Bulk or full order will be placed on firm who has successfully supplied tendered/similar [Paint /Primer item] item to Zonal Railways/PU/CORE /PSU/Other Govt. Department in last three financial year including current financial year up to date of tender opening. Necessary documents like R/note/CRN/CRAC/IC (successfully complied) etc. regarding proof of supply must be uploaded along with tender, failing which offer may be liable to be by passed/passed over.

LIQUIDATED DAMAGE (LD) ON DELAYED SUPPLY: For delayed supplies, Recovery of Liquidated Damage (LD) shall be levied @1/2% (half percent) of the price of the store per week or part of the week during which delivery is accepted and the upper limit for recovery of LD in supply contracts is 10%(ten percent) of the valu of contract irrespective of delays, unless otherwise provided, specifically in the contract.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

IRS Conditions of Contract: The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.
I/We engage to supply the Western Railway with the articles specified above upon the terms of the Indian Railway Standard Conditions of Contract (latest revision) and upon the terms of the Revised Special Conditions and Instructions for the Guidance of the Contracts issued by the Western Railway. (Instructions to Tenderers & General condition of Contract as per latest amendment available on IREPS portal.
The contract shall be governed by Instructions to Tenderers and General Conditions of contract as revised from time to time, last revised in September 2021, Version 2021/1 or latest, as available as public documents of W. Rly. on IREPS website. It may be noted that the reference to IRS conditions of contract in the above special conditions is construed to mean IRS conditions of contract, latest version. It may be noted that conditions mentioned in tender schedule on IREPS shall prevail over General Conditions of Contract, which in turn shall prevail over IRS conditions of Contract.
