Supply , Installing , Commissioning & Testing of Extension Medical Gas Pipe Line System at disaster management ward of BLW Central Hospital.

a) The tenderer must have successfully completed or substantially completed any one of the following categories of work(s) during last 07 (seven) years, ending last day of month previous to the one in which tender is invited:: Three similar works each costing not less than the amount equal to 30% of advertised value of the tender, or Two similar works each costing not less than the amount equal to 40% of advertised value of the tender, or One similar work each costing not less than the amount equal to 60% of advertised value of the tender.

Defination of Similar Work :- Similar works implies Supply, Installation, commissioning, testing & Maintenance of Oxygen Gas Pipe Line System (MGPS) to hopsitals of Railway /central goverment / state goverment.

I/we the tenderer (s) am/are signing this document after carefully reading the contents.

I/We the tenderer(s) also accept all the conditions of the tender and have signed all the pages in confirmation thereof.

I/we hereby declare that I/we have downloaded the tender documents from Indian Railway website www.ireps.gov.in . I/we have verified the content of the document from the website and there is no addition, no deletion or no alteration to the content of the tender document. In case of any discrepancy noticed at any stage i.e. evaluation of tenders, execution of work or final payment of the contract, the master copy available with the railway Administration shall be final and binding upon me/us.

I/we declare and certify that I/we have not made any misleading or false representation in the forms, statements and attachments in proof of the qualification requirements.

I/We also understand that my/our offer will be evaluated based on the documents/credentials submitted along with the offer and same shall be binding upon me/us.

I/We declare that the information and documents submitted along with the tender by me/us are correct and I/we are fully responsible for the correctness of the information and documents, submitted by us.

I/we certify that I/we the tenderer(s) is/are not blacklisted or debarred by Railways or any other Ministry / Department of Govt. of India from participation in tender on the date of submission of bids, either in individual capacity or as a HUF/ member of the partnership firm/LLP/JV/Society/Trust.

I/we understand that if the contents of the certificate submitted by us are found to be forged/false at any time during process for evaluation of tenders, it shall lead to forfeiture of the Bid Security and may also lead to any other action provided in the contract including banning of business for a period of upto two year. Further, I/we and all my/our constituents understand that my/our offer shall be summarily rejected.

I/we also understand that if the contents of the certificate submitted by us are found to be false/forged at any time after the award of the contract, it will lead to termination of the contract, along with forfeiture of Bid Security/Security Deposit and Performance guarantee and may also lead to any other action provided in the contract including banning of business for a period of upto two year.

I/We have read the clause regarding restriction on procurement from a bidder of a country which shares a land border with India and certify that I am/We are not from such a country or, if from such a country, have been registered with the competent Authority. I/We hereby certify that I/we fulfil all the requirements in this regard and am/are eligible to be considered (evidence of valid registration by the competent authority is enclosed)

The complete equipment/ items shall be covered by warranty for a period of three years from the date of completion/installation of the respective work of medical gas pipe line warranty shall include the following: -

Till the warranty period Firm should provide one of his trained service person for 08 hours daily ( morning hours) at BLW hospital premises to attend breakdown calls.

Firms have to attend breakdown calls within a Hour for rest of 16 Hours.

Firm should have local office at Varanasi City.

Security Deposit: The Security Deposit shall be 5% of the contract value. The successful bidder has to submit the Security Deposit Amount within 21 days after receiving the LOA in PCMO office of BLW , Varanasi.

Refund of Security Deposit: Security Deposit mentioned in sub clause (1) above shall be returned to the Contractor after successfully completion of warranty period .

(ii) Forfeiture of Security Deposit: Whenever the contract is rescinded as a whole under clause 62 (1) of these conditions, the Security Deposit already with railways under the contract shall be forfeited. However, in case the contract is rescinded in part or parts under clause 62 (1) of these conditions, the Security Deposit shall not be forfeited.

No interest shall be payable upon the Bid Security and Security Deposit or amounts payable to the Contractor under the Contract, but Government Securities deposited in terms of Sub- Clause 16.(4)(b) of this clause will be payable with interest accrued thereon.

Ensure all equipment as mentioned above is always operational. The services are also required to be provided on holidays and Sundays (No extra charge will be paid for the same).

The staff for problem rectification at site should be competent to handle any emergency and rectify the problem in minimum possible time.

No cost of spare parts will be reimbursed.

During the Warranty, all required spares should be supplied to the equipment site by the tenderer. Shipping clearance, custom, octroi and any other taxes & duties etc. shall be paid by the tenderer. It is the responsibility of the tenderer to see that the equipment & all the accessories are maintained in proper functioning condition by providing spare parts where required, whether such accessories are manufactured by the tenderer or not. Railway will not enter into any separate service contract with any other manufacturer for the maintenance of these accessories.

