Special Eligibility Criteria

   The Purchaser reserves the right to place an order for either the entire quantity or the bulk quantity (minimum 80% of the net procurable quantity) on approved vendors, as reflected in U-VAM as on the date of tender closing, for Item ID 3100558, in terms of Clause 3.3 of Section II of the Central Railway Bid Document RDSO-(updated January 2024). Developmental vendors listed in the RDSO Vendor Directory as reflected in UVAM for Item ID 3100558, as on the date of tender closing, may be considered for developmental orders up to 20% of the net procurable quantity. Developmental vendors shall be eligible for consideration only if they hold unconditional approval status In U-VAM as on the date of tender closing. Developmental Vendors reflected in the RDSO Vendor Directory with conditional approval/General Remarks (e.g.. field trials, prototype approval, limited or temporary approval etc.) shall not be eligible for order placement. The status of the vendor (i.e. approved or developmental vendor) shall be reckoned as available in U-VAM on the date of tender closing thereafter.However, date and cases not of downgrading/removal/suspension/banning etc., after closing date of tender, shall be taken into account while considering the offers. Note: If the works address indicated in an offer is different from what is indicated in the approval certificate issued by the respective vendor approving agency or appearing in Vendor Directory reflected on U-VAM, then such offer will be treated as if the same has been received from an unapproved source

   Where there are not more than three Indian suppliers categorized as "approved vendor" for a particular item, vendors categorized as "developmental vendors" can be considered for placement of bulk order, without any quantity restrictions, considering factors such performance, requirements, as past capacity, delivery under quantity procurement, nature of item, outstanding order load etc. in a transparent manner, in terms of Clause 3.3.4 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated Latest).

   In keeping with the Public Procurement (Preference to Make in India) Order 2017, latest revision, it has been found that there exists sufficient local capacity and competition in supply of the tendered item of required quality and therefore public procurement of the item is restricted to Class I local suppliers only and the vendors who do not qualify to be Class local suppliers should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a Class I local supplier for the tendered item participates in the tender it does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor. Terms of Clause 5 of Section II of CENTRAL RAILWAY BID DOCUMENT (Updated Latest) is applicable.

   Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

   Inspection shall be process inspection by RITES as per Railway Board letter No 2024/RS(G)/779/12 dated 06.01.2025 (Enclosed with NIT)

   Bidders must note that for offers having vague delivery schedule like - as per your requirements- or any time delivery- or indefinite like -02 to 12 months- or like -06 to 08 months- etc, delivery period while issuing the contract shall be given as per the requirement best suited to this office within the quoted range. No further claim by the bidder shall be admissible in such cases.

   By default your offer shall be considered as valid for 90 days from the date of tender opening. This is a mandatory requirement and no deviations to this will be permitted or considered while consideration of the offer. Bidders not willing to accept this condition must not submit the offer. Bids if submitted shall be considered as deemed acceptance of this condition. Any deviation regarding this or remarks for not agreeing to this condition, offered in the deviation column or anywhere including in uploaded document will not be accepted or considered while consideration of the offer. The purchaser may, at his discretion ignore any such deviation, if quoted, while issuing the contract. No further claim by the bidder shall be admissible in such cases.

    Offers will be evaluated strictly as per the eligibility criteria as defined under para ELIGIBILITY CONDITIONS : Special Eligibility Criteria of this tender document. Any other eligibility criteria if mentioned anywhere in any of the uploaded documents will have no relevance with respect to evaluation of the bids.

    Warranty for ERCs shall be 36 months from date of issue of inspection certificate or 30 months from date of actual fitment in the track, whichever is earlier.

    In tenders where inspection agency is mentioned as TPI, Inspection by any of the TPI shall be binding on the bidder and the Railways will decide TPI agency. Bidders having willingness for any specific TPIs only must not participate in this tender. Bids if submitted shall be considered as deemed acceptance of the bidder for inspection by any of the TPI without any specific choice even if mentioned by the bidder anywhere in their offer. Indicating choice of specific TPIs in the deviation column or anywhere including in uploaded document will not be accepted or considered while consideration of the offer. The purchaser may, at his discretion ignore any such specific choice of TPI, if indicated by the bidder, while issuing the contract. No further claim by the bidder shall be admissible in such cases.

   Bid Securing Declaration [Applicable only for bidders availing exemption from submission of EMD]-I/we certify that my/our offer is eligible for exemption from submission of bid security/ Earnest Money Deposit, in terms of the tender conditions. In case my/our claim to exemption from submission of bid security/ Earnest Money Deposit is not found valid as per terms of the tender, I/we understand and accept that Railways has unquestionable right to summarily reject my bid and my offer shall not be considered for ordering. Further, I/we hereby understand and accept that if I/ we withdraw or modify my/ our bids during the period of validity, or if I/ we are awarded the contract and on being called upon to submit the performance security/ Security Deposit, fail to submit the performance security/ Security Deposit before the deadline defined in the request for bid document/ Notice Inviting Tender, I/ we shall be debarred from exemption of submitting Bid Security/ Earnest Money Deposit and performance security/ Security Deposit for a period of 6 [six] months, from the date I/ we are declared disqualified from exemption from submission of EMD/SD, for all tenders for procurement of goods issued by any unit of Indian Railways published during this period.

   If the Contractor, having been called upon by the Purchaser to furnish security deposit, fails to make a security deposit within the specified period, it shall be lawful for the Purchaser to cancel the Letter of Award and to recover from the Contractor the amount of such security deposit by deducting the amount from the pending bills of the Contractor under any other contract with the Purchaser or the Government or any person contracting through the Purchaser or otherwise howsoever, duly adjusting the Earnest Money deposit, if any, made by the contractor.
