   This item shall be procured from the Original Equipment Manufacturer (OEM) or an OEM-authorized supplier. In case of an OEM-authorized supplier, a valid authorization letter issued by the OEM shall be submitted along with the bid. The authorization letter must specifically mention the Tender Number for which the authorization is issued. In case the OEM submits the bid directly, self-certification confirming OEM status shall be furnished along with supporting documents, such as a valid factory license for the manufacturing facility, ISO certification(s), and any other relevant documents establishing OEM credentials.

   Bidder should have successfully Supplied, Same item to Indian Railways/Govt. Departments/Public Sector Undertakings in last 2 years from the date of tender opening. Proof of such successful, execution of contract to be uploaded along with the offer in the form of Receipt Note, Completion Certificate etc

Commercial-Compliance

   (i) In case of road delivery, the date of delivery at destination (Consignees end) shall only be treated as delivery date irrespective of F.O.R./F.O.T. condition mentioned elsewhere in the contract/tender. (ii) The bidder confirms that rates and other financial terms quoted in relevant columns of financial bid will only be ruling terms for acceptance, and such terms i) In case of road delivery, the date of delivery at destination (Consignees end) shall only be treated as delivery date quoted anywhere else should be ignored. (iii) (a) Regarding MSE purchase preference firms, please refer clause 15.0 part B of Southern Railway tender conditions available under the link Public Documents->Stores/Supply. (b) Goods and service Tax: Please refer part A Para 14.0 of Southern Railway tender conditions available under the link Public Document -> Stores/Supply. (c) Preference to make in India Please refer part B Para 16.0 of Southern Railway tender conditions available under the link Public Document -> Stores/Supply. (d) Tenderers are advised to refer instructions to tenders (Part A) and Tender conditions (Part B) for other terms and conditions available under the link Public Document -> Stores/Supply. (iv) Procurement of the item is restricted to Class-I Local suppliers with minimum local content of 50% (Class-I Local supplier as defined in Railway Board letter no: No.2020/RS(G)/779/2/Pt.1 dated 25.09.2020) only and the vendors who do not qualify to be "Class-I Local suppliers" (i.e., "Non-Local suppliers" or "Class-II Local suppliers" with local content less than 50%) should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a "Class-I Local supplier" for the tendered item participates in the tender, it does so at it's own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor.    Tenderers shall provide a certificate from the Statutory Auditor or Cost Auditor of the Company or from a practicing Cost Accountant/Chartered Account giving the percentage of local content. The tenderer shall refer Para.16.1 of Part.B of Southern Railway Tender Conditions.

   Tenderers shall confirm the following declaration failing which the offer is likely to be ignored. " I have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India.I certify that this bidder is not from such a country or,if from such a country,has been registered with the Competent Authority.I hereby certify that this bidder fulfills all requirements in this regard and is eligible to be considered.Where applicable,evidence of valid registration by the Competent Authority shall be attached."

   (i) Offer validity should be minimum 90 days. (ii) Firms with MSME/NSIC Certificate for subject item are requested to submit the same for eligibility towards purchase preference. (iii) Tenderer should mention GST No of their firm and also HSN Code of this item is 8607.

I/We hereby certify that no other sister concerns or affiliates (such as having common partner/director/promoter/owner/holding company decision control etc.) have participated in this tender which can give rise to a conflict of interest or fall under anti-competitive practices. We understand that the offers of all such sister concerns including ours are liable to be rejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti competitive practices [Para 2502(c)] and obligation to proactive disclosures [Para 2503]. I/We understand that we are fully responsible for the above declaration and it shall not be the Railway's responsibility to verify the same.
