The tenderer must have minimum average annual contractual turnoverof V/N or 'V' whichever is less, where V= Advertised value of the tenderin crores of Rupees N= Number of years prescribed for completion ofwork for which bids have been invited. The average annual contractualturnover shall be calculated as an average of "total contractualpayments" in the previous three financial years, as per the auditedbalance sheet. However, in case balance sheet of the previous year isyet to be prepared/ audited, the audited balance sheet of the fourthprevious year shall be considered for calculating average annualcontractual turnover. The tenderers shall submit requisite information asper Annexure-I, along with copies of Audited Balance Sheets dulycertified by the Chartered Accountant/ Certificate from CharteredAccountant duly supported by Audited Balance Sheet.
(a)The tenderer must have successfully completed or substantially completed any of the following (by any Government organizations) during last 07 (seven) years, ending last day of month previous to the one in which tender is invited:Three similar works each costing not less than the amount equal to 30% of advertised value of the tender, orTwo similar works each costing not less than the amount equal to 40% of advertised value of the tender, orOne similar work each costing not less than the amount equal to 60% of advertised value of the tender.(b)(i)In case of tenders for composite works (e.g. works involving more than one distinct component, such as Civil Engineering works, S&T works, Electrical works, OHE works etc. and in the case of major bridges - substructure, superstructure etc.), tenderer must have successfully completed or substantially completed any of the following during last 07 (seven) years, ending last day of month previous to the one in which tender is invitedThree similar works each costing not less than the amount equal to 30% of advertised value of each component of tender, orTwo similar works each costing not less than the amount equal to 40% of advertised value of each component of tender, orOne similar work each costing not less than the amount equal to 60% of advertised value of each component of tender.Note for (b)(i): Separate completed works of minimum required values shall also be considered for fulfilment of technical eligibility criteria for different components.(b) (ii) In such cases, what constitutes a component in a composite work shall be clearly pre- defined with estimated tender cost of it, as part of the tender documents without any ambiguity. Any work or set of works shall be considered to be a separate component, only when cost of the component is more than 2 crore each. (b)(iii) To evaluate the technical eligibility of tenderer, only components of work as stipulated in tender documents for evaluation of technical eligibility, shall be considered. The scope of work covered in other remaining components shall be either executed by tenderer himself if he has work experience as mentioned in clause 2.3.3(a) (ii) of the Tender Document or through subcontractor fulfilling the requirements as per clause 2.3.3 of the Tender Document or jointly i.e., partly himself and remaining through subcontractor, with prior approval of Chief Engineer in writing.
Similar nature of work - Civil Engineering works involving construction of Railway/Road bridge of clear span of 12.2 m or more. The bridge work should include both sub-structure and super structure components.

In short, he/theyshould familiarize himself/themselves fully with the conditionsobtaining at site and FURNISH A CERTIFICATE TO THIS EFFECT,in the Proforma appended as Annexure-C of Tender Document.
Tenderers are compulsorily required to fill up/submit requisitedetails in prescribed Performa of Annexure C to G,I,J andAnnexure-L as per tender document without which the offer maybe considered as incomplete and be liable to be rejected.
The tenderer's may note that the Railway reserves its right toeither accept or reject any Bid/s without assigning any reasonswhatsoever and tenderer s shall have no claim s on thisaccount.
The time, date and venue of opening of Financial Bids shall benotified to the successful tenderer s after evaluation of Technicalcum Commercial Bids. The same shall be opened on due date inthe presence of tenderers / their representatives as may wish toattend the same
As per Income Tax Act, Tax will be deducted for sums paid forcarrying out the work under this contract. In case of supplycontract for ballast, deduction of 2% (Two percent) Income taxwill be made for the sums paid for labour portion only (i.e.,loading, unloading, stacking, measurement and laying etc.). 1%labour cess shall be deducted from each RA bill to be depositedwith concerned labour Commissioner/State Govt.
