1. OEM/Authorised agents for the tendered make/brand are eligible for bulk quantity order. 2. Preferably manufacturers should participate. Participating traders/agents must provide authorization letter issued by the OEM or OEM authorized stockist along with their offer. Authorization letter should preferably be tender specific. In case of general authorization letter, it must clearly indicate the validity period/expiry date. Offers with general authorization letter silent on validity period/expiry date will not be considered for placement of order and that offer is liable to be ignored. Authorization issued by OEM Indian office is also acceptable. Bidders must submit authorization letter along with their offer failing which the offer is liable to be ignored. i) In a tender, either the authorized agent/dealer on behalf of the Principal/OEM or the Principal/OEM itself can bid, but both cannot bid simultaneously for the same item in the same tender and such bids will be summarily rejected. Further, against a particular tender, one Principal/OEM should not issue Tender Specific Authorization (TSA) to more than one agent/dealer. Such offers with different terms against a particular product, if treated as ambiguous offers, the bidder(s) or their Principal/OEM will have no right to lodge any claim. ii) If an authorized agent/dealer submits bid on behalf of the Principal/OEM, the same agent/dealer shall not submit a bid on behalf of another Principal/OEM in the same tender for the same item/product and such bids will be summarily rejected.

In case where firm has failed to supply material within DP, General Damages equal to 5% of the PO/Contract value will be applicable in cases where performance guarantee is not applicable and not submitted by firm. In cases where a firm has submitted a performance guarantee, then the same will be forfeited.
