Bidder to provide detailed product sheet and specification sheet of the offer. Failing which offer may not be considered.

The tenderer shall, in their offer, submit performance certificate of atleast 01 number of same machine(which are counted for the purpose of clause above) or similar item (Similar item means transformer of 200 KVA or higher)supplied in the last 5 years and the machine covered by these certificates must have worked satisfactorily for at least one year from the date of commissioning as on the original date of closing of tender. The performance certificate submitted by the tenderer shall have been issued by the actualend user organization of the machine, with their clear signature and address therein, in whose premises the machine is installed and commissioned. Performance certificates should be as per Annexure-A1

Bidder has to upload Tender specific authorization from OEM for supply and after sales service and warranty support. If OEM is the bidder, self declaration certificate for the same to be provided along with bid. Failing which offer wont be considered

Clause wise compliance of detailed specificaition attached in tender to be provided by the bidder.Failing which offer wont be considered.

During warranty period, the supplier or his authorized agent shall attend for break down as soon as possible, but in no case later than 72 hours of receipt of intimation of the breakdown. (b) Maximum down time during the warranty period will be 2%. (c) A penalty of @1/2% (half percent) of the price of the store (including elements of taxes, duties, freight, etc) per week or part of the week will be levied for delay in response time for attending and rectification of faults beyond specified time of 72 hours during the warranty period. (d) Maximum penalty to be levied on account of warranty failure will be 10% of the contract value calculated during whole of the warranty period and after that if there is any delay on the part of the supply, purchaser shall be entitled for encashment of WG bonds or from other bills. In such cases ,the bad performance of the firm during the warranty period, the same should be recorded and circulated to all Railways. The same should be given due regards in deciding future orders on the firm and when evidence to the contrary is not available, the firm offer may be even rejected.

Performance Guarantee for the warranty obligations, of 10% of the contract value to be submitted at time of supply valid for 6 months beyond the free warranty period. The consignee officials to ensure that the Performance Guarantee is received and given to purchase office before releasing CRN

Otherwise, claim for benefits under MSME Act may not be entertained and also indicate whether the Enterprise is owned by SC/ST/Woman. Please upload support of this. [b] If you are not a MSE or a consortia of MSEs formed by NSIC, please indicate percentage of sub contracts in execution of this tender that will be from Micro and Small Enterprises. HSN CODE [a] All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per the GST Law. Firms must indicate its GST registration number along with their offer. [b] In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, The Railway shall deduct the applicable GST from his/their bills under Reverse Charge Mechanism (RCM) anddeposit the same to the concerned tax authority. [c] The firm should indicate the tariff code (HSN Code) for claiming GST for the tendered item. [d] The offer shall be evaluated based on the GST rate as quoted by each bidder and same will be used for determining the inter-se ranking. While submitting offer, it shall be the responsibility of the bidder to ensure that they quote correct GST rate and HSN number. [e] It shall be the responsibility of the bidders to quote correct HSN number and corresponding GST rate. The Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate, if quoted by the bidder. [f] Wherever, the successful bidder invoices the goods at GST rate or HSN number which is different from that incorporated in the Purchase order, payment shall be made as per GST rate which is lower of the GST rate incorporated in the Purchase order or billed. [g] Vendor is informed that she/he would be required to adjust her/his basic price to the extent required by higher tax bill as per invoice to match the All inclusive Price as mentioned in the Purchase order. [h] Any amendment to GST rate or HSN number in the contract shall be as per the contractual conditions and statutory amendments in the quoted GST rate and HSN number, under SVC.

Railway is not bound to accept/Cancel the lowest or any tender or assign any reason for doing so and Railway reserves the right to accept/Cancel any tender in respect of the Whole or any portion of the items specified in the Schedule annexed (a or Tender Schedule) and the contractor shall be required to supply the same at the rate quoted

Purchaser shall have the right to levy general damages on the supplier for failing to comply with the contractual conditions, not by way of penalty, an amount equal to 5% of the value of cancelled quantity.

EARNEST MONEY DEPOSIT : EARNEST MONEY DEPOSIT (EMD) : EMD shall be deposited by all vendors for tenders with estimated value above Rs.25 Lakhs subject to the applicable exemptions. SECURITY DEPOSIT : SECURITY DEPOSIT (SD) shall be 5 % of total value of contract and shall be taken from all vendors for contract value above Rs. 25 Lakh subject to the applicable exemptions. For details please refer 10.0 Part A of Southern Railway Tender Conditions. In case of submission of security Deposit in the form of Bank Guarantee, please refer Annexure - 5 of Southern Railway Tender conditions. The Security Deposit is valid for 3 months beyond the date of successful supply of the machine. Security deposit to be given within 15 days of placement of Purchase Order.
