   I/We engage to supply the Western Railway with the articles specified above upon the terms of the Indian Railway Standard Conditions of Contract (last version) and upon the terms of the Revised special conditions and Instructions for the Guidance of the Contracts issued by the Western Railway S/137/F Revised May 2011 Amendment No. 12 of AUGUST 2018.

   In case of rejection of supplied material, 2% of value of rejected goods would be charged as "Incidental Charges " as per WRSI.

   LD clause in condition is 2% per month quote RB Letter No g176/0/msop18 dt 03/01/19 & induct 0.5% per week.

   The bidder confirms that Rates and other financial terms quoted in relevant columns of financial bid will only be ruling terms for acceptance, and such terms quoted anywhere else should be ignored.

   S.D WILL BE TAKEN AS PER RB GUIDE LINE RAILWAY BOARD LETTER NO 2004/RS(G)/779/11/Pt. DT 23/12/19.

   F.O.R. - Destination ( No deviation from the F.O.R. Terms stipulated in the tender is permitted.)

   In The event of sucessful tenders failing to deposit/submit SD acceptable form within the prescribed period as aforesaid, the EMD submitted by such sucessful tenderers shall be automatically adjusted towards SD in view of the fact that in view of the fact that in most of the cases, EMD amount would be adequate to meet the SD amount. Incase where available EMD amount is less than required SD and the sucessful tenderer does not deposit the balance SD amount within stipulated time, then EMD shall be forfeited and case be dealt with as that of withdrawal of offer by the tenderer as per extant instruction. this will resolve the problem faced by purchaser to great extent due to intentional delay in submission of SD successful tenderers.
