Special Eligibility Criteria

   The Bidder or its OEM {themselves or through re-seller(s)} should have supplied same or similar Category Products (similar item means to supply XLPE CABLE with same or different sizes ) for 20% of bid quantity, in at least one of the last three financial years before the bid closing date in a single contract to a Central / State Govt Organization / PSU / Public Listed Company.

   The onus of submission of requisite documents in support of supply {[i] Receipt Notes/CRAC/Proof of acceptance of material by consignee OR [ii] Inspection Certificate with self- declaration by the bidder that supply has been accepted by consignee. Furnishing of false declaration shall render termination of contract and further action as per terms and conditions of contract} lies with the tenderer. In case the tenderers do not submit the requisite documents as detailed above along with their offer, the tender will be decided on the basis of their past supply performance of SWR [ if any].

   Tenderers who have failed to supply at least 50% of the ordered quantity of the same/similar category of item within original delivery period against any previous order placed in last financial year and in the current financial year till tender closing date of this tender placed by South Western Railway (SWR) shall be considered ineligible. Their offers shall be passed over and shall not be considered for further evaluation

   Bulk procurement of this item shall be restricted to firms holding a valid BIS Licence for thetendered item conforming to IS:7098 (Part 1): 1988 or the latest version thereof, and bearing the ISI Mark.The bidder shall submit a valid BIS Licence along with the offer. In the case of an authorizedagent/dealer, a tender- specific authorization certificate or time- specific authorization certificate issued by the BIS licence-holding manufacturer (OEM), along with a copy of themanufacturer's valid BIS Licence, shall be submitted with the offer, failing which the offer shall be summarily rejected.Authorized agents and BIS licence-holding manufacturers may participate in the tender,provided they submit the requisite authorization certificate and valid BIS Licence as applicable. Failure to submit the required documents shall render the offer liable for rejection. In the event of removal, suspension, cancellation, banning, or downgrading of the BIS Licence after opening of the tender, such cases shall be taken into consideration while finalizing the tender. The bidder shall clearly indicate the valid CM/L Number in the offer, failing which the offer shall be summarily rejected.

   Bidders should confirm following certificate for Compliance. (a) I have read the clause 32 of Instructions to tenderers and general conditions of tenders for supply contract attached with the tender regarding restrictions on procurement from a bidder of a country which shares a land border with India and on sub-contracting to contractors from such countries. (b) I certify that this bidder is not from such a country and will not subcontract any work to a contractor from such countries unless such contractor is registered with the Competent Authority. I also certify that this bidder will not offer any products/services of entity from such countries unless such entity is registered with the Competent Authority. (c) I hereby certify that this bidder fulfills all requirements in this regard and is eligible to be considered. (d) I hereby acknowledge that in the event of acceptance of my bid on above certificate and if the certificate is found to be false at any stage, the false certificate would be aground for immediate termination of contract and further legal action in accordance with the Law. (Bidders confirming this certificate for Compliance shall select Yes in the Complied column. However, in case you do not confirm above certificate for Compliance, select NO in the complied column. In such cases you are required to submit the certificate for Compliance as per Instructions to tenderers and general conditions of tenders for supply contract along-with their Bid/Offer.

   Time Preference Clause : It should be noted that if a contract is placed on a higher tenderer as a result of invitation of tender, in preference to the lower acceptable offer, in consideration of offer of earlier delivery, the contractor will be liable to pay to the Government the difference between the contract rate and of the lowest acceptable tender on the basis of final price F.O.R destination including all elements of freight, GST and other incidentals in case of failure to complete supplies in terms of such contract within the date of delivery specified in tender and incorporated in the contract. This is in addition and without prejudice to other rights under the terms of contract. (Refer para 12.7 of tender booklet 06.10.2025 enclosed with this tender document)

   Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.
