Railway reserves the right to procure the material from having satisfactory fast performance for same or similar items. The tenders must upload documents pertaining to their credential/past performance in Zonal Railway/PUs/PSUs/Other Govt. Organization. Tenderers are instructed to upload Receipt Note, Receipted Challan, Inspection Certificate or any other receipt document along with bid as a proof of supply document failing which their offer will not be considered. No back reference shall be made in this regard and Railway decision will be final.

100 percent payment through RTGS against supply, installation & TPI inspection certificate and acceptance of materials by the consignee duly countersigned by the Gazetted officer of the consignee/indenter on the receipted challan subject to submission of Performance Bank Guarantee [PBG] for an amount of 5% of contract value towards warranty obligation in favour of PFA, South Eastern Railway, garden Reach, Kolkata-43 and PBG validity should be warranty period plus 6 months as back-up of warranty along with the bill else Railway reserve the right to deduct equal amount from firm's bill and will keep it towards warranty obligation upto warranty period plus 6 months as back-up of warranty for which Railway will not pay any interest. Mandate form to be submitted indicating Bank A/c number, IFS, MICR code etc.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

General Conditions of Contract: The contract shall be governed by latest version (along with all correction slips) of General Conditions of Contract, and all other terms and conditions incorporated in the tender documents.
IRS terms and condition with latest amendment/correction slip and SER instruction to tenderers & General conditions of tender are applicable.
