Provision of RUB/LHS in lieu of LC No. 55/C, 58/C, 57/C, and 59/C in the Maa Belha Devi Dham Pratapgarh Jn. - Phaphamau Section of Lucknow Division, Northern Railway.

The tenderer must have minimum average annual contractual turnover of V/N or 'V' whichever is less, whereV= Advertised value of the tender in crores of RupeesN= Number of years prescribed for completion of work for which bids have been invited.The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover.The tenderers shall submit requisite information as per Annexure-I, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet.

The tenderer must have successfully completed or substantially completed any of the following (by any Government organizations) during last 07 (seven) years, ending last day of month previous to the one in which tender is invited:Three similar works each costing not less than the amount equal to 30% of advertised value of the tender, orTwo similar works each costing not less than the amount equal to 40% of advertised value of the tender, orOne similar work each costing not less than the amount equal to 60% of advertised value of the tender.(b)(i)In case of tenders for composite works (e.g. works involving more than one distinct component, such as Civil Engineering works, S&T works, Electrical works, OHE works etc. and in the case of major bridges - substructure, superstructure etc.), tenderer must have successfully completed or substantially completed any of the following during last 07 (seven) years, ending last day of month previous to the one in which tender is invitedThree similar works each costing not less than the amount equal to 30% of advertised value of each component of tender, orTwo similar works each costing not less than the amount equal to 40% of advertised value of each component of tender, orOne similar work each costing not less than the amount equal to 60% of advertised value of each component of tender.Note for (b)(i): Separate completed works of minimum required values shall also be considered for fulfilment of technical eligibility criteria for different components.(b) (ii) In such cases, what constitutes a component in a composite work shall be clearly pre- defined with estimated tender cost of it, as part of the tender documents without any ambiguity. Any work or set of works shall be considered to be a separate component, only when cost of the component is more than 2 crore each. (b)(iii) To evaluate the technical eligibility of tenderer, only components of work as stipulated in tender documents for evaluation of technical eligibility, shall be considered. The scope of work covered in other remaining components shall be either executed by tenderer himself if he has work experience as mentioned in clause 2.3.3(a) (ii) of the Tender Document or through subcontractor fulfilling the requirements as per clause 2.3.3 of the Tender Document or jointly i.e., partly himself and remaining through subcontractor, with prior approval of Chief Engineer in writing.

Similar nature of work -: Construction of Bridges such as Rail Bridges or Road Bridges or Rail cum Road Bridges or Road over Bridges (ROB) or Road Under Bridges (RUB) or Limited Height Subways (LHS)

The tenderers must necessarily upload/submit thelegal documents, pertaining to the constitution of their Concernas applicable, along with the tender, as enumerate in clause 2.4of spl tender condition and instruction to tenderers oftender document.

Submit your bank details i.e. Name of the Bank along withBank Branch Code, Account Number, IFSC Code as per AnnexureJ(Real Time Gross Saving (RTGS)/National ElectronicFund Transfer (NEFT) (Model Mandate Form)) of tender document

The tenders confirms the option of taking payment throughLC arrangement. The tenderer affirms having read over andagreed to the terms and conditions of the LC option.

Tenderer shall certify that they are not black listed ordebarred by Railways or any other Ministry/ Department/PSU(Public Sector undertaking) of the Govt. of India/State Govt.from participation in tenders/contract on the date of opening ofbids either in their individual capacity or as a member of the JVfrm in which they were/are members

The original Bank Guarantee for Bid Security should bedeliveredin person to the office of Deputy ChiefEngineer/Const./AY,NorthernRailway, Lucknow before closing date of submission ofbids (i.e. excludingthe last date of submission of bids).

Tenderers are compulsorily required to upload Certificate asperAnnexure M (A), as the case may be, as stipulated inClause2.2.6 of Special Tender Conditions and instruction totendererswithout which the offer will be considered incompleteand will berejected summarily.

Tender upload ANNEXURE-Q regarding Employment/Partnership etc. of Retired Railway Employees as stipulated in clause 2.2.12.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

Tenderer may please note that offers receivedwithout requisite/mandatory documents as mentioned above, will be considered as invalid tender and for which contractor shall have no claim on Railway.

The tenderer shall visit the site of work andacquaint himself/themselves with the conditions of work viz.approach roads and accessibility, nature of soil/rock, availabilityof materials, electric power, water for work and drinkingpurposes, site for labour camps, stores, godowns, extent oflead/lift in work, availability of skilled and unskilled labour etc.that may beencountered in the course of execution of work. Inshort, he/they should familiarize himself/themselves fully with theconditions obtaining at site and FURNISH A CERTIFICATE TO THISEFFECT, in the Proforma appended as Annexure-C of TenderDocument.

Tenderers are compulsorily required to fill up/submitrequisite details in prescribed Performa of Annexure C to G,I,Jand Annexure-L as per tender document without which the offermaybe considered as incomplete and be liable to be rejected.

The tenderer's may note that the Railway reserves its rightto either accept or reject any Bid/s without assigning anyreasons whatsoever and tenderer s shall have no claim s onthis account.

