5 Minimum Local content (Make in India Policy): The ‘local content’ requirement to categorize a supplier as ‘Class-I local supplier’ is minimum 50%. For ‘Class-II local supplier’, the ‘local content’ requirement is minimum 20%. Nodal Ministry/ Department may prescribe only a higher percentage of minimum local content requirement to categorize a supplier as ‘Class-I local supplier/ ‘Class-II local supplier’. For the items, for which Nodal Ministry/ Department has not prescribed higher minimum local content notification, it shall be 50% and 20% for ‘Class-I local supplier’/ ‘Class-II local supplier’ respectively. Supplier’s status as MSEs: It is relevant to note that as per Government of India direction, the aspect of MSEs policies also included in the tender and the same is covered in the other terms & conditions which are part of RFQ. The aspect as indicated below would be applicable for procurement which falls under divisible category (i.e., not applicable for indivisible category).  If any Indian vendor satisfies the requirement of MSEs stipulation and also falls within the purchase preference margin as called for in MSME policy (in case of matching L1 price) will be considered for ordering 25% of tendered quantity. The balance quantity/works will be considered for distribution amongst all bidders (including MSEs) as per this subject purchase preference policy.  In case no MSEs qualifies for purchase preference or do not match with L1 price then the total tendered quantity will be distributed amongst all bidders as per this subject purchase preference policy. That the bidder has to indicate MLC as part of offer & Self Certificate and Auditor might have also indicated MLC as per their certification. In case there is difference in those values, the lowest of them will be considered as the applicable MLC & the offer will be dealt accordingly. Other MLC information will be treated as invalid

TERMS and CONDITION: Compliance/ Remarks

1 Currency of offered prices. (i.e. INR etc.)

2 Incoterms - Price/Delivery basis (i.e. whether price is on FOR Engine Division etc. incoterms 2010)

3 Liquidated damages (HAL standard term is 0.5% per week of delay or part thereof upto maximum 10% of the delayed item value)

4 Payment terms (HAL standard payment term is 100% within 30 days of receipt & acceptance of items at HAL)

5 Validity of offer (HAL required validity of offer is 120 days from the tender due date)

6 Acceptance of Other terms as per HAL standard terms attached with RFQ.

7 REPEAT ORDER: Repeat Order may be placed up to 100% of the value of the original order after placement of the original order, but within 12 months from the date of completion of the original order unless, in the mean time, further market research has disclosed a cheaper source of supply. The prices, terms and conditions of the repeat order shall be the same as that of the original order. No price negotiation shall be held. Repeat order (single order or multiple orders totaling to 100% value of the original order) may be placed by other Division of HAL including the Division which has originally placed purchase order. In order to exercise the control on the total value, the repeat order should be coordinated by the Division who originally placed order to ensure sum total of value does not exceed 100% of original order.

8 Option Clause: HAL reserves the right to order additional quantities up to 100 % of the ordered quantity as per the price, terms & conditions of the resultant contract during the currency of the contract. It is entirely at the discretion of HAL to exercise this option. The additional quantities may be ordered in staggered manner in different years of supply at the discretion of HAL at any time during the currency/period of Contract.

9 By participating / bidding against this tender the Seller / Bidder automatically complies with the bid and all HAL terms and conditions. In the absence of this input the offer would be considered as acceptance of HAL RFQ terms and conditions. If any terms and conditions are not acceptable, the same has to be brought in the quotation clearly.

Important Note: Price comparison will be carried for each line seperately. Hence, vendors to quote unit price inclusive of packing charges. In case any vendor quotes lumsum packing charges for eg. per box etc., this lumpsum charge will be considered individually (and not prorata) for each line item for the purpose of comparison between vendors prices. Hence, it is adviced to quote unit prices for each line item inclusive of packing.
