Miscellaneous P.Way Works under SSE (P.Way) DEHR MILITARY SIDING (IRUSSOR- 2021)

Financial Eligibility Criteria: The tenderer must haveminimumaverageannual contractual turnover of V/N or 'V' whichever isless; whereV=Advertised value of the tender in crores of Rupees N=Number ofyearsprescribed for completion of work for which bids havebeen invited.Theaverage annual contractual turnover shall be calculatedas anaverage of"total contractual payments" in the previous threefinancialyears, as perthe audited balance sheet. However, in casebalance sheetof theprevious year is yet to be prepared/ audited, theaudited balancesheetof the fourth previous year shall be considered forcalculatingaverageannual contractual turnover

The tenderers shall submit requisite information as perAnnexureVIB, along with copies of Audited Balance Sheets duly certifiedby the Chartered Accountant/ Certificate from CharteredAccountantdulysupported by Audited Balance Sheet

In case of newly formed partnership firm, the credentialsofindividualpartners from previous propriety firm(s) ordissolvedpreviouspartnership firm(s) or split previous partnership firm(s),shallbeconsidered only to the extent of their share in previous entity onthedateof dissolution / split and their share in newly formedpartnershipfirm. Forexample, a partner A had 30% share in previousentity and hisshare inpresent partnership firm is 20%. In the presenttenderunderconsideration, the credentials of partner A will be consideredtotheextent of 0.3*0.2*value of the work done in the previous entity.Forthispurpose, the tenderer shall submit along with his bid alltherelevantdocuments which include copy of previouspartnershipdeed(s),dissolution deed(s) and proof of surrender of PAN No.(s) in caseofdissolution of partnership firm(s) etc.

In case of existing partnership firm, if any one or more partnersquitthepartnership firm, the credentials of remaining partnership firmshallbere-worked out i.e., the quitting partner(s) shall take awayhiscredentialsto the extent of his share on the date of quittingthepartnership firm(e.g.in a partnership firm of partners A, B & 1.2.1 Chavingshare 30%, 30% & 40%respectively and credentials of Rs 10crore; incase partner C quits thefirm, the credentials of this partnershipfirm shallremain as Rs 6 crore).For this purpose, the tenderer shallsubmit alongwith his bid all therelevant documents which include copy ofpreviouspartnership deed(s),dissolution deed(s) and proof of surrenderof PANNo.(s) in case ofdissolution of partnership firm(s) etc

In case of existing partnership firm if any new partner(s) joinsthefirmwithout any modification in the name and PAN/TAN no. of thefirm,thecredentials of partnership firm shall get enhanced to theextentofcredentials of newly added partner(s) on the 1.2.2 sameprinciplesasmentioned in item 6 above. For this purpose, the tenderershallsubmitalong with his bid all the relevant documents which includecopyofprevious partnership deeds, dissolution/splitting deeds andproofofsurrender of PAN No.(s) in case of dissolution of partnership firmetc

