   Railway reserves the right to procure full/bulk quantity from PAC [Proprietary Article Certificate] holder i.e. M/S KNORR BREMSE INDIA PVT LTD-PALWAL, Address- 51/4 KM Stone, Village and P.O. Baghola Delhi Mathura Road NH-2, PALWAL, Haryana, India, 121102. However, other firms are eligible for developmental order and can quote along with their list of M&P, Manufacturing Capacity and Credentials of supplying same/equivalent item(s), thereby, establishing the ability to develop present item under tender. The suitability of that offer for developmental order will be based on submitted documents in the offer.

   Any bidder from a country which shares a land border with India will be eligible to bid in any procurement whether of goods, services (including consultancy services and non-consultancy services) or works (including turnkey projects) only if the bidder is registered with the Competent Authority. Further, any bidder (including bidder from India) having specified Transfer of Technology (TOT) arrangement with an entity from a country which shares a land border with India, shall also require to be registered with the same competent authority.

   Code of integrity Declaration: I/We have carefully gone through the IRS conditions of contract (included anduploaded along with the bid document) particularly para 2500 pertaining to "Code of Integrity, Misdemeanor and Penalties". I/We hereby certify that no other concerns or affiliates (such as having common partner/ director/promoter/owner/holding company/ management control etc.) have participated in this tender which give rise to a conflict of interest or fall under anti- competitive practices. We understand that the offers of all such related concerns including ours are liable to be rejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of integrity in general, with specific reference to conflict of interest (Para 2502 (e)), anti competitive practices (Para 2502(c)) and obligation to proactive 164disclosures (para 2503).    Tenderer must keep validity of their offer open for a minimum period as mentioned in bid document. Offers with validity period of shorter duration shall be taken as unresponsive to Railways requirements and will be summarily rejected.