The time, date and venue of opening of Financial Bids shallbenotified to the successful tenderer s after evaluation ofTechnical cum Commercial Bids. The same shall be opened ondue date in the presence of tenderers / their representatives asmay wish to attend the same

As per Income Tax Act, Tax will be deducted for sums paidfor carrying out the work under this contract. In case ofsupply contract for ballast, deduction of 2% (Two percent)Income tax will be made for the sums paid for labour portion only(i.e., loading, unloading, stacking, measurement and laying etc.).1%labour cess shall be deducted from each RA bill to bedeposited with concerned labour Commissioner/State Govt.

TAXES

The contractor shall be governed by the Taxes applicable atthe place of actual execution of work as per clause 23.0 ofSpecial Tender Conditions and instruction to tenderers

The tenderers shall quote the rates of one single %age" Above/Below/At par" on the total amount comprisingbasic value of entire Schedule of Chapters of USSOR-2021/DSR2021plus escalation as per Schedule A, one single %age" Above/Below/At par" on the total amount comprisingbasic value of entire Schedule of Chapters of DSR-2021plus escalation as per Schedule B, and one single %age "Above/Below / At par" over entire schedule of Non schedule Itemsasper Schedule C, in the Bill(s) of quantities. (Packet-II,Financial Bid). Every possible fluctuation, in the rate of labour,material and general commodities, and other possibilities of eachand every kind which may affect the rates, should be consideredandkept in view before quoting the rates and no claim onthis account shall be entertained by the Railway underany circumstances except the price escalation payable as perprice variation clause, if any, provided separately in thetender documents.

Only Technical cum Commercial bid will be openedfirst. Thereafter all Technical cum Commercial offers will beevaluated for eligibility on the basis of the documents submittedby the tenderers regarding constitution of firm, technical andfinancial eligibility. The shortlisted firms will thereafter beinformed of the date, time and venue of the opening of theirFinancial bids. Financial bids of these shortlisted tenderers will beopened as scheduled and evaluated accordingly.

If on verification of credentials, at the evaluation stage, itis found that the tenderer has submitted forged/fake documentsin support of his offer, his Bid Security shall be forfeitedbesides banning of business for a period of up to two year.

IF THE TENDERER S DELIBERATELY GIVES WRONGINFORMATION/CREDENTIALS/DOCUMENTS IN HIS/THEIRTENDERS AND THEREBYCREATE S CIRCUMSTANCES FORACCEPTANCE OF HIS/THEIRTENDER, RAILWAY RESERVES THERIGHT TO TERMINATE THECONTRACT AT ANY STAGE, BESIDES,BANNING OF BUSINESS FORA PERIOD OF UPTO TWO YEAR.

The contractors operations and proceedings in connectionwith the works shall at all times be conducted during thecontinuance of contract in accordance with the laws, ordinance,rules and regulations for the time being in force and t h econtractor s h all further observe a n d comply with t h e byelaws and regulations of the Govt. of India, State Govt. and ofMunicipal other authorities having jurisdiction in connection withthe works or site over operations such as these are carried outby the contractor/s and shall give all notice required by suchbye-laws and regulations. The Hospital and medical regulations inforce for the time being shall also be complied with bythe contractor/s and his workmen.

The contractor shall be responsible for the observance ofthe rules and regulations under the mines act and mineral rulesand Indian Metallurgical rules and regulations of State/CentralGovt. concerned as amended from time to time.

Contractor shall at all times keep the railwayadministration indemnified against all penalties that may beimposed by the Govt. of India or State Govt. for infringements orany of the clauses of the mines act and rules made there underin respect of quarries from which the ballast for these works isprocured.

Care for submission of offer

Before submitting a tender, the tenderer will be deemed tohave satisfied himself by actual inspection of the site and localityof the works, that all conditions liable to be encountered duringthe execution of the works are taken into account and that therates he enters in the tender forms are adequate and allinclusive to accord with the provisions in Clause-37 of theStandard General Conditions of Contract for the completion ofworks to the entire satisfaction of the Engineer.

Tenderers will examine the various provisions of TheCentral Goods and Services Tax Act, 2017(CGST)/IntegratedGoods and Services Tax Act, 2017(IGST)/Union Territory Goodsand Services Tax Act, 2017(UTGST)/ respective state's StateGoods and Services Tax Act (SGST) also, as notified byCentral/State Govt &as amended from time to time andapplicable taxes before bidding. Tenderer's will ensure that fullbenefit of Input Tax Credit (ITC) likely to be availed by them isduly considered while quoting rates.

The successful tenderer who is liable to be registeredunder CGST/IGST/UTGST/SGST Act shall submit GSTIN along withother details required under CGST/IGST/UTGST/SGST Act torailway immediately after the award of contract, without whichno payment shall be released to the contractor. The contractorshall be responsible for deposition of applicable GST to theconcerned authority.

In case the successful tenderer is not liable to beregistered under CGST/IGST/UTGST/SGST Act, the railway shalldeduct the applicable GST from his/their bills under reversecharge mechanism (RCM) and deposit the same to theconcerned authority.