Technical Eligibility Criteria: (a)The tenderer musthavesuccessfullycompleted or substantially completed any one ofthefollowing categoriesof work(s) during last 07 (seven) years, endinglastday of monthprevious to the one in which tender is invited: (i)Threesimilar works eachcosting not less than the amount equal to 30%ofadvertised value of thetender, or (ii)Two similar works each costingnotless than the amountequal to 40% of advertised value of the tender,or(iii)One similar workcosting not less than the amount equal to 60%ofadvertised value of thetender (b) (1)In case of tenders forcompositeworks(e.g. works involvingmore than one distinct component,such asCivil Engineering works, S&Tworks, Electrical works, OHE worksetc. andin the case of major bridgessubstructure, superstructure etc.),tenderermust have successfullycompleted or substantially completedany one ofthe following categoriesof work(s) during last 07 (seven)years, endinglast day of monthprevious to the one in which tender isinvited: (i)Threesimilar works eachcosting not less than the amount equalto 30% ofadvertised value ofeach component of tender, or (ii)Two similarworkseach costing not lessthan the amount equal to 40% of advertisedvalueof each component oftender, or (iii)One similar work each costingnotless than the amountequal to 60% of advertised value ofeachcomponent of tender. Note forb(1): Separate completed worksofminimum required values shall alsobe considered for fulfillmentoftechnical eligibility criteria for differentcomponents. (b)(2)In suchcases,what constitutes a component in acomposite work shall be clearlypredefined with estimated tender cost ofit, as part of the tenderdocumentswithout any ambiguity. (b) (3) Toevaluate the technicaleligibility oftenderer, only components of work asstipulated in tenderdocuments forevaluation of technical eligibility, shallbe considered. Thescope of workcovered in other remainingcomponents shall be eitherexecuted bytenderer himself if he has workexperience as mentioned inclause 7 ofthe Standard General Conditionsof Contractor throughsubcontractorfulfilling the requirements as perclause 7 of the StandardGeneralConditions of Contract or jointly i.e.,partly himself and remainingthroughsubcontractor, with prior approvalof Chief Engineer in writing.However,if required in tender documents byway of Special Conditions, aformalagreement duly notarised, legallyenforceable in the court of law,shall beexecuted by the main contractorwith the subcontractor forthecomponent(s) of work proposed to beexecuted by thesubcontractor(s),and shall be submitted along with theoffer forconsidering subletting ofthat scope of work towards fulfilmentof technicaleligibility. Suchsubcontractor must fulfill technical eligibilitycriteria asfollows: Thesubcontractor shall have successfully completedat least onework similarto work proposed for subcontract, costing notless than 35%value ofwork to be subletted, in last 5 years, ending lastday of monthprevious tothe one in which tender is invited through aworks contract.Note: forsubletting of work costing up to Rs 50 lakh, noprevious workexperienceof subcontractor shall be asked for by theRailway

Work experience certificate from private individual shallnotbeconsidered. However, in addition to work experiencecertificatesissuedby any Govt. Organisation, work experience certificateissued byPubliclisted company having average annual turnover of Rs 500croreandabove in last 3 financial years excluding the current financialyear,listedon National Stock Exchange or BombayStockExchange,incorporated/registered at least 5 years prior to the dateofclosing oftender, shall also be considered provided the workexperiencecertificatehas been issued by a person authorized by thePublic listedcompany toissue such certificates. In case tenderer submitsworkexperiencecertificate issued by public listed company, the tenderershallalso submitalong with work experience certificate, the relevant copyofwork order,bill of quantities, bill wise details of payment receiveddulycertified byChartered Accountant, TDS certificates for allpaymentsreceived andcopy of final/last bill paid by company in supportof aboveworkexperience certificate.

Para 1.2 & its sub para of standard financial criteria arealsoapplicableduring evaluation of technical credential of partnershipfirm.

Defination of Similar Work :- Similar work means any track worksbymanually or mechanical means involving deep screening or TSR orTRRor Casual renewals or TWR or Turn outs or dismantling of tracks etc

Tenderers should show discount in the rate scheduleonly,insteadof anywhere else in the offer. Discounts not shownatdesignatedplace will be summarily ignored for assigninginterse ranking ofoffers. Conditional discount will not beconsideredfor adjudgingthe inter-se position i.e. rate quotedwithout anyconditionsattached (viz. Discount/ Rebates havinglinkages toquantity,rates payment etc.) will only be consideredforevaluationpurpose. In other words, discounted rates linkedtoquantities,rates, prompt payment etc. will be ignoredfordetermining interse position. Railway, however reservestheright to use thediscounted rate/ rates considered workableandappropriate, forcounter offer to the successful tenderers

