The tender rate will be for F.O.R. destination and inclusive of all incidental charges, enroute & at destination. Nothing extra shall be paid separately. 3. WWC@1% will be deducted from the each bill of the agency. 4. The rate should be inclusive carriage, fitting and allied parts complete in all respect with left over items (if any) as per site requirement. 5. Goods which to be used / supplied should be as per sample and conforming to the site condition & also conforming to I.S. Specification. 6. Department will not be responsible for non submission of BOQ / Bid Document online by due date, due to any fault of internet/ E-tendering. 7. Third Party Testing by T.P.I.A. will be carried out in the presence of departmental representative at the manufacturer premises and cost of the same will be borne by the successful agency. 8. The warranty of the work shall be as per Service Level agreement from the date of commissioning. 9. Time period for completion of work 5 Months from the issue date of order to proceed with the work. 10. Payment schedule, as per bidding documents & 70% payment be made as per pro-rata basis. 11. Payment shall be made on finished goods and not on casting only. 12. The material will be supplied as per drawing and newly approved technical specifications laid down in tender documents & subsequent submission by bidder in this regard. 13. Successful agency will submit drawing of the work within week period from the date of approval of rate by competent authority. 14. Authorization from OEM (Pump, Motor & Panels) be attached if tenderer is not a manufacturer. 15. Each page of bid book will be signed by the tenderer as a token of acceptance of terms and conditions. 16. Bidders may visit to the sites before quoting the tender rates. 17. Panels be manufactured by original manufacturer either by approved brands themselves or their authorized original equipment manufacturers under their brand name. The inspection is also allowed at their channels partner’s work with the condition that all drawings / test certificates shall be from the original equipment manufacturer. System house of approved brand are not acceptable and rating IP 54 and authorization from OEM be attached if tenderer is not manufacturer. 18. Bidders should have executed similar nature work in any Center Government / State Government/ Public Sector Undertaking / Central Autonomous Body for minimum value equivalent to 50 % of quoted value in last 3 years alongwith existing criteria as per bid i.e. bidder should have completed at least 25% of quantity of similar nature work. 19. ln case, the material offered for inspection by the firm fails to meet the specifications stipulated in NIT/order/Contract and the samples are rejected by the Inspecting Committee, the Department will have the right to levy a penalty at 0.1% of the total value of that particular item. 20. Bidders who will be rejected during technical scrutiny, will submit their representation within 5 days from issue of minutes of TSC. 21. The bidders must create their contractor ID on HEW Portal (https://works.haryana.gov.in ) and accordingly upload the contractor profile summary in bidding documents. 22. Affidavit on Non Judicial Stamp Paper of Rs. 100/- duly certified by the Notary stating that the firm (name of the firm) has not been blacklisted/ debarred either in Government Departments/ Agencies in state of Haryana or Central Government Departments/ Agencies etc. as on the date of submission of the bid in the present tender. 23. Bidders should have average annual financial turnover of atleast 30% of estimated amount during the last 03 financial years, ending 31st March of previous financial year. This should be duly audited by Chartered Accountant. 24. Concession is given to Haryana based MSME’s, KVIU, Central or HPSE (as declared by industries Department Haryana) as in tender fee, EMD, Past Experience and eligibility criteria for turnover. Though they have to complete the job as per tender with warranty of 5 years or 12500 Hours which ever is earlier as per service level agreement. Only those MSME, KVIU, Central or HPSE(as declared by industries Department Haryana) will be eligible for this tender, those are authorized dealer or manufacturer of approved make of IWRD. 25. Notwithstanding anything contained in the Tender, Department has the right to accept or reject any Bid, and to cancel the bid process and reject the Tender, at any time, without thereby incurring any liability to the affected Bidder or Bidders and without any obligation to inform the participating/affected Bidder (s) the reason for such decision. 26. The Bid i.e. Technical Bid as well as Financial Bid is to be submitted online on web portal https://etenders.gov.in. The Technical Bids uploaded on the portal should have proper indexing and page numbering on all the documents forming the Technical bid. Any supporting documents if required is to be submitted in online mode only along with their Technical Bids by due date and time. All care should be taken by the bidders to submit correct information and documents in first place. No cognizance of the documents submitted subsequently by the bidders on his own regarding his technical bid shall be taken. However, clarification can be sought upto the extent of clearing any doubt on the documents already submitted online. 27. Dispute Redressal system 26.1 If any dispute or difference of any kind what-so-ever shall arise in connection with or arising out of this contract or the execution of work or Defect Liability cum-Maintenance period of the works there under, whether before its commencement or during the progress of works or after the termination, abandonment or breach of the contract, it shall, in the first instance, be referred for settlement to the competent authority, described along-with their powers in the contract data above the rank of the Engineer.
