The tenderer shall provide satisfactory evidence acceptable to the Purchaser to show that (a) He is a manufacturer, who regularly manufactures the items offered and has adequate technical knowledge and practical experience; (b) He has financial strength and resources to meet the obligations under the contract for which he is required to submit duly audited Annual financial statements (Balance sheet, profit & loss account etc.) for the last 3 years or a report from a recognized bank or a financial manufacturing capacity to manufacture and supply the items offered within the delivery schedule offered by him ; (d) He has established quality control system and organization to ensure adequate control at all staged of the manufacturing process. (e) He satisfies the provisions mentioned in contained in Special Conditions of Tender.
For purpose of clause 2.1 above, the tenderers should additionally submit (a) A performance statement as in Annexure -1, giving a list of major supplies of same/similar equipments effected in last 5 years or for such period a s specified elsewhere in Bid document & special conditions of tender of the items offered by him, giving details of the User name and address, order no. and date and the quantity supplied and whether the supply was made within the delivery schedule. Such period shall be reckoned from the date of opening of tender. 9b) A statement indicating details of equipment deployed and quality control measures adopted by the manufacturer as per attached Annexure 2.
In addition to the above, further information regarding his capacity, capability, if required by the Purchaser, shall be promptly furnished by the tenderer and he would offer all facilities to representative of Purchaser for assessing capacity, capability by actual visit to his work/office.
The evidence/documents submitted for meeting the qualifying requirements, if found false/fake/forged/manipulated at any stage during evaluation of offers and or even during the currency of Contract, the purchaser reserves the right to summarily reject the offer or terminate the Contract at his risk and cost and take action as per applicable law including banning of business dealings etc.

EARNEST MONEY 1. Tenderers are required to deposit Earnest Money online equivalent to the amount mentioned in the tender document. Tenderers not submitting Earnest Money should clearly indicate in their offer the reasons for the same, and failure to do so will be taken as unwillingness on their part to deposit the Earnest Money. 2. Amount of EMD (rounded off to nearest higher Rs. 10 (ten)) to be taken in tenders, Wherever applicable. a) It will be @ 2% of the estimated tender value up to Rs. 50 Cr. subject to maximum EMD of Rs. 20 lakh. b) EMD will be Rs. 50 lakh for tenders above Rs. 50 Cr. 3. Exemption from Submission of Earnest Money: The under noted categories of tenderers need not deposit Earnest Money:- a. Firms registered with MSE for tendered item as specified in para-3(b)(I)/NSIC. b. Tender cases of value up to and including Rs. 25 lakh unless otherwise mentioned in the tender. c. Other Railways and Government departments. d. Indian Ordinance factories. e. PSUs owned by Ministry of Railways and PSUs for the group of items that are manufactured by them. f. Vendors registered with Railways for the trade group of the item tendered. g. Vendors appearing on the approved vendor lists of DSO/PUs/CORE, subject to approval status being valid on the date of tender closing. h. Vendors registered with Railways for supply of medicine, medical equipments and consumables shall be exempted from submission of EMD for these items. i. In tenders issued against PAC, OEM in whose favour PAC has been issued shall be exempted from submitting EMD. KVIC and ACASH shall be exempted from EMD for items supplied by them. 4. Offers of tenderers who do not submit Earnest Money, and are also not exempted from submission of Earnest Money shall be summarily rejected. 5. The purchaser reserves the right to forfeit the Earnest Money Deposit if the tenderer withdraws or revises his offer within the validity period or fails to deposit Security Money in terms of Clause6 of this document. 6. No interest shall be payable by the purchaser on the Earnest Money. EMD of unsuccessful bidders and tenderers shall be released immediately after finalization of the tender.
The manufacturer shall have valid ISO 9001 certificate on the original date of closing of Tender and a copy of same should be submitted along with the bid. The EOT Crane of 30 ton with accessories or similar should be in scope of ISO certificate.