Tenderers will examine the various provisions ofTheCentralGoods and Services Tax Act,2017(CGST)/IntegratedGoods andServices Tax Act, 2017 (IGST)/ UnionTerritory GoodsandServices Tax Act, 2017(UTGST)/ respectivestate's StateGoodsand Services Tax Act (SGST) also, as notifiedbyCentral/StateGovt.& as amended from time to timeandapplicable taxesbefore bidding. Tenderers will ensure thatfullbenefit of InputTax Credit (ITC) likely to be availed by themisduly consideredwhile quoting rates.The successful tendererwhois liable to beregistered under CGST/IGST/UTGST/SGST Actshallsubmit GSTINalong with other details requiredunderCGST/IGST/UTGST/SGSTAct to railway immediately aftertheaward of contract, withoutwhich no payment shall bereleased tothe Contractor. TheContractor shall be responsible fordepositionof applicable GSTto the concerned authority. In casethesuccessful tenderer isnot liable to be registeredunderCGST/IGST/UTGST/ SGST Act,the railway shall deducttheapplicable GST from his/their billsunder reversechargemechanism (RCM) and deposit the sameto theconcernedauthority. Contractor shall be liable topay/refund theamountcollected as GST to the Indian Railwaysalong withinterest andpenalties, if any imposed by theauthorities, in caseGST inputtax credit of Indian Railways isdenied/rejected by thetaxauthorities due to reasons mentionedbelow but not limitedto: Wrong/incorrect invoices issued byContractor ; No- filing ofGSTreturns; Non payment of GSTcollected from Indian Railwaystothe authorities; Any other noncompliance done byContractor;Retention Money: Any paymentliable to be paid byIndianRailways to contractor against thegoods or services orbothsupplied by such contractor to IndianRailways shall be keptonhold in case supplier makes any noncompliance of any oftheGST law provisions including nonreporting of invoices inGSTreturns. Such payment shall bereleased after properverificationof records and availability ofITC to Indian Railways asperprovisions of GST Law. GeneralIndemnity: Contractorherebyagrees to indemnify and holdharmless the IndianRailways fromand against any and alllosses, including loss onaccount of InputTax Credit and alllosses incurred by the IndianRailways relatingto or arising outof or in connection with anyactual or threatenedclaim, legalaction, proceedings, prosecutionor inquiry by oragainst theIndian Railways arising out, directly orindirectly,offailure by thecontractor to comply with theprovisions of GSTand relatedlaws, or based upon or arising fromany failure bythe Contractor{After award of LOA it should beindemnifyotherwise action maybe taken by competent authorityand willbe binding uponcontractor).(ACS-6 dtd 21.12.2023). The Bid Security shall be deposited either in cashthroughepayment gateway or submitted as Bank Guaranteebond fromascheduled commercial bank of India or as mentionedintenderdocuments. The Bank Guarantee bond shall be asperAnnexureVIA and shall be valid for a period of 90daysbeyondthe bidvalidity period. In case, submission of Bid Securityin theform ofBank Guarantee, following shall be ensured: (i).Ascannedcopyof the Bank Guarantee shall be uploaded oneProcurementPortal (IREPS) while applying to the tender.(ii).Theoriginal BankGuarantee should be delivered to ChiefOfficeSuperintendentRate before closing date for submission ofbidsi.e., excludingthe last date of submission of bids. (ACS-5dtd20.10.02023).(iii)Non submission of scanned copy ofBankGuarantee with thebid on etendering portal (IREPS) and/ornonsubmission oforiginal Bank Guarantee within the specifiedperiodshall lead tosummary rejection of bid. (iv) The TenderSecurityshall remainvalid for a period of 90 days beyond thevalidityperiod for theTender. (v) The details of the BG,physicallysubmitted shouldmatch with the details available inthe scannedcopy and thedata entered during bid submissiontime, failingwhich the bidwill be rejected (vi).The BankGuarantee shall beplaced in anenvelope, which shall be sealed.The envelope shallclearly bearthe identification "Bid for the *****Project" and shallclearlyindicate the name and address of theBidder. In addition,the BidDue Date should be indicated on theright hand topcorner of theenvelope. (vii)The envelope shall beaddressed tothe officer andaddress as mentioned in the tenderdocument.(viii).If theenvelope is not sealed and marked asinstructedabove, theRailway assumes no responsibility forthemisplacement orpremature opening of the contents of theBidsubmitted andconsequent losses, if any, suffered by theBidder

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

Tenderers are abiding by the General Conditions of Contract(GCC) April 2022 corrected upto ACS 11 & any statutorymodification thereof and also abide to carry out the workaccordingly.