TAXES
The contractor shall be governed by the Taxes applicable at theplace of actual execution of work as per clause 23.0 of SpecialTender Conditions and instruction to tenderers
The tenderers shall quote the rates of one single % age"Above/Below/At par" on the total amount comprising basicvalue of entire Schedule of Chapters of USSOR-2021/DSR- 2021plus escalation as per Schedule A, one single % age"Above/Below/At par" on the total amount comprising basicvalue of entire Schedule of Chapters of DSR-2021 plusescalation as per Schedule B, and one single %age "Above /Below / At par" over entire schedule of Non schedule Items asper Schedule C, in the Bill(s) of quantities. (Packet-II, FinancialBid). Every possible fluctuation, in the rate of labour, materialand general commodities, and other possibilities of each andevery kind which may affect the rates, should be considered andkept in view before quoting the rates and no claim on thisaccount shall be entertained by the Railway under anycircumstances except the price escalation payable as per pricevariation clause, if any, provided separately in the tenderdocuments.
Only Technical cum Commercial bid will be opened first.Thereafter all Technical cum Commercial offers will be evaluatedfor eligibility on the basis of the documents submitted by thetenderers regarding constitution of firm, technical and financialeligibility. The shortlisted firms will thereafter be informed of thedate, time and venue of the opening of their Financial bids.Financial bids of these shortlisted tenderers will be opened asscheduled and evaluated accordingly.
If on verification of credentials, at the evaluation stage, it isfound that the tenderer has submitted forged/fake documents insupport of his offer, his Bid Security shall be forfeited besidesbanning of business for a period of upto two year.
IF THE TENDERER S DELIBERATELY GIVES WRONGINFORMATION/ CREDENTIALS/DOCUMENTS IN HIS/THEIRTENDERS AND THEREBY CREATE S CIRCUMSTANCES FORACCEPTANCE OF HIS/THEIR TENDER, RAILWAY RESERVES THERIGHT TO TERMINATE THE CONTRACT AT ANY STAGE, BESIDES,BANNING OF BUSINESS FOR A PERIOD OF UPTO TWO YEAR.
The contractors operations and proceedings in connection withthe works shall at all times be conducted during the continuanceof contract in accordance with the laws, ordinance, rules andregulations for the time being in force and t h e contractor s h all further observe a n d comply with t h e bye- laws andregulations of the Govt. of India, State Govt. and of Municipalother authorities having jurisdiction in connection with the worksor site over operations such as these are carried out by thecontractor/s and shall give all notice required by such bye-lawsand regulations. The Hospital and medical regulations in forcefor the time being shall also be complied with by thecontractor/s and his workmen.
The contractor shall be responsible for the observance of therules and regulations under the mines act and mineral rules andIndian Metallurgical rules and regulations of State/Central Govt.concerned as amended from time to time.
Contractor shall at all times keep the railway administrationindemnified against all penalties that may be imposed by theGovt. of India or State Govt. for infringements or any of theclauses of the mines act and rules made there under in respectof quarries from which the ballast for these works is procured.
Care for submission of offer
Before submitting a tender, the tenderer will be deemed to havesatisfied himself by actual inspection of the site and locality ofthe works, that all conditions liable to be encountered during theexecution of the works are taken into account and that the rateshe enters in the tender forms are adequate and all inclusive toaccord with the provisions in Clause-37 of the Standard GeneralConditions of Contract for the completion of works to the entiresatisfaction of the Engineer.
Tenderers will examine the various provisions of The CentralGoods and Services Tax Act, 2017(CGST)/Integrated Goods andServices Tax Act, 2017(IGST)/Union Territory Goods and ServicesTax Act, 2017(UTGST)/ respective state's State Goods andServices Tax Act (SGST) also, as notified by Central/State Govt &as amended from time to time and applicable taxes beforebidding. Tenderer's will ensure that full benefit of Input TaxCredit (ITC) likely to be availed by them is duly considered whilequoting rates.
The successful tenderer who is liable to be registered underCGST/IGST/UTGST/SGST Act shall submit GSTIN along with otherdetails required under CGST/IGST/UTGST/SGST Act to railwayimmediately after the award of contract, without which nopayment shall be released to the contractor. The contractor shallbe responsible for deposition of applicable GST to the concernedauthority.
In case the successful tenderer is not liable to be registeredunder CGST/IGST/UTGST/SGST Act, the railway shall deduct theapplicable GST from his/their bills under reverse chargemechanism (RCM) and deposit the same to the concernedauthority.
