1.0 We, the undersigned bidder, having read examined in detail the specifications and all the bidding documents of the said 33kV line work and hereby propose to do erection, testing and commissioning of the line work including design, whenever specified, engineering, manufacture, testing, supply on FOR/FOB as applicable site basis as applicable and commissioning of the various line equipments, equipment support structures etc., as detailed in the specifications and documents.
2 PRICE AND VALIDITY:
2.1 All ex-works price components and spares, maintenance and testing equipments and other charges viz. Freight & Insurance and other charges stated in our proposal shall be firm. All the prices and other terms and conditions of this proposal are valid during the performance of the contract. We further declare that prices stated in our proposal are in accordance with your “Instructions to Bidders” included in the Volume – I of Bid documents. All the prices and other terms and conditions of this proposal are valid for a period of One Hundred and Eighty Days (180) from the opening of bid.
2.2 We do hereby confirm that our bid prices as quoted in the e-portal include all the import duties and levies applicable on bought out components, materials, equipment and other items and confirm that any such taxes, duties and levies additionally payable shall be to our account. We further understand that no taxes in any form shall be payable by the owner for bought out items, which are dispatched by our sub-suppliers directly to project site as sale-in-transit basis.
2.3 All applicable taxes on the transaction between the owner and ourselves shall be to Owner’s account. These are included in our bid price quoted in the price bid template provisioned in the e-portal.
2.4 The bid prices, the price components of the various items, price components of Mandatory spares are considered while quoting percentage in the price bid template provisioned in the e-portal.
3 CONSTRUCTION OF THE CONTRACT
We, declare that we are making the offer on the basis of a divisible supply-cum-erection contract on single source responsibility basis. The supply portion of the contract will relate to supply of equipment/material on ex-works basis and the erection portion of the contract will relate to transportation, storage, erection, testing and commissioning of equipment/ material etc as defined in Bid documents. However, we will have no objection in case owner decides to split the above mentioned package into three separate contracts, one contract for supply of all equipments on ex-works basis, second contract for all services such as transportation, insurance, handling at site storage, installation of the equipment/material as defined in bid documents and the third portion as Civil Engineering works including formation of cable duct, equipment foundation etc.We declare that the award of three contracts our responsibility for successful operation of the equipment as per bid documents and that both the contracts will have a cross fall breach clause viz. that a breach in one contract will automatically be classified as breach for the other contract which will confer on the owner the right to terminate the other contract at our risk and cost.

iii Further, we agree that additional conditions if any, found in the proposed documents, other than those stated in Deviation Schedules, save that pertaining to any rebates offered, shall not be given effect to.
7 PERFORMANCE GUARANTEES:
We declare that the ratings and performance figures of the equipment to be furnished and erected by us are guaranteed.
8 BID PRICING :
We further declare, that the prices stated in our proposal are in accordance with your “Instructions to Bidders” included in Volume – I of the Bid Documents.
9 PRICE ADJUSTMENT: VOID
10 ADDITIONAL INFORMATION
We confirm that any additional information does not imply any additional deviation beyond those covered in Schedule-5 & 6 and in case of any contradiction between these additional information and other provisions of Bid, the latter will prevail.
11 QUALIFICATION DATA:
We confirm having submitted the qualification data in duplicate copies, as required by you in your ‘Instructions to Bidders’, Volume – I, in a separate envelope along with this proposal. Further, we have filled in the information for qualification requirements as listed in Schedule-9. In case you require any further information in this regard, we agree to furnish the same in time to your satisfaction.
12 WORK SCHEDULE:
If this proposal is accepted by you, we agree to submit engineering data, provide services and complete the entire works from time to time, in accordance with Schedules indicated in the proposal. We fully understand that the time schedule stipulated in the proposal is the essence of the Contract, if awarded.
13 CONTRACT PERFORMANCE SECURITY
We further, agree that if our proposal is accepted we shall provide an irrevocable Contract Performance Guarantee, of value equivalent to five percent (5%) of the contract price valid up to the end of ninety (90)
days after the end of the Contract warranty period in the form of
