   (1) Railway reserve the right to procure full or bulk quantity of tendered item is restricted to be procured from RDSO/ICF/RCF/MCF approved sources only, (2) Manufacturers or their authorized Distributor/Dealer/Agent with Tenders specific authorization can only quote. OEMs can authorize and give Tender specific authorization to its Agent/Dealers to quote on their behalf. And (3) Delivery period must be in stipulated delivery schedule as per tender condition, Higher delivery schedule offer will be summarily rejected.

   Time preference clause : In cases where it is decided to accept a higher price than the lowest tender in consideration / interest of earlier delivery, passing over the lowest acceptable offer, following conditions will apply : It should be noted that if a contract is placed on a higher tenderer as a result of this invitation to tender, in preference to the lowest acceptable offer, in consideration of offer of earlier delivery, the contractor will be liable to pay to pay to the Government the difference between the contract rate and that of the lowest acceptable tenderer on the basis of the final price, F.O.R. destination including all elements, of freight, Sales tax, Local taxes, duties and other incidentals in case of failure to complete supplies in terms of such contract within the date of delivery specified in the tender and incorporated in the contract. This is in addition and without prejudice to other rights under the terms of contracts.
