1. Bulk Order: Bulk order will be placed on the manufacturer or its authorized agent having proven performance. The manufacturer firm must have satisfactorily executed at least of 20 percent of total tendered quantity upto date of tender opening against one single purchase order of Zonal Railways/ PUs/CORE for the tendered item/similar item, placed during three preceding completed financial year and current financial year upto date of tender opening. 2. The onus of submission of requisite documents in support of supply {[i] Receipt Notes/Proof of acceptance of material by consignee OR [ii] Inspection Certificate with self declaration by the bidder that supply has been accepted by consignee. Furnishing of false declaration shall render termination of contract and further action as per terms and conditions of contract} lies with the tenderer. 3. In case tenderer participates as an authorized agent, then the performance as required above shall be that of Principal authorizing the agent. It may so happen that the agent has credentials of past supply for a different Principal but this will not be considered as performance for placing bulk order in case of change of Principal.

i) In case of road delivery, the date of delivery at destination (Consignees end) shall only be treated as delivery date irrespective of F.O.R./F.O.T. condition mentioned elsewhere in the contract/tender. (ii) The bidder confirms that rates and other financial terms quoted in relevant columns of financial bid will only be ruling terms for acceptance, and such terms i) In case of road delivery, the date of delivery at destination (Consignees end) shall only be treated as delivery date quoted anywhere else should be ignored. (iii) (a) Regarding MSE purchase preference firms, please refer clause 15.0 part B of Southern Railway tender conditions available under the link Public Documents->Stores/Supply. (b) Goods and service Tax: Please refer part A Para 14.0 of Southern Railway tender conditions available under the link Public Document -> Stores/Supply. (d) Tenderers are advised to refer instructions to tenders (Part A) and Tender conditions (Part B) for other terms and conditions available under the link Public Document -> Stores/Supply.

Procurement of the item is restricted to Local suppliers with minimum local content of 20% (Class-I or Class-II Local supplier as defined in Railway Board letter no: No.2020/RS(G)/779/2/Pt.1 dated 25.09.2020) only and the vendors who do not qualify to be "Local suppliers" (i.e., "Non-Local suppliers" with local content less than 20%) should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a "Local supplier" for the tendered item participates in the tender, it does so at it's own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor

Tenderers shall confirm the following declaration failing which the offer will be ignored. " I have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India. I certify that this bidder is not from such a country or, if from such country, has been registered with the Competent Authority. I hereby certify that this bidder fulfills all requirements in this regard and is eligible to be considered. Where applicable, evidence of valid registration by the Competent Authority shall be attached."
