7 LIQUIDATED DAMAGES FOR DELAY IN DELIVERY (3.47) @1% of Contract Price per week for the period of delay subject to maximum of 10 % of Contract Price and other conditions.
8 PLACE OF MANUFACTURING, INSPECTION AND TESTING (3.17) One month Notice in writing of the Date & Place at which the Equipment will be ready for Testing.
9 TERMS OF PAYMENT (5.18) As per clause No. 5.18 of volume-1
10 SECURITY DEPOSIT / PERFORMANCE GUARANTEE (2.44) 10 % of the Contract Price, in the Form of Cash / Bank Guarantee / Demand Draft within one month of the issue of Award. Penalty would be charged as per clause in case of late submission of B.G.
11 WARRANTY (2.46) 24 Calendar Months from the date of actual taking over date or Thirty six (36) months after its commissioning which ever expires earlier.
12 Input Tax Credit BENEFIT The Benefit of ITC FOR SELF MANUFACTURED ITEMS , if any, on the present Prices i.e. Base Rate of Material to be passed on to the HPSEBL.
13 TYPE TESTS The Equipment shall be Type Tested in line with IS / IEC & Test Reports to be submitted.

JOINT VENTURE / INDIVIDUAL
2.7.1 TECHNICAL REQUIREMENT:
a) The Bidder must have successfully Designed, Erected, Tested and Commissioned in India on Supply – Cum – Erection Basis at least two Nos. 66 kV or higher Voltage class Sub Stations, under Turnkey Contract in India during last seven years, having at least three no. bays out of which at least one must be a transformer bay and one substation must be in successful operation for at least two years (Twenty Four months) as on the Date of Bid Opening.
b) The Bidder shall supply equipment as per this tender from any nationally / Inter nationally reputed manufacturer of Sub-station equipment, having adequate Plant and manufacturing capacity in India. The equipment manufacturer should have valid type test reports as per relevant standards, which shall not be older than 10 (Ten) Years as on opening date of Techno-Commercial Bid (Part -1).
c) The bidder must obtain authorization from the sub-station equipment manufacturer, meeting the above criteria, and shall submit with his offer.
d) All equipment offered for this package should have type tested as per IEC/relevant standards, not older than Ten years as on bid opening date.
e) To incorporate the Public Procurement Policy Clause (as per Make in India preferences) as under.
Public Procurement Policy (Preference To Make In India).
1 Government of India has notified that Public Procurement Policy (Preference to Make in India) should be a part of all public procurement tenders. Bidders are instructed to ensure that provisions made in Order no. P-45021/2/2017 (BE-II) dt. 15.06.2017 from Department of Industrial Policy & Promotion, Ministry of Commerce and Industry & order no. 11/05/2018-Coord, dated 20.12.2018 Ministry of Power, Government of India and latest revisions thereof are strictly adhered to.
2 In reference to para 1 above, bidders shall have to certify ‘Local Content’ as given hereunder:-
a) The local supplier / EPC contractor at the time of tender, bidding or solicitation shall be required to provide self-certification that the item / work offered meets the minimum local content and shall give details of the location(s) at which local value addition is made.
b) In case of procurement / work for a value in excess of Rs. 10 crore, the local supplier / EPC contractor shall be required to provide a certificate from the statutory auditor or cost auditor of the company (in case of companies) or from a practicing cost accountant or practicing chartered accountant (in case of suppliers other than companies) giving the percentage of local content.
2.7.2 FINANCIAL REQUIREMENT:
For the Purpose of this particular Bid, the Bidder shall meet the following Minimum Financial Criteria:
a) Average Annual Turn Over for the best Three Years out of last Five Years of the Bidder should be at least 30% of estimated cost.
b) Liquid Assets and / or evidence of access to or availability of Credit Facilities of not less than 10% of estimated cost.
c) The bid capacity calculations of bidders shall be submitted with the bid as per the following formula (Minimum equal to estimated cost):
Bid capacity, C= (2xA)-B
A= Maximum Turnover of one year out of last three years.