The number of visits for attending to breakdown of equipment should be unlimited.

BLW Medical Administration in no case is responsible for any legal matter arising of any State/Central /Govt. laws in the matter of employment of the labour by Contractor or in respect of any other matter.

Minimum wages to the laobur/Staff and other statutory obligations shall be met by the contractor at his own cost. Railway Administration will not be responsible for any dispute/legal matter arising regarding this.

The Contractor in addition to the indemnity provided by law shall indemnify the Railway administration against all liability whatsoever to pay compensation under Workmen Compensation Act as amended from time to time in respect of any accident/injury to any labour employed by him under this contract or compensation in respect of any claim arising out of or in the course of employment under this contract.

The contractor shall not assign or sublet the contract or any part thereof or allow any person to become interested therein in any manner whatsoever without the permission in writing of the Railway. Any breach of this condition shall entitle the Railway to rescind the contract and also render the contractor liable for payment to the Railway of any loss or damage arising or ensuring from such cancellation.

VARIATIONS IN EXTENT OF CONTRACT: The quantities shown in the schedule are approximate and meant to give the tenderer/s an idea of the quantities of work involved. The Railway reserves the right to add/delete any item/s and to increase/decrease the quantities. Notwithstanding anything contained in the other clauses of the agreement, in the event of unsatisfactory service or any failure/breach at any time by the contractor of the terms and provision of the agreement, the contract shall be terminated forfeiting the deposits i.e. PBG/SD etc. of the contractor and contractors shall have no claim whatsoever against the administration in consequence of such termination of contract. Price variation clause is NOT applicable in this tender:

Sr.DMO/Anesthesia will be executing the work.

Penalty Clause: As per Clause as defined in at 17-B of Gcc-2020 of Works pertains to liquidated damages for non- completion of the work within stipulated completion period which will be applicable only for the work of SITC of MGPS System.

Payment Clause:

(i)Payment for Schedule : 100 % payment will be made after on successful installation and commissioning of the entire work of i.e. Supply, Installing, Commissioning & Testing of Medical Gas 2.15.1 Pipe Line system (MGPS) at BLW Central Hospital disaster management ward , Varanasi , Subject to submission of SD @ 5% .

(ii)The bill for payment will be processed in measurement book 2.15.2 by DMO/Anesthesia , but will be processed further by Hospital Administrator.

Payment against this work shall be made by Railways through NEFT.

BLW also reserves the right to reject all or any of the offers or terminate the contract of any / all contractors at any time during the currency of the contract without assigning any reason.

Whenever there is any conflict between the General Conditions of Contract and Special Conditions of Contract, the later shall prevail.

Service Tax/GST registration number to be made mandatory for all bidders and to be included in the tender document.

The contractor should sign the Scope of Work, Technical Specifications and additional conditions, general conditions of contract, Special conditions of the contract along with the contract document.

COMMENCEMENT OF WORK: Contractor should start the work within 10 days from the date of issue of acceptance letter.

PERMIT OR PARWANA: The contractor will at his own expense obtain such permits or parwana from whomsoever necessary for carrying out work or for any other purpose as may be necessary to enable him to perform his part of the contract. The Railway Administration will not under any circumstances be liable to obtain any permit or parwana whatsoever, for the contractor.

Cancellation or suspension of contract: The Railway Administration shall be at liberty at any time without giving any reasons to suspend temporarily of terminate permanently this contract after giving one month's notice in writing to the contractor and the contractor shall not be entitled to any date or compensation by reason thereof. Force Majeure Clause: If at any time, during the continuance of this contract, the performance in whole or in part by either party of any obligation under this contract shall be prevented or delayed by reason of any war, hostility, acts of public enemy, civil commotion, sabotage, serious loss or damage by fire, explosions, epidemics, strikes, lockouts or acts of God (hereinafter, referred to events) provided, notice of the happening of any such event is given by either party to the other within 30 days from the date of occurrence thereof, neither party shall by reason of such event, be entitled to terminate this contract nor shall either party have any claim for damages against the other in respect of such non-performance or delay in performance, and works under the contract shall be resumed as soon as practicable after such event has come to an end or ceased to exist, and the decision of the Medical Director as to whether the works have been so resumed or not, shall be final and conclusive, PROVIDED FURTHER that if the performance in whole or in part of any obligation under this contract is prevented or delayed by reason of any such event for a period exceeding 120 days, either party may at its option terminate the contract by giving notice to the other party.
