Special Eligibility Criteria

   Tenderers whose names are appearing in the latest List of Approved Vendors and Vendors for Developmental Orders published by RDSO for manufacture of- Elastic Rail Clips, Item ID:3100558 - are considered eligible in this tender. The status of the firm shall be reckoned as on the date of tender opening and not thereafter unless there is a case of downgrading/removal /suspension/banning.

   Bidders must fulfill the "Conditions for responsiveness of offer" mentioned in the tender document, failing which, their offer will be summarily rejected.

   Eligibility Criteria for Developmental order : The developmental order will be placed on firm qualified for the developmental order having prototype approval for the tendered item as on Tender closing date .The developmental vendor not having prototype approval for the tendered item as on Tender closing date will only be eligible for the limited quantity of developmental order not exceeding the 5% of the Net Procurable Quantity (NPQ). The total Developmental order quantity will not be more than 20% of the net procurable quantity. The status of the firm shall be reckoned as on the date of tender opening and not thereafter unless there is a case of downgrading/removal/suspension /banning.

   In terms of Railway Board letter No. 2015/RS(G)/779/5 (Vol.III) dt. 15-09- 2020, keeping in view with the Public Procurement (Preference to Make in India) Order 2017 as amended, it has been found that there is sufficient local capacity and competition in supply of the tendered item of required quantity and therefore public procurement of the item is restricted to Class I Local suppliers only and the vendors who do not qualify to be Class I Local supplier should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor, who does not qualify to be a Class I local supplier for the tendered item, participates in the tender, it does so as it s own risk and cost and Railway shall not be liable for any loss or damage caused to the vendor.

   CA CERTIFICATE /SELF LOCAL CONTENT CERTIFICATE : In cases of procurement for a value in excess of Rs.10 crores, the Class-I local supplier/ Class II Local supplier shall be required to provide certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing Costaccountant or practicing chartered accountant (in respect of suppliers other than companies) giving the percentage of Local content. The certificate should have valid UDIN mentioned in certificate. In case of non submission of CA certificate having valid UDIN No. , the offer will be summarily rejected.

   Have you gone through the Clause No 6.0 for deposit of Earnest Money as indicated in Instructions to Tenderers and 13.0 for Security Deposit (SD) as indicated in General Conditions of Tender in ECoR Tender conditions uploaded in IREPS website as well as attached with this tender.

   Bid securing declaration to be signed and submitted by bidders (along with bid) availing exemption from submission of EMD as per Annexure-VI of ECoR Tender Document attached.

   The bidder should go through the Tender Documents consisting of Instructions to Tenderers, General Tender Conditions and agree & confirm to abide by the Instructions to tenders, General Tender Conditions, IRS conditions of Contract .

Commercial-Compliance

   Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

   Validity of Offer: No deviation from the offer validity period stipulated in the tender is permitted.

   Code of Integrity Declaration : I/We have carefully gone through the IRS conditions of contract (included and uploaded along with the bid document) particularly Para 2500 pertaining to "Code of Integrity, Misdemeanor and Penalties". I/We hereby certify that no other concerns or affiliates (such as having common partner/director/promoter/owner/holding company /management control etc.) have participated in this tender which give rise to a conflict of interest or fall under anti-competitive practices. We understand that the offers of all such related concerns including ours are liable to be rejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti competitive practices [Para 2502(c)] and obligation to proactive disclosures [Para 2503]. I/We understand that we are fully responsible for the above declaration and it shall not be the Railway's responsibility to verify the same. I/We are aware that we shall be liable for all consequences of violation of Code of Integrity, if detected at any stage.

   Price Variation Clause: No deviation from the Price Variation Clause stipulated in the tender is permitted. Offers with any other PVC or without PVC will not be considered as per ECoR tender document of general conditions of contract para 1.3