B= Value of left over existing commitments against various contracts which have already awarded to the firm. Relevant documents may also be submitted.
2.7.3 JOINT VENTURE FIRMS:
1) In case a Bid is submitted by a Joint Venture (JV), both the Partners of Joint Venture shall meet collectively the requirement of Para 2.7.2 above. The figure of Average Annual Turnover and Liquid Assets / Credits Facilities for each of the Partners of the Joint Venture shall be added together to determine the Joint Venture’s compliance with the minimum qualifying criteria set out in Para 2.7.2 above. However, for a Joint Venture to be qualified, the Partner of Joint Venture must also meet the following minimum criteria:-
a) The Lead Partner shall meet, not less than 50 % of the Minimum Criteria given in Para 2.7.2 and 100 % of criteria given in 2.7.1.(a) or 2.7.1.(b) above.
b) The other Partner shall meet, not less than 25 % of the Minimum Criteria given in Para 2.7.2 above.
2) In case of participation in Joint Venture, the following conditions shall also apply:
a) In case of successful Bid, the specified Form of Agreement shall be signed so as to be legally binding on both Partners.
b) One of the Partners shall be nominated as Lead Partner, and this authorization shall be evidenced by submitting a Power of attorney signed by legally authorized signatories of both the Partners.
c) The Lead Partner shall be authorized to incur liabilities and receive instructions for and on behalf of both Partners of the Joint Venture and the entire execution of the Contract, including Payment, shall be done exclusively with the Lead Partner as per Power conferred to him in the Power of Attorney.
d) Both Partners of the Joint Venture shall be liable jointly and severally for the execution of the Contract in accordance with the Contract Terms and a statement to this effect shall be included in the authorization mentioned under b) above as well as in the Bid Form and in the Contract Form (in case of a successful Bid).
e) Agreement entered in to by Joint Venture Partners shall be submitted with the Bid in original.
f) The Share of different Partners of the Joint Venture shall be clearly specified along with responsibility of each of the Partners in case of Award of Work. The share & responsibility, in respect of execution of work, of the partners shall be in conformity to their eligibility & qualification. However, the other partner(s) may associate with the eligible & qualified partner(s) for the execution of works.
2.7.4 The Bidders shall also furnish following Documents / Details with its Bid: -
i) A Certificate from Banker indicating various Funds based / Non Fund based Limits sanctioned to the Bidder and the extent of utilization as on date. Such Certificate should have been issued not earlier than THREE Months prior to the Date of Bid Opening.
ii) The complete Annual Reports together with Audited Statement of Accounts of the Company for Last Five Years of its own (separate) immediately preceding the Date of submission of Bid.
1. Any bidder from a country which shares a land border with India will be eligible to bid in any procurement whether of goods, services (including consultancy services and non-consultancy services) or works (including turn key projects) only if the bidder is registered with the Competent Authority as specified in the Office Memorandum No. 6/18/2019-PPD dated 23.07.2020 of Department of Expenditure, Ministry of Finance, Govt. of India, New Delhi.
2. In the event the Bidder is not able to furnish the information of its own (i.e. separate), being a Subsidiary Company and its accounts are being consolidated with its Group / Holding / Parent Company, the Bidder should submit the Audited Balance Sheets, Income Statements, other information pertaining to it only (not of its Group / Holding / Parent Company) duly certified by any of the Authority [(a) Statutory Auditor of the Bidder / (b) Company Secretary of the Bidder or (c) a certified Public Accountant] certifying that such information / documents are based on the audited accounts as the case may be.
3. Similarly, if the Bidder happens to be a Group / Holding / Parent Company, the Bidder should submit the above documents / information of its own (i.e. exclusive of its Subsidiaries) duly certified by any one of the Authority mentioned in above Note - 1 certifying that these information / documents are based on the Audited accounts, as the case may be.”
