The tenderer must have minimum average annual contractual turnoverof V/N or 'V' whichever is less; where V= Advertised value of the tenderin crores of Rupees; N= Number of years prescribed for completion ofwork for which bids have been invited. The average annual contractualturnover shall be calculated as an average of "total contractualpayments" in the previous three financial years, as per the auditedbalance sheet. However, in case balance sheet of the previous year isyet to be prepared/ audited, the audited balance sheet of the fourthprevious year shall be considered for calculating average annualcontractual turnover. In this reference, fourth previous year shall beconsidered only if bidder(s) give their consent in Annexure VIB as"previous year is yet to be prepared/ audited". The tenderers shallsubmit requisite information as per Annexure-VIB, along with copies ofAudited Balance Sheets duly certified by the CharteredAccountant/Certificate from Chartered Accountant duly supported byAudited Balance Sheet. Criteria with explanation & Format are attachedas a link.
(a) Attested Certificates(s) issued by Executive or Nominated Authority ofthe government Departments or Semi-Government/Public SectorUndertakings for the value of the work done for them during thequalifying period including current financial year certifying the billamounts paid Agreement-wise and Date-wise or attested photo copy ofsuch certificate. Such certificates will be accepted only from Govt. / Govt.bodies / PSUs authorities. Certificates issued by Private Bodies will not beconsidered.
NOTE: (i) Financial Year shall normally, be reckoned as 1st April to 31stMarch of the Next Year. However, for Turnover Criteria, the FinancialYear as applicable to the Company /Tenderer is to be considered, if itdefers from the above. (ii) Current Financial year is reckoned as theincomplete Financial year in which the date of tender submission falls.(iii) Chartered Accountant statements duly indicating yearly receipts willnot be considered until and unless backed by Audited Balance Sheets orProvisional Balance sheet. (iv) If the tender is not accompanied by thecertificate(s) in support of financial eligibility as above, the tender shallbe rejected. No post-tender correspondence will be entertained.
If JV firms are allowed to participate; Financial eligibility of the JV Firmshall be adjudged based on satisfactory fulfillment of the Para No.17.15.2of J.V guide lines of IRSGCC April - 2022 [with up to date correction slip].
10. Eligibility Criteria: 10.1 Technical Eligibility Criteria: (a) The tenderermust have successfully completed or substantially completed any one ofthe following categories of work(s) during last 07 (seven) years, endinglast day of month previous to the one in which tender is invited:(i) Threesimilar works each costing not less than the amount equal to 30% ofadvertised value of the tender, or (ii) Two similar works each costing notless than the amount equal to 40% of advertised value of the tender, or(iii) One similar work costing not less than the amount equal to 60% ofadvertised value of the tender. (b) (1) In case of tenders for compositeworks (e.g. works involving more than one distinct component, such asCivil Engineering works, S&T works, Electrical works, OHE works etc. andin the case of major bridges - substructure, superstructure etc.),tenderer must have successfully completed or substantially completedany one of the following categories of work(s) during last 07 (seven)years, ending last day of month previous to the one in which tender isinvited:(i) Three similar works each costing not less than the amountequal to 30% of advertised value of each component of tender, or (ii)Two similar works each costing not less than the amount equal to 40% ofadvertised value of each component of tender, or (iii) One similar workeach costing not less than the amount equal to 60% of advertised valueof each component of tender. Note for b(1): Separate completed worksof minimum required values shall also be considered for fulfillment oftechnical eligibility criteria for different components. (b)(2)In such cases,what constitutes a component in a composite work shall be clearlypredefined with estimated tender cost of it, as part of the tenderdocuments without any ambiguity. (b) (3) To evaluate the technicaleligibility of tenderer, only components of work as stipulated in tenderdocuments for evaluation of technical eligibility, shall be considered. Thescope of work covered in other remaining components shall be eitherexecuted by tenderer himself if he has work experience as mentioned inclause 7 of the Standard General Conditions of Contractor throughsubcontractor fulfilling the requirements as per clause 7 of the StandardGeneral Conditions of Contract or jointly i.e., partly himself andremaining through subcontractor, with prior approval of Chief Engineerin writing. However, if required in tender documents by way of SpecialConditions, a formal agreement duly notarised, legally enforceable in thecourt of law, shall be executed by the main contractor with thesubcontractor for the component(s) of work proposed to be executed bythe subcontractor(s), and shall be submitted along with the offer forconsidering subletting of that scope of work towards fulfilment oftechnical eligibility. Such subcontractor must fulfill technical eligibilitycriteria as follows:The subcontractor shall have successfully completedat least one work similar to work proposed for subcontract, costing notless than 35% value of work to be subletted, in last 5 years, ending lastday of month previous to the one in which tender is invited through aworks contract. Note: for subletting of work costing up to Rs 50 lakh, noprevious work experience of subcontractor shall be asked for by theRailway
The total value of similar nature of work completed during the qualifyingperiod and not the payments received within qualifying period alone,shall be considered. In case, final Bill of similar nature of work has notbeen passed and final measurements have not been recorded, the paidamount including statutory deductions will be considered. If finalmeasurements have been recorded and work has been completed withnegative variation, then also the paid amount including statutorydeductions will be considered. However, if final measurements havebeen recorded and work has been completed with positive variation butvariation has not been sanctioned, original agreement value or lastsanctioned agreement value whichever is lower shall be considered forjudging eligibility.
In case JV firms are allowed to participate, Technical Eligibility of the JVFirm shall be adjudged based on satisfactory fulfillment of the ParaNo.17.15.1 of J.V. guide lines of IRSGCC April-2022 [read with up to datecorrection slip]

