Technical Capacity : Following conditions of eligibility, as per clause no 2.2.2 of RFQ for New Age Passenger Locomotive Project as below: -(A) Technical Capacity: (A.1). Propulsion System: (i) Applicant must have designed, manufactured and supplied IGBT/SiC based Propulsion System for Railway locomotives (Electric or Diesel) of 6000 HP or above. (ii) Total Horse Power of above supply shall exceed 3,00,000 HP, called Threshold Technical Capacity for IGBT/SiC based Propulsion System over past 7 financial years (including current financial year) from the Application Due Date in eligible projects as defined in clause 3.2. (iii) Applicant must have supplied at least one third of the Threshold Technical Capacity for IGBT/SiC based Propulsion System over past 4 financial years (including current financial year) from the Application Due Date. Note:- (i) Propulsion System shall include IGBT/SiC based Traction Converter, Auxiliary Converter and Vehicle Control Unit (VCU).(ii) An Applicant who has procured the design from a third party (not being an Associate) shall not be eligible. (A.2)Mechanical System:- (i) Applicant may itself have proven record of designing locomotives, including design ofMechanical System of locomotives or engage Specialist locomotive design Sub-Contractor/s, having proven record/s of designing of locomotives, design of Mechanical System of locomotives. (ii) The Specialist Sub-Contractor/s shall be engaged by the Applicant at least upto approval of the Technological Partner as approved regular source. Note:-(i) The Applicant shall have manufacturing facility for Propulsion System in India. (ii) Traction Motor, Main Transformer, Car Body Shell, Bogies and Brake Systems shall be procured from the manufacturers in India. (iii) For Bogies, proven record would essentially mean a validated design of Bogie of 160 kmph speed satisfactorily running on any Railways on at least 10 locomotives for not less than 01 year.
Financial Capacity : Following conditions of eligibility, as per clause no 2.2.2 of RFQ for New Age Passenger Locomotive Project as below: -(B) Financial Capacity: Annual Turn Over of the Applicant shall be more than Rs. 1100 Cr. (One Thousand One Hundred crores) in any two financial years out of the last five financial years immediately preceding the Application Due Date (the Financial Capacity).
(C) Compliance of Provisions of Public Procurement Order No.4 dated 23.02.2023 of Department of Expenditure, Ministry of Finance on Restrictions under Rule 144(xi) of the General Financial Rules (GFRs), 2017. The Applicant shall comply with the provisions of Public Procurement Order No. 4 dated 23.02.2023 of Department of Expenditure, Ministry of Finance on Restrictions under Rule 144(xi) of the General Financial Rules (GFRs), 2017 or latest. Applicant shall provide a certificate of compliance along with the Application as per the said Order.
Compliance of Functional Requirement Specification : (D) Compliance of Functional Requirement Specification:- The Applicant shall submit an undertaking confirming that it has thoroughly examined and understood the provisions and requirements stipulated in the Functional Requirement Specification (FRS) document and possesses the requisite capability to manufacture the locomotive in accordance and shall submit clause-wise compliance statement against all the requirements stipulated in the FRS document, in the prescribed format as provided at Appendix-XI, along with the application. No deviation from the requirements stipulated in the FRS shall be accepted. Non-submission of the undertaking and the clause-wise compliance shall lead to rejection of the application.
In case of a Consortium/Joint Venture, the combined Technical Capacity and Financial Capacity of those Members, who have and shall continue to have an equity share of at least 26% (twenty-six per cent) each in the SPV, should satisfy the above conditions of eligibility; provided that each such Member shall, during the Supply Period, hold equity share capital not less than 26% (twenty- six per cent) of the subscribed and paid- up equity of the SPV.

In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, the railway shall deduct the applicable GST from his/her bills under reverse charge mechanism [RCM] and deposit the same to the concerned tax authority.
All the tenderers/bidders should ensure that they are GST complaint and their quoted tax structure/rate as per GST Law.

Power of Attorney for signing the Application as per format prescribed in APPENDIX II of RFQ.
If applicable, the Power of Attorney for Lead Member of Consortium/Joint Venture to be submitted as per format prescribed in APPENDIX III of RFQ.
Joint Bidding Agreement as per format prescribed in APPENDIX IV of RFQ.
Earnest Money Deposit (EMD): All bidders except those who are exempted from submittingEMD as per relevant para of CLW BID DOCUMENT- (Rev.V) Jan. 2026 (Copy attached), shall be required to submit EMD as per the amount mentioned in the tender schedule. Offers submitted by bidders without EMD who are not eligible for exemption shall be summarily rejected.
In compliance to Public Procurement (Preference to Make in India), Order 2017 -Rev circulated vide Railway Board letter dated 20.08.2024, bidders to indicate percentage of local content and provide self certification that the item offered meets the local content requirement for Class-I local supplier and also give details of the location at which the local value addition is made.
At the time of execution of the project, for all contracts above INR 10 Crore, the contractor/supplier shall be required to give local content certification duly certified by cost/ charteredaccountant in practice. For cases where it is not possible to provide certification byCost/Chartered Accountant at the time of execution of project, the supplier shall bepermitted to provide the certificate for local content from Cost/Chartered Accountant aftercompletion of the contract, within time limit acceptable to the procuring entity. In case thecontractor/ supplier does not meet the stipulated local content requirement and thecategory of the supplier changes from Class-I to Class-II/ Non-local, a penalty upto 10% of thecontract value may be imposed. However, contract once awarded shall not be terminatedon this account.
Bidders claiming to avail benefits and preferential treatment extended to Micro andSmall Enterprises [MSEs] should necessarily enclose relevant document. Bidder may pleaserefer the CLW BID DOCUMENT- (Rev.V) Jan. 2026 ( Copy attached).
The bidder agrees to supply the tendered stores at the rates quoted by him in accordance with the IRS Conditions of Contract and [or] special Conditions and [or] other Conditions specified/attached with the tender.

