When work is tendered for by a firm or company, the tender shall be signed by the individual legally authorized to enter into commitments on their behalf

The tenderers shall submit a copy of certificate stating that all their statements/documents submitted along with the bid are true and factual. Standard format of certificate to be submitted by the bidder is enclosed as Annexure-V.In addition to Annexure-V, in case of other than Company/Proprietary Firm, Annexure-V(A) shall also be submitted by each member of a Partnership Firm/Joint Venture (JV)/Hindu Undivided Family (HUF)/Limited Liability Partnership (LLP), etc., as the case may be.Non-submission of the above certificate(s) (i.e. Annexure-V & V(A)) by the bidder shall result in summary rejection of his/their bid.It shall be mandatorily incumbent upon the tenderer to identify, state and submit the supporting documents, duly self-attested/digitally signed, by which they/he is qualifying the Qualifying Criteria mentioned in the Tender Document.NOTE: "On IREPS Module, a facility has already been created for online submission of Annexure-V. Therefore, the provision of downloading Annexure-V of GCC & uploading physically signed Annexure-V by the tenderer has been discontinued on IREPS."(As per Railway Board's Letter No. 2022/CE-I/CT/GCC Correspondence, New Delhi, dated 14.05.2024)

Documents to be Submitted Along with Tender:-The tenderer shallclearly specify whether thetender is submitted on his own (ProprietaryFirm) oron behalf of a Partnership Firm/Company/JointVenture(JV)/Registered Society /Registered Trust /Hindu Undivided Family(HUF)/Limited LiabilityPartnership (LLP) etc. The tenderer(s) shallenclosethe attested copies of the constitution of theirconcern and copyof PAN Card along with theirtender. Tender Documents in such casesare to besigned by such persons as may be legallycompetent to signthem on behalf of the firm,company, association, trust or society, as thecasemay be. The tenderer whether sole proprietor/a company ora partnershipfirm/registered society/registeredtrust/HUF/LLP etc if they want to actthrough agentor individual partner(s), should submit along withthetender, a copy of power of attorney dulystamped and authenticated by aNotary Public or byMagistrate in favour of the specific personwhetherhe/they be partner(s) of the firm or anyother person, specificallyauthorizing him/them tosign the tender, submit the tender and furthertodeal with the Tender/Contract up to the stage ofsigning the agreementexcept in case where suchspecific person is authorized for abovepurposesthrough a provision made in thepartnershipdeed/Memorandum of Understanding/Article of Association/Boardresolution, failing whichtender shall be summarily rejected. Aseparatepower of attorney duly stamped andauthenticated by a Notary Public orby Magistrate infavour of the specific person whether he/theybepartner(s) of the firm or any other person, shallbe submitted after awardof work, specificallyauthorizing him/them to deal with allothercontractual activities subsequent to signing ofagreement, if required.Note: A Power of Attorneyexecuted and issued overseas, the documentwillalso have to be legalized by the Indian Embassy andnotarized in thejurisdiction where the Power ofAttorney is being issued. However, thePower ofAttorney provided by Bidders from countries thathave signedthe Hague Legislation Convention 1961are not required to be legalizedby the IndianEmbassy if it carries a conforming Apostillecertificate.

Since the work is to be carried out by the OEM ,relaxation in eligibility criteria ( technical andfinancial) is being provided as per Railway Board'sletter no. 2011/M(M&P) /7/2/Guidelines, dated23.08.2012 & letter No:2011/M(M&P)/7/2/Guidelinesdated 23.01.2020