The value of work completed will not include the cost of any materialsissued free of cost by the Railway/ Department concerned. PriceVariation amount, if any; if indicated / incorporated in the experiencecertificate will also be considered towards eligibility.
Work experience certificate from private individual shall not beconsidered. However, in addition to work experience certificates issuedby any Govt. Organization, work experience certificate issued by Publiclisted company having average annual turnover of Rs 500 crore andabove in last 3 financial years excluding the current financial year, listedon National Stock Exchange or Bombay Stock Exchange,incorporated/registered at least 5 years prior to the date of closing oftender, shall also be considered provided the work experience certificatehas been issued by a person authorized by the Public listed company toissue such certificates.
The work experience certificate shall be in the name and style of thetenderer participating or as per provisions under Clause 17.15 of GCCApril-2022 for JV Firm, if eligible to participate. [with up to date correctionslip]
The work experience certificate shall be issued by an officer not belowthe rank of JA Grade or Bill passing Officer in Railways and Bill passingOfficer/Executive In-charge of work in other Govt. / Govt. bodies / PSUs.The certificate should bear the signature and seal of the issuing officer,name of the department etc. In case tenderer submits work experiencecertificate issued by public listed company, the tenderer shall also submitalong with work experience certificate, the relevant copy of work order,bill of quantities, bill wise details of payment received duly certified byChartered Accountant, TDS certificates for all payments received andcopy of final/last bill paid by company in support of above workexperience certificate.

IRSGCC para 6.0 of part-I (a)(ii) Tenderers will examine thevarious provisions of The Central Goods and ServicesTax Act,2017(CGST)/ Integrated Goods and Services Tax Act,2017(IGST)/ Union Territory Goods and Services Tax Act,2017(UTGST)/ respective state's State Goods and Services TaxAct (SGST) also, as notified by Central/State Govt.& as amendedfrom time to time and applicable taxes before bidding.Tenderers will ensure that full benefit of Input Tax Credit (ITC)likely to be availed by them is duly considered while quotingrates. (a)(iii) The successful tenderer who is liable to beregistered under CGST/IGST/UTGST/SGST Act shall submit GSTINalong with other details required under CGST/IGST/ UTGST /SGSTAct to railway immediately after theaward of contract, withoutwhich no payment shall be released to the Contractor. TheContractor shall be responsible for deposition of applicable GSTto the concerned authority. (a)(iv) In case the successfultenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, the railway shall deduct the applicable GST fromhis/their bills under reverse charge mechanism (RCM) anddeposit the same to the concerned authority. (b) When work istendered for by a firm or company, the tender shall be signedby the individual legally authorized to enter into commitmentson their behalf. (c) The Railway will not be bound by any powerof attorney granted by the tenderer or by changes in thecomposition of the firm made subsequent to the execution of thecontract. It may, however, recognize such power of attorney andchanges after obtaining proper legal advice, the cost of whichwill be chargeable to the Contractor.
Increase/decrease of TAXES: if rates of existing GST or cess onGST for Works Contract is increased or any new tax /cess onWorks Contract is imposed by Statute after the date of openingof tender but within the original date of completion/date ofcompletion extended under clause 17 & 17A and the Contractorthereupon properly pays such taxes/cess, the Contractor shall bereimbursed the amount so paid. Further, if rates of existing GSTor cess on GST for Works Contract is decreased or any tax/cesson Works Contract is decreased / removed by Statute after thedate of opening of tender, the reduction in tax amount shall berecovered from Contractor's bills/Security Deposit or any otherdues of Contractor with the Government of India
Fixed Deposit Receipts (FDRs) submitted after award of tendertowards Security Deposit/Performance Guarantee should be withautomatic renewal facility only.
Tenderer(s) shall note that conditional/alternate offer will not beconsidered and will summarily be rejected, even though suchcondition makes them as the lowest tenderer.

Price Variation Clause (PVC) is applicable If the advertisedtender value above Rs.2 Crores. Base Month: The Base Month for 'Price VariationClause' shall be taken as the one month prior to closing oftender, unless otherwise stated elsewhere. The Bid Security shall be deposited either in cash throughepayment gateway or submitted as Bank Guarantee bond froma scheduled commercial bank of India or as mentioned in tenderdocuments. The Bank Guarantee bond shall be as perAnnexureVIA and shall be valid for a period of 90days beyondthe bid validity period. We fail to submit the requisite Performance Guarantee [P.G] inthe prescribed format even after 60 (Sixty days) from the dateof issue of Letter of Acceptance, we are aware that the contractliable to be terminated duly forfeiting Bid Security and otherdues, if any payable against the contract.
