Inspection of item to be done through 3rd Party

All the relevant OEM Test Certificates/Inspection Certificates to be submitted by contractor to railways

As the GST Regime has been implicated from 01-07-2017 against the previous regime of the ED. ST.VAT and Tax ect., therefore the tenderer shall indicate in their offer in the remarks column as to whether they are registered with GST Regime for availing input Tax credit (ITC) or not. If they are availing ITC. They shall take into account the entire credit on input available under GST regime while quoting the price and furnish a declaration to this effect along with a confirmation that any further benefit available in future on account of ITC will be passed on to the purchaser. In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, the Railway shall deduct the applicable GST from his/their bills under reverse charge mechanism (RCM) and deposit the same to the concerned tax authority.

All the items which are not mentioned specifically and are required for proper installation and commissioning of items under scope of supply shall be in contractors scope of supply.

Migration to GST Regime-special tender conditions: The GST is applicable with effect from 01-07-2017.

For : Destination

Latest version 14 of Bid document, special condition of the tender, conditions mentioned in the item specification and IRS conditions of the contract shall be applicable to this tender.

Liquidated damages:railway will recover from the contractor as agreed liquidated damages and not by way of penalty, a sum equivalent to 0.5% (half percent)of the price of any stores (including elements of taxes, duties,freight etc.)which the contractor has failed to deliver within the period fixed for delivery in the contract or as extended for each week or part of a week during which the delivery of such stores may be in arrears where delivery thereof is accepted after expiry of the aforesaid period, subject to a maximum of 10% of value of delayed supplies and the same will not be waived off except in cases where delay is on account of RCF.note:(this is applicable for tenders opened after 31 mar 2019)

GD clause : Railway reserve the right to cancel the contract after expiry of the delivery period by imposing GD@ 10% of the outstanding the value of order.