Security Deposit: 1. There shall have no exemption from submission of Security Deposit (SD) by any tenderer except following: (i) The store contract cases of value upto Rs.25 (Twenty five) lakh. (ii) Other Railways, Indian Ordinance Factories and Govt. Department(iii) Public Sector Undertakings (PSUs) owned by Ministry of Railways and PSUs for the group of items that are manufactured by them.(iv) In tender issued against PAC, OEM in whose favour PAC has been issued shall be exempted from submitting SD (v) KVIC and AKASH shall be exempted from SD for items supplied by them(vi) Vendors registered with the Railways for the trade group of the item tendered shall be exempted from SD for orders valued upto their monetary limit of registration(vii) Vendor appearing on the approved vendor lists of RDSO/PUs/CORE, subject to approval status being valid on the date of tender closing.(viii)Vendors registered with railways for supply of medicine, medical equipments and consumables shall be exempted from submission of SD for these items2. (a) The amount of Security Deposit (SD),shall be, rounded off to nearest higher of Rs.10 (ten).(b) Amount of SD for contract value above Rs 25 lakh and upto Rs 50 Crore will be @ 5% of contract value subject to maximum of Rs 50 lakh(c) SD will be Rs 1 Crore for the contract value above Rs 50 Crore.3. Security Deposit shall have to be submitted by the successful tenderer within 21 days from the date of communication of the acceptance with respect to the purchaser..4. Security Deposit shall remain valid for a minimum period of 60 days beyond the date of completion of all contractual obligations, unless otherwise specified in the tender documents. 5. In the event of successful tenderer (s) failing to deposit/submit SD in acceptable form within the prescribed period as aforesaid, it shall be lawful for the Purchaser: i) To automatically adjust the EMD submitted by such successful tenderer (s) towards SD. ii) In cases where available EMD amount is less than required SD and the successful tenderer does not deposit the balance SD amount within stipulated time, then EMD shall be forfeited and case be dealt with as that of withdrawal of offer by the tenderer. iii) In case, the MSEs exempted from submission of EMD fail to submit SD in stipulated time, damages shall be levied for failure to act as per offer with regard to condition relating to SD, equal to EMD amount, as would have been applicable if the offer was from a non-MSE vendor. These damages shall be treated as recoveries outstanding against the vendor and dealt with accordingly.
Security Deposit: 6. Wherever the supplies are to be delivered in morethan one instalment, each such instalment forms a severable contract. In case of failure by contractor to meet deliveries for any instalment, purchaser may cancel the contract for defaulted part by forfeiting SDcommensurate to that instalment. Where ever SD has been exempted, for any reason, and the supplier fails to supply goods as per condition of contract, as amended from time to time, purchaser shall have right to levy damages from the supplier for failing to comply with the contractual conditions, not by way of penalty, an amount equal to SD amount as would have been applicable if the contract was with a non- exempted vendor. These damages shall be treated recoveries outstanding against the vendor and dealt with accordingly Risk purchase clause shall not be applicable. (7) All vendors, exempted from submitting SD shall be required to sign a bid securing declaration as per Annexure- A to this instruction. There shall be no exemption to such bidders from submitting SD for all tenders published during the period of time if they are disqualified as per declaration signed by them .The disqualification procedure and all correspondence thereof shall be online and digital. The above Para 7 shall not be applicable for Govt. Deptts/ordnance factories/Other Railways/ Railway's PSUs/KVIC/AKASH.
Annexure - A. Bid securing declaration to be signed by bidders availing exemption from submission of EMD/SD. "I/We certify that my/our offer is eligible for exemption from submission of bid security/Earnest Money Deposit, in terms of the tender conditions. In case my/our claim to exemption from submission of bid security/Earnest Money Deposit is not found valid as per terms of the tender, I/We understand and accept that Railways has unquestionable right to summarily reject my bid and my offer shall not be considering for ordering. Further, I/We hereby understand and accept that if I/We withdraw or modify my/our bids during the period of validity, or if I/We are awarded the contract and on being called upon to submit the performance security/Security Deposit, fail to submit the performance security/Security Deposit before the deadline defined in the request for bid document/Notice Inviting Tender, I/We shall be debarred from exemption of submitting Bid Security / Earnest Money Deposit and performance security/ Security Deposit for a period of 6 (six) months, from the date I/we are declared disqualified from exemption from submission o EMD/SD, for all tenders for procurement of goods issued by any unit of Indian Railways published during this period."
