   1. Railway reserves the right to procure full/bulk quantity of the tendered item from PAC [Proprietary Articles Certificate] holder of M/s PLASSER INDIA PRIVATE LIMITED-FARIDABAD. Address: 13th Milestone, Mathura Road P.O. Amar Nagar, Faridabad, Haryana, India, 121003. 2. Authorized Dealer of PAC Holder must submit valid Tender Specific Authorization along with their offer, failing which their offer will be summarily rejected.

   Developmental order :- Other sources (new/untried sources/Non PAC Sources) having capacity to manufacture and supply of the tendered item and attaching documents for their past performance for same or similar item duly supported by PO copies along with Inspection certificate/Consignee Receipt Certificate(CRC)/Consignee Receipt Note(CRN)/Receipt Note (R/Note)/Delivery documents/Tax invoices/Receipted challans etc. of same or similar item to Zonal Railways/PUs etc. may be considered for Developmental orders maximum up to 20 percent of the net procurable quantity provided they have attached the relevant documents along with their offer which proves their capacity and capability to manufacture the tendered item.Such tenderer are to note that non submission of such documents shall be taken as their not having any such past performance and/or capacity, and their offer is liable to be rejected and no back reference in this regard will be made to them. Firm to approach Vendor Approving Authority for capacity cum capability assessment and prototype approval if applicable, before supply/ offering for inspection.

   1. In terms of DPIIT/Ministry of Commerce and Industries order no.P- 45021/2/2017-PP(BE-II)-Part(4)Vol.II dated 19.07.2024 and keeping in view with the public procurement (preference to Make in India) order 2017 as amended time to time, only class 1 and class 2 local suppliers are eligible to participate in this tender. 2. Clause No. 28.0 under Section 2 of ER General Tender Condition is applicable.

   [1] Bidder should go through the Tender document, IRS Conditions of contract, General Tender conditions of Eastern Railway, Special conditions [if any] and other Conditions specified/attached with the tender. [2] In case of Authorized Dealer, bidder must uploaded Tender specific Authorization Certificate along with their offer. [3] Bidder has deposited required EMD amount as applicable as the case may be. [4] In case of micro and small enterprises, firm has submitted Udyam Registration Number as per public procurement policy. [5] The bidder has uploaded document like copies of Receipt Notes, Inspection Certificates etc. in support for their performance/Credentials as the case may be.

Commercial-Compliance

   GST: [1] All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law. [2] In case the successful tenderer does not have valid GST registration. Then the railway shall deduct the applicable GST from his/their bills under reverse charge mechanism [RCM] and deposit the same to the concerned tax authority. [3] The offers shall be evaluated based on the GST rate as quoted by each bidder and same will be used for determining the inter se ranking. While submitting offer, it shall be the responsibility of the bidder to ensure that they quote correct GST rate and HSN number. [4] Wherever the successful bidder invoices the goods at GST rate or HSN number which is different from that incorporated in the purchase order, payment shall be made as per GST rate which is lower of the GST rate incorporated in the purchase order or billed. [5] Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by the bidder. [6] Any amendment to GST rate or HSN number in the contract shall be as per the contractual conditions and statutory amendments in the quoted GST rate and HSN number, under SVC.    Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

   Validity of the Offer: No deviation from the offer validity period stipulated in the tender is permitted. Firm will have to submit quotation with a validity for a minimum period of 90 [ninety] days otherwise their offer will be summarily rejected.
