by the Chartered Accountant for the completed Financial years. For the current financial year, Provisional Balance sheet issued by Chartered Accountant, clearly indicating contractual receipts. NOTE: (i) Financial Year shall normally, be reckoned as 1st April to 31st March of the Next Year. However, for Turnover Criteria, the Financial Year as applicable to the Company /Tenderer is to be considered, if it defers from the above. (ii) Current Financial year is reckoned as the incomplete financial year in which the date of tender submission falls. (iii) Chartered Accountant statements duly indicating yearly receipts will not be considered until and unless backed by Audited Balance Sheets or Provisional Balance sheet. (iv) If the tender is not accompanied by the certificate(s) in support of financial eligibility as above, the tender shall be rejected. No post-tender correspondence will be entertained

Technical Eligibility Criteria as per Clause 10.1 of Part-I of IRSGCC-2022: a. The tenderer must have successfully completed or substantially completed any one of the following categories of work(s) during last 07 (seven) years, ending last day of month previous to the one in which tender is invited: i. Three similar works each costing not less than the amount equal to 30% of advertised value of the tender, OR ii. Two similar works each costing not less than the amount equal to 40% of advertised value of the tender, OR iii. One similar work costing not less than the amount equal to 60% of advertised value of the tender. b. In case of tenders for composite works (e.g. works involving more than one distinct component, such as Civil Engineering works, S&T works, Electrical works, OHE works etc. and in the case of major bridges - substructure, superstructure etc.) (Not Applicable for this Tender), tenderer must have successfully completed or substantially completed any one of the following categories of work(s) during last 07 (seven) years, ending last day of month previous to the one in which tender is invited: i. Three similar works each costing not less than the amount equal to 30% of advertised value of each component of tender, OR ii. Two similar works each costing not less than the amount equal to 40% of advertised value of each component of tender, OR iii. One similar work each costing not less than the amount equal to 60% of advertised value of each component of tender. Note for b: Separate completed works of minimum required values shall also be considered for fulfillment of technical eligibility criteria for different components, and as per tender document. Note - Works Completion certificate of Similar work along with copy of LOA as per IR GCC 2022 may be submitted, this shall be on bidder's name. NOTE - Substantially Completed Work is defined in Tender Document Attached Herewith vide Para 10.5 of GCC April 2022 with latest applicable ACS.

Work experience certificate from private individual shall not be considered. However, in addition to work experience certificates issued by an officer not below the rank of JA Grade or Bill passing Officer in Railways and Bill passing Officer/Executive In-charge of work in other Govt. / Govt. bodies / PSUs. The certificate should bear the signature and seal of the issuing officer, name of the department etc. In case tenderer submits work experience certificate issued by Public listed company having average annual turnover of Rs. 500 crore and above in last 3 financial years excluding the current financial year, listed on National Stock Exchange or Bombay Stock Exchange, incorporated/registered at least 5 years prior to the date of closing of tender, shall also be considered provided the work experience certificate has been issued by a person authorized by the Public listed company to issue such certificates. In case tenderer submits work experience certificate issued by public listed company, the tenderer shall also submit along with work experience certificate, the relevant copy of work order, bill of quantities, bill wise details of payment received duly certified by Chartered Accountant, TDS certificates for all payments received and copy of final/last bill paid by company in support of above work experience certificate. (Proforma for Work experience certificate/Works Completion certificate as per Annexure-13 & 17 of tender document & separately enclosed with tender)

Definition of Similar Work: - " Any work involving commissioning of Telephone Exchange/IP Exchanges/ Intercom Facilities"

The said suppliers of goods and/or services would be subject to GST Act and rules as applicable from time to time. Tenderers are requested to submit their offers as per GST Tax regime. All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law.

The offer submitted by the firm shall be in compliance of Railway Board's letter No. 2020/Tele15(18)/4(3317053) dated 21.01.2025 regarding Government Procurement (Preference to Make in India) Order 2017- Telecom Products, Services or Works.

The offer submitted by the firm against this tender shall be in compliance of Order No. P-45021/2/2017-PP (BE-II)-Part (4) Vol. II dated 19.07.2024 of Department of Promotion of Industry and Internal Trade, Ministry of Commerce and Industry attached with this tender. The tenderer shall enter local content percentage with their offer.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

Tenderer(s) on award of contract will have to enter into agreement with Railway in format of above mentioned original tender documents. Tenderer(s) shall not have any right/claim to insist on signing of contract agreements in format on which tender document were forwarded by him on e-tendering website.

If during process of tender finalization, it is detected that tenderer has submitted tender documents after making any changes / additions / deletions in the tender documents on e- tendering website, then, the earnest money deposited by the tenderer shall be forfeited by the Railway. Further, if after award of contract, it is detected that tenderer has submitted tender documents after making any changes/additions/deletions in the tender documents e-tendering website then Railway will take action to remove the contract from the work in terms of clause 62 of GCC 2022 and initiate such further legal action against contractor as it considered necessary.

The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the Railway, make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification, by the railway shall not relieve the bidder of its obligations or liabilities hereunder nor will it affect any rights of the railway there under. False/Incomplete statement: Any statement/declaration made by the Tenderer, if proved wrong or false or incomplete or such as to withhold any information relevant to the award of the tender, at any stage of the tender or in the event of his tender having been accepted at any stage of the contract, shall tender his/their tender(s)/contractors) liable to be cancelled/rescinded, in addition to the following: (i) If such statement is found at the stage of tender his total earnest money shall be forfeited. (ii) In case such a statement is found at the contract stage rights available to the Railways under clause 62 of the GCC-2022 with latest applicable ACS shall be applicable.

If the mandatory documents asked for in the E-Tender Document are not submitted along with the tender, the tender submitted otherwise will be treated as incomplete and will not be considered.

The quantities shown in above Schedule are approximate and are as a guide to give the tenderer(s) an idea of quantum of work involved. The Railway reserves the right to increase/ decrease and/or delete or include any of the quantities given above and no extra rate will be allowed on this account.

It is responsibility of the tenderer that they ensure to see any Corrigendum of the tender to check the corrigendum on the website from time to time.

The Tenderer's shall not add any conditions on their own in the tender documents while submitting their offer. Any such conditions if stated and if tender conditions are in violation of the Railway s, may lead to summary rejection of the offer. Railway reserves the right to reject such tenders summarily without assigning any reasons whatsoever.

Railways, being principal employer are required to ensure that the contractors are complying with the provisions of the contract labour (R&A) Act, 1970 and Minimum wages Act, 1948 strictly and arranging prescribed minimum wages to the contractor labourers vide Railway Board letter No. 2016/E(LL)/AT/MW/1 Dt. 05.06.2017.

It is the responsibility of contractor to arrange the payment of the labour employed for the work through bank and to deduct PF as per the provisions of Minimum Wages Act.

No post tender correspondence for submission of additional documents shall be entertained after opening of the Technical & Commercial offers. Even suomoto post tender letters of the tenders shall be treated as NULL & Void as per Para 4.6 of STD- 2022.

As per Railway board letter No. 2018/CE-1/CT/4 dt. 17.10.2018 contractor shall mandatorily update the labour data on Railway Sharmik kalyan portal on monthly basis. The detailed guidelines are given in Clause 5.4 of PART-I of Standard Tender Document- 2022.