Documentary proof - Tenderer should submit scanned copydocumentary proof in regard for fulfilling the Technical /financialeligibility criteria along-with their offer (for details refer attacheddocuments). If the tenderers do not submit any proof of meetingwith the eligibility criteria as laid down in the tender conditions,the offer shall be considered as incomplete and shall besummarily rejected. Documents submitted in support ofeligibility criteria after opening of tender will not be considered.

In terms of HQ's letter No. W.187.R.GCC dated 24.05.2019, "Ifany contract is terminated under clause 62 of GCC oncontractor's fault, then that contractor shall be temporarilydebarred from participation in any tender in that division forONE YEAR, If so decided by the Tender Accepting Authority. Incase creation of unsafe working due to infringement/entanglement of P.Way materials ( Rails, Sleeper, tec.) or/andtool & plants, deployed at worksites with running trains, apenalty of Rs. 1,00,000/- (Rs. One Lakh) shall be imposed perincident. In case of repeated such incidence, contract is liablefor termination as per contract conditions. (HQ's Lt. No. W.636.T.FBWP/Tender/2017 dtd. 12.10.2021). Further,Excavation and Earthwork in Railway Premises: While carryingout the excavation in the yard for executing any work allprecautions should be taken to avoid damages to cables pipelines etc and the damage cost will be borne by agency. In orderto avoid damage to the Signaling, Tele communication andElectrical cables, Telecom Circular No.17/2013 -"Procedure forundertaking digging work in the vicinity of signaling, electricaland telecommunication cables" issued vide letter no.2003/Tele/RCIL/1 Pt.IX dated 24.06.2013 has to be followed. 9."No Land belonging to or in the possession of the Railway shall beoccupied by the contractor without the permission of theRailway. The contractor shall not use or allow to be used the sitefor any purpose other than that of executing the works. Whenever non-railway bodies/persons are permitted to userailway premises with competent authority's approval,conservancy charges as applicable from time to time may belevied." As per the recommendations by the 47th GST CouncilMeetinginrelation to changes in Tax rates, circulated byRailwayBoardvide L.No.2017/ACII/1/6/GST/Main/Vol.-III, dated 05-07-2022, theGST rates on Railway works contract has beenrevisedfromexisting 12% to 18%. The clarification mentioned intheRailwayBoard's letter is attached in tenderdocument.Therefore,Bidders are requested to quote their ratesincluding18% GST.'

Spl Eligibility Condition, Scope of Work,Specialconditionsattached to GCC

Tenderers are requested to go through the SpecialConditions for Letter of Credit.

The tender Document of the subjected work is inconformity with Indian Railways Standard General Conditions ofContract - April2022 with latest correction slip No 1 of dated14.07.2022, the perspective Tenderers are requested to gothrough the Tender Document before offering their offers

Annexure-V(A) shall be submitted by each memberof a partnership Firm/Joint Venture (JV)/HinduUndivided Family (HUF)/ Limited Liability Partnership (LLP) etc, asthe case may be. Non submission of the certificate/Affidavit, orsubmission of certificate/Affidavit either not properly filled in, orin a form at other than the prescribed format shall leadto summarily rejection of your offer

Applicability of Price Variation Clause (PVC)depends on fulfillment of condition of Para 46.A1 of IndianRailways Standard General Conditions of Contract April 2022-partII corrected up to ACS 1.
