Draft Tender Conditions
1) General Conditions of Eligibility
Condition 1 Tenders from Joint ventures are not acceptable.
Condition 2 Conditional Tenders will not be accepted.
Condition 3 Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka
Condition 4 Bidders shall ensure upload of relevant document certifying his/her status as Scheduled Caste/ Scheduled Tribe/other reserved category as prescribed in the tender document.
Condition 5 It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee (Min Rs.500/- and Max Rs.7500/-) and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission. The tender processing fee is not refundable.
Condition 6 EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.
Condition 7 As per Karnataka State Government order No.LD 300 LET 2006 Bangalore Dated 01/01/2007 and Government Letter No.PW 134 BMS 2007 Dated 27/7/2007 a sum amounting to 1 percent of the bill amount will be deducted towards Construction Labour Welfare fund.
Condition 8 The tenderer should quote his rates with all lead and lifts, loading and unloading including cost of labour, hire charges of machinaries and other incidental charges etc complete as per specification and directions of the Engineer incharge of the work.
Condition 9 The bidder shall bear all costs associated with the preparation and submission of each tender and the employer will in no case be responsible and liable for those costs. The department is not responsible for any delay in accessing e-procurement portal
Condition 10 Contractors should have to upload the scanned copy of all necessary qualification documents, and submit the original documents certificates after opening the tender for evalution and verification.
Condition 11 The bidder is required to ensure browser compatibility of the computer well in advance to the last date and time for receipt of tenders The departments shall not be responsible for non accessibility of KPPP portal due to internet connectivity issues and technical glitches at bidders end.
Condition 12 All materials required for the work shall be procured by the tenderer himself and should be got tested by the quality control authorities at his own cost before use on work.
Condition 13 Within 20 days of receipt of Letter of Acceptance, the successful Tenderer shall deliver to the employer a Security Deposit in the form of NSC/DD/ FDR in favor of the Executive Engineer, P.R.E. Division, ___________, for an amount equivalent to 5 percent of the Contract price plus additional security for unbalanced tenders in accordance with the conditions of contract.
Condition 14 Successful Bidder shall pay Contract Management Module processing fees of 0.025 percent of the contact value (Min Rs.500/- and Max Rs.7500/-) when bills are raised using Contract Management Module.
Condition 15 Self declaration of machineries are not accepted.
Condition 16 Third party inspection is mandatory for all the works in this programme.
Condition 17 The Employer reserves the right to reject any or all tenders without assigning reason.
Condition 18 Tenderer must submit his present accurate postal address and phone / cell phone number.
Condition 19 For interpretations of clauses, conditions, spelling mistakes, etc., decision of Executive Engineer is final.
Condition 20 The Furnished E.M.D. will be released only after successful execution of the Tender Agreement by the successful Tenderer or bid validity days from the date of submission of Tender whichever is earlier.
Condition 21 The successful tenderer shall maintain the work during the defect liability period of 1 year from the date of completion of the work.
Condition 22 The Tenderer at his own responsibility and risk is encouraged to visit and examine the Site of Works and its surroundings and obtain all information that may be necessary for preparing the Tender and entering into a contract for construction of the Works. The cost of visiting the Site shall be at the Tenderer’s own expense.
Condition 23 All other conditions and requirements has to be fulfilled as per the KW Standard Bid Document.
Condition 24 It is to be noted that any false documentation found to be uploaded, action may attract punitive measures such as Blacklisting, Cancellation of Registration etc.
Condition 25 The GST will be paid separately to the Contractors as per the Guidelines of the Government.
Condition 26 The work shall be inspected by the Third Party and the bill shall be admitted only after the satisfactory quality reports from the Third Party.
Condition 27 All safety precautions, warnings, signs, deployment of security guards have to be ensured so that no untoward incident happens on account of negligence or any project activity.
Condition 28 All materials required for the work, shall be procured by the tenderer himself and should be got tested by the Department quality control authorities at his own cost before use for the work. If employer wishes to engage third party inspecting agency for the said work, apart from the quality control authorities, then the contractor should cooperate with the third party for test
Condition 29 In the case of death of the contractor after executing the agreement/ commencement of the work, his legal heir, if is an eligible registered contractor and is willing, can execute and complete the work at the accepted tender rates in the same terms and conditions of the contractor of the work
Condition 30 Corrigendum/Modifications/Corrections if any will be published in the KPPP website only.
Condition 31 The work should be executed as per the KTPP Act.
Condition 32 The work should be completed within the stipulated time period from the date of issue of work order including Rainy Season.

5 Past Experience The bidder must submit last 5 years Profit and loss account obtained from Chartered Accountant (CA) Only. Certificate issued by CA.
6 Past Experience The Tenderer shall obtain the work done certificate in the prescribed form from the competent authority not below the rank of Executive Engineer (District Level Officer) and scan the Original Certificate and attach the scanned file to the Bid. The Original Certificate / Certificates shall be produced whenever required. Work Done certificate should be isuued from not below the rank of Executive Engineer with complete Indent No.
7 Capabilities of Vendor The Tenderer should possess valid Registration Certificate. KPWD/CPWD License
8 Capabilities of Vendor Tenderers who meet the above specified minimum qualifying criteria, will only be qualified, if their available tender capacity is more than the total tender value. The available tender capacity will be calculated as: Assessed available tender capacity = ( A*N*1.5 - B ) List of ongoing works with balance amount to be executed.
