Eligibility Criteria

Tenderers should not be associated, or have been associated in the past, directly or indirectly, with a firm or any of its affiliates which have been engaged by the Purchaser to provide consulting services for the preparation of the design, specifications, and other documents to be used for the procurement of the goods to be purchased under this Invitation of Tenders.

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

The bidder is required to ensure browser compatibility of the computer well in advance to the last date and time for receipt of tenders. The departments shall not be responsible for non-accessibility of e-Procurement portal due to internet connectivity issues and technical glitches at bidders end.

Company Profile to be submitted

Only reputed Manufacturers/Authorized Suppliers are eligible to submit the tenders.

The Quality and Quantity of Drugs shall be on par with requirement of WHO

Manufacturers/ Authorized Suppliers are required to enclose approved WHO Quality Assured Certificate.

As and when orders are placed by the University Medical Officer, the concerned Manufacturers / Authorized Suppliers shall ensure the supply or drugs within a period of two weeks, failing which University may procure the drugs from outside at their cost & risk

After the acceptance of tender and approval of rate, the same rate should be maintained throughout the year.

Tenders from Joint ventures are not acceptable.

The tenderer shall bear all costs associated with the preparation and submission of his tender, and the employer will in no case be responsible and liable for those costs

The cost of the Tender Processing shall not be refundable.

The employer is not responsible for any delay in accessing E - Procurement Portal.

The Tenderers need to register with e-procurement portal and to obtain user ID and Password for participating in the tender

The EMD & Tender processing fee shall be paid through e-procurement portal only using any of the four modes. 1-Credit Card. 2-Direct debit using Internet banking 3-NEFT( National electronic fund transfer OTC (Over the counter using bank challan)

Bank Guarantee will not be acceptable for EMD. EMD should be paid as specified in the e-procurement schedule.

The authority reserves the rights to Accept or Reject any or all the tenders without assigning any reasons.

The quoted price should be inclusive of all types of taxes (service tax, VAT, sales tax), customs duty, clearance charges, transportation, erection (commission), excise duty etc., & all incidental charges F.O.R MYSORE-570006, MANASAGANGOTRI, KARNATAKA STATE, INDIA.

The quantity of items is subject to change as and when required.

The EMD and Security Deposit are liable to be forfeited as liquidated damages in the event of any evasion , refusal or delay on his/her part in signing the contract form. The other terms and conditions are as stipulated in Standard Tender Document of government of Karnataka K/g2

Warranty: 14.1 The Supplier warrants that the Goods supplied under this Contract are new, unused, of the most recent or current models and that they incorporate all recent improvements in design and materials unless provided otherwise in the Contract. The Supplier further warrants that all Goods supplied under this Contract shall have no defect arising from design, materials or workmanship (except when the design and/or material is required by the Purchasers Specifications) or from any act or omission of the Supplier, that may develop under normal use of the supplied Goods in the conditions prevailing in the country of final destination

Liquidated Damages: 22.1 Subject to GCC Clause 24, if the Supplier fails to deliver any or all of the Goods or to perform the Services within the period(s) specified in the Contract, the Purchaser shall, without prejudice to its other remedies under the Contract, deduct from the Contract Price, as liquidated damages, a sum equivalent to 0.5% of the delivered price of the delayed Goods or unperformed Services for each week or part thereof of delay until actual delivery or performance, up to a maximum deduction of 10% of the Contract Price.. Once the maximum is reached, the Purchaser may consider termination of the Contract pursuant to GCC Clause 23.
