DECLARATIONS The bidder shall submit the duly signed declaration furnished in the bid document.

The bidder is required to ensure browser compatibility of the computer well in advance to the last date and time for receipt of tenders. The departments shall not be responsible for non-accessibility of Karnataka public procurement portal due to internet connectivity issues and technical glitches at bidders end.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

The original documents should be produced for verification at any stage of tender process as and when sought for, failing which, the bids are liable for disqualification.

Rates shall be quoted in price schedule in the website itself.

The tender document is part and parcel of the agreement Condition.

Conditional tenders are liable for rejection.

The successful bidder shall give an undertaking that they would abide by the provisions of the Employees Provident Fund Act.

The bidder shall obtain insurance coverage for all the workers deployed for this work.

The bidder shall quote his rates exclusive of GST but inclusive of all other applicable taxes, levies, duties and Building Workers Welfare Cess at 1% etc., as per the latest GoK and GoI prevailing as on the last date of submission of bid.

The bidder shall quote his rates inclusive of PF as per the applicable rate as issued by the PF department from time to time.

KPCL shall recover the Income Tax, building workers welfare cess, at the prevailing applicable rates.

The bidder should take into account the prevailing royalty charges while quoting their rates. The successful bidder shall strictly adhere (GoK circular DATED :07.11.2023) to Rule 36 & 42 of Karnataka Mineral Concession Rules 1994 & its amendments thereof. If the successful bidder/agency fails to furnish documents related to remittance of royalty charges for Coarse aggregate, Fine aggregate, murrum etc., as per Rule 44(4) of Karnataka Mineral Concession (amendment) Rules 2023, prevailing royalty charges along with following penalty will be recovered from the work bills. A. penalty of 5 times the royalty amount & additional payment(AP) of 40% royalty amount to Department of mines and Geology. B. penalty of 10% of royalty amount and the same will be transferred to District Mineral Foundation Trust.

The bidder should maintain register of workers deployed and wages paid for the workers and shall produce the documents whenever called for by the competent authority. Remittance towards PF shall be commensurate with the labour component of the work involved.

Bidder should have independent PF code. The bidder shall remit PF of labourers to Contractors permanent PF code number only and not to the KPCL PF sub code.

In case the dates notified above declared as holiday, the immediate next working day will be reckoned

If the Bidder makes any alterations in the conditions of the contract or puts any condition of his own, such tenders are liable for rejection.

The bidder shall register himself under section 7 and their workers who will be engaged for the works under section 12 of the Building and other construction workers (Regulation of employment & conditions of services) Act 1996

Corrigendum/modification/corrections, if any, will be published in the web site only.

The bidder shall quote item rates on the basis of prevailing market rate.

Bidders shall give declaration regarding payment of fair and reasonable wages which shall not be less than the minimum wages fixed by the government from time to time to the labours working under the contractor in the contract undertaken by him. Failing which, the bids are liable for rejection.

The successful bidder shall obtain ESI coverage for all the workers deployed for this work if required.

KPCL reserves the right to verify any information/document furnished by the bidder should the circumstances so warrant in the overall interest of the Corporation. In case the information or the documents furnished are found to be incorrect or invalid, then tenders of such bidders will be cancelled and the EMD furnished by such bidders will be forfeited.

Any revision in GST rates during execution of work will be paid to the contractor by KPCL or recovered from the bills of the contractor.

In case of death of a contractor after executing the agreement/ commencement of the work, his legal heir (to be intimated at the time of execution of agreement by the successful contractor), if any eligible registered contractor and willing, can execute and complete the work at the accepted tender rates irrespective of the cost of the work after obtaining approval from competent authority.

The successful bidder shall furnish Contract performance guarantee (CPG)/Security deposit (SD) in the form of DD/NEFT or e-Bank Guarantee from any schedule bank acceptable to the Corporation, Insurance Surety Bonds issued by Insurance Company authorized by Insurance Regulatory and Development Authority of India and enter into an agreement within 20 days of receipt of Letter of Intent through e-portal.

Contract performance guarantee (CPG)/Security deposit (SD) shall be equivalent to 5% of the Contract amount and should be valid for 30 days after the date of completion of defect liability period.

Work completion period is 4 (Four) months excluding monsoon. Defect liability period for the work is One Hundred Twenty (120) months from the date of completion of the work. Contract period is 124 (One hundred and twenty four ) months (i.e Work completion period plus Defect liability period).

If tenderer has engaged in corrupt or fraudulent practice, action shall be initiated finance department, Government of Karnataka Notification No.FD884 Exp-12/2019, Bengaluru, dated 7th May 2020.

Any variation in labour wages made by the Government from time to time shall be borne by the agency. Any claim towards this variation will not be entertained by KPCL.

Past Experience

The intending bidder should have satisfactorily completed (at least 90% of the contract value) as a prime contractor at least one water proof treatment work using TPO membrane of value not less than Rs. 18.22 Lakhs during the preceding five financial years i.e. 2021-22, 2022-23, 2023-24, 2024-25 and 2025-26. The past experience should be supported by original scanned copy of the Work done certificate issued from state/central Government/Government under taking from the officers not below the rank of Executive Engineer. (Work done of previous financial years shall be given weightage of 10% per year to bring them to the price level of the financial year in which the tender is invited)

The intending bidder should have achieved in at least Two (02) financial years an average annual financial turnover Rs. 36.43 Lakhs in the last 05 (Five) financial years i.e. (2021-22, 2022-23, 2023-24, 2024-25 and 2025-26). Turnover certificate, duly certified by chartered Accountant (along with UDIN No) shall be furnished. (Financial turnover of previous financial years shall be given weightage of 10% per year to bring them to the price level of the financial year in which the tender is invited)
